도서관간 복제. 전송에 의한 디지털 정보의 공동이용을 위한 도서관 면책 연구 = A Study on Library Exemption for the Cooperative Utilization of Digital Information by Digital Republication and Transmission between Library and Library

To promote the production of information and knowledge in infor mation user and to raise national competitiveness indigital network environment, the cooperative utilization of dig ital information by digital republication and transmission betw eene utilization of digital information by digital republication a ndtransmission between library and library is influenced by the r egulation of library exemption in copyright law. First of all,this study analyzes limitations and exceptions of copyright in international norm(Berne Convention, Agreement on TRIPsDirective. And then this study analyzes and examinesthe regulation of library exemption in the revised Copyright Ac t of Korea in 2003, library remuneration system, technicalmeasures for protection of copyright, etc. Also this paper poin ts out related problems. 디지털 네트워크 환경 하에서 정보이용자의 지식·정보의 창출을 도모하고 국가경쟁력을 제고하기 위해서는 도서관간 디
지털 복제·전송은 필수적이다. 도서관간의 디지털 복제·전송에 의한 정보의 공동이용 정책에 절대적인 영향력을 미치는 것
은 저작권법상의 도서관 면책 규정이다. 먼저 국제규범(베른협약, TRIPs협정, WCT)과 미국, 유럽연합의 저작권 제한과 예외
규정을 분석하였다. 이어서 우리 나라 2003년 개정저작권법상 도서관 면책 규정의 관련 규정, 도서관 보상금 제도, 권리 보호
조치 등의 내용을 집중 분석하였다. 그와 관련하여 제기되는 문제점도 논의하였다. 끝으로 본 연구 결과를 기초로 하여 도서
관간 디지털 복제·전송에 의한 정보의 공동이용 활성화를 위하여 개정된 저작권법에 대한 도서관의 현실적인 조치와 대응방
안을 제시하였다.
