외국인 근로인력 법제의 문제점과 개선방안 = 농어업 분야 활용방안을 중심으로

국문 초록 (Abstract)

농어업인력의 계절적인 집중으로 인하여 농어업 분야의 인력부족이 심각하다. 이 논문에서는 농어업분야의 외국인력 활용을 위한 외국의 입법례와 외국인 근로인력의 법제와 문제점을 검토하고 외국인 근로인력을 농어업 분야에서 활용하기 위한 제도개선 방안을 다음과 같이 제시하였다.
첫째, 농어업 분야의 인력수요를 보다 정확히 예측하여 농어업에 배정된 쿼터를 안정적으로 확보하여야 한다.
둘째, 우리나라의 농어촌환경에 친숙한 재외동포들을 농어업분야에 끌어들이는 유인책이 필요하다.
셋째, 농어업분야에는 캄보디아, 네팔, 태국, 미얀마 등의 국가에서 외국인력을 도입하고 있는데 대부분 남방계 열대농업 국가이다. 우리와 농업여건이 비슷한 중국, 몽골 등 북방국가를 농어업 인력송출국가로 지정할 필요가 있다.
넷째, 미국, 독일, 프랑스에서는 계절근로자(seasonal workers)제도를 채용하고 있다. 농어업의 계절적 집중문제를 해결하기 위하여 계절적으로 근로를 제공하는 단기 계절근로자 제도를 도입할 필요가 있다.
다섯째, 단기취업(C-4), 관광취업(H-1), 유학생(D-2)과 같은 단기체류 외국인을 농어업인력으로 유입시킬 필요가 있다.
여섯째, 국내에 상시 거주하는 거주(F-2), 결혼이민(F-6), 영주(F-5) 자격자를 농어업 인력으로 활용할 필요가 있다.

다국어 초록 (Multilingual Abstract)

Due to the seasonal intensive of foreign workers in agriculture and fisheries fields, serious shortage of labor occurred in the field of agriculture and fisheries.
This article addresses foreign legislation and law in the field of agriculture and fisheries to utilize foreign labor in the field of agriculture and fisheries field, and proposes improvement plan to utilize foreign labor for agriculture and fisheries fields as follows.
First, it is necessary to prepare the incentives to attract overseas Koreans who are familiar with our countrys rural areas.
Second, in the field of agriculture and fisheries, foreign workers are currently introduced from Cambodia, Nepal, Thailand, Myanmar, etc. which are the country of tropical agriculture in Southeast Asia. However, it is necessary to designate China, Mongolia which are in northern countries and in similar situation with our agriculture environment as labor sending countries in the field of agriculture and fisheries.
Third, the United States, Germany, and France employ the seasonal workers scheme. To solve the seasonal intensive of foreign workers in agriculture and fisheries fields, it is necessary to introduce the system of a short-term seasonal employment to provide seasonal workers.
Fourth, it is necessary to employ short-term influx of foreigners like the short-term employment (C-4), tourism employment (H-1), and students (D-2) as foreign labor in the field of agriculture and fisheries.
Fifth, it is necessary to utilize a full-time residents living in Korea like residence (F-2), married immigrant (F-6), and permanent residence (F-5) as labor in the field of agriculture and fisheries.
