아동·청소년이용음란물의 범위에 대하여

국문 초록 (Abstract)

최근 아동·청소년이용음란물 배포죄와 관련하여 총 19건이 사건이 항소심 및 상고심에 계류되어 심리 및 확정되었다. 법원의 입장은 아동·청소년이용음란물의 범위를 규정한 아동·청소년의 성보호에 관한 법률 제2조 5호를 가능한 엄격하게 해석하는 것으로 보인다. 아동·청소년이용음란물의 범위에 대한 논의에 있어 기본적으로 판단 자체가 어려운 이유는 비록 그 범위에 있어 나름대로 세분화하려고 노력한 흔적은 보인다 하더라도 비교법적인 분석을 통해서 드러났듯이 현행법 규정은 지극히 불명확하고 단순하다는 것이다. 영국의 예에서 알 수 있듯이 오히려 아동청소년이 성교행위를 하지 않는다 하더라도 그러한 성교행위를 직접 목격하는 것을 촬영한 포르노물이 해당 아동에 대한 피해는 더 클 수 있기 때문에 이를 규제할 필요성은 상당하다고 인정됨에도 불구하고 그와 같은 영상 등은 조문 해석과 판례의 입장을 고려해 볼 때 우리나라의 경우에는 아동·청소년이용음란물로 구분되지 않을 것이라는 현실과 단순히 “명백하게”라는 용어를 추가함으로써 해서 법규정의 해석이 용이해지고 분명해지리라고 본 입법권자들의 반성이 필요하다고 본다.

다국어 초록 (Multilingual Abstract)

Lately there have been nineteen criminal cases stacked at various courts in Korea regarding the accused who intentionally uploaded pornographic materials depicting girlish people with schoolgirl custom having sexual intercourse with men. The image of wearing school-uniform-like clothes may come to people differently. Some may regard the Image as fantasy because it feeds their particular needs of sexual satisfaction. Others would think the women with schoolgirl uniform as the closed image to the actual schoolgirls. A question is whether we can equate the Uniform with the image of minors. In that case the symbolization would work towards prosecution.
According to Article 2-5 of Act on the Protection of Children and Juveniles from which was the Article at issue in abovementioned nineteen cases, it provides “the term child or juvenile pornography means depiction of children or juveniles or persons or representations that can be perceived evidently as children or juveniles” doing many sort of sexually explicit acts. The lingering question in interpreting the Article is how people would perceive the image of adults or the created/simulated image by computer technology as evidently as the one of actual child/juveniles. Courts seem to agree that schoolgirl uniform cannot be the sole feature making the image close to the one of actual children or juveniles.
