민간조사업의 도입에 관한 질적 연구 = A Study on the establish direction of the Private Investigation Act

In our country, needs of Private Investigation have been increasing by demands of public safety services with increasing of public order consciousness. Private Investigation have been needed by count testimony data, trial-related services, cooperation with law enforcement agencies, handling of missing children, runawaypeople, missingpeople, business related crimes, privacy related crime. But in our country, services of Private Investigation have been spreading to Private Investigation agencies derived by illegal needs, foreign private guard companies, domestic private guard companies in our country. In this study, we examined what is the situation of present Private Investigation and what is the suitable enactment of Private Investigation Act. For the study, we did In-depth Interview that one of the in-depth qualitative research and analyzed how private guard enterprise think about detective businesses through data analysis of NVivo8 program. After conducting interviews, it has been found that the employees of private investigation companies had negative views on the cooperation with the police. Besides, they said that their work ethic was severely low, which led to the purchase and use of illegal equipment. Second, it has been believed that the reason for the emergence of such private investigation companies was due to an increase in the demand of private investigation, according to the changes in the conditions of public order and security. Private security companies accepted cases of private investigation due to the demand of such cases, and it has been believed that this was due to the degradation of quality in private security industry. Third, they said that the unification of service entity for private investigation and security was made by the demand of clients. Meanwhile, it was told that the staff in charge of private investigation performed security duties, thus bringing up the positive effects of psychological stability on clients` part. Fourth, the research participants believed that the most effective way to support private investigation in the field would be a method of adding private investigation into security industry act. This would be possible since security companies have already accepted the cases of private investigation. If the suggested method were put into practice, they believed that it would be convenient to run private investigation companies and would resolve current problems, such as conflicts with Korea Bar Association in the current legislation processes.
