    This article analyzes the detailed content and effectiveness of the United Nation’s economic sanction against North Korea provoked by the North’s decision to conduct it’s two nuclear tests. This article first analyzes the specific content of the United Nation’s Security Council Resolution 1718 and 1874, while also focusing on its practical limitations.
    Contrary to the UN’s objective, the research findings suggest that economic sanctions against North Korea are not as effective as intended. In relation to the requirement for member states to report North Korea’s violations, only 93 member states among 193 participating nations have reported cases, a mere 48 percent participation rate. The search and seizure of luxury goods constituted the lowest record among reports filed to the UN.
    The UN’s North Korea sanctions are confronted by the following limitations. First,the UN lacks enforcement measures to force member states from participating in sanctions against North Korea. The UN can play the role of ante reassurance of actors by enhancing cooperation but it lacks the capacity to impose post punishment against nations that fail to comply. Second, there is discordance between the volition and capacity of participating major players. China who holds the largest political and economic influence over North Korea is not an active participant of sanctions, while the US, despite taking the lead in imposing sanctions, is unable to exert leverage aside from military pressure. South Korea is in an unique position of participating in sanctions against North Korea and being unable to sever ties with the pariah state. Despite the implementation of the May 24th measures,the expansion of the Kaesung Industrial Complex belittles effects of sanctions against the North. Third, the UN’s sanctions against North Korea was a selective measure targeting the governing regime. However, unlike its limited effect on the regime, the enforcement measures have damaged humanitarian efforts toward the North Korean people.
    In conclusion, the primary cause that reduces the effectiveness of the UN’ s sanctions against North Korea can be identified by a conflict of interest between the major players. China’s reserved attitude toward participating in the sanctions stems from the need to expand its influence over North Korea and simultaneously confront a rise in pro-American elements in neighboring countries, a result of the US pivot back to Asia strategy. If the competitive landscape between China and the US continues in the future,the UN’s economic sanctions against North Korea will continue to have little impact.

    이 글은 북한의 1·2차 핵실험으로 인해 촉발된 UN의 대북 경제제재의 구체적 내용과 실효성을 분석하고 있다. 먼저 UN안보리의 대북제재결의안 1718호 및 1874호의 구체적 내용을검토하고, 결의안 실행의 한계가 무엇인지를중점적으로 분석하였다. 그 결과 UN의 목표와다르게 대북 경제제재의 효과가 낮게 나타나고있었다. UN이 요구하는 북한의 위반사례 보고와 관련해서 UN의 제재참여국 193개국 중 93개국만이 보고하고 있어, 보고율은 48%에 머무르고 있다. 제재안이 결의된 후 초반에는 보고율이 높지만 시간이 경과할수록 점차 보고율이 떨어지는 추세를 보였고, 제출된 보고서도질적인 면에서 내용이 부실한 것으로 나타났다. 특히 사치품의 수색 및 압수에 대한 보고율이 매우 낮았다.
    UN의 대북제재가 잘 시행되지 않는 데에는다음과 같은 한계점이 있기 때문인 것으로 사료된다. 첫째, UN은 대북 제재안을 제대로 이행하지 않는 국가를 처벌할 강제력이 결여되어있다. 실제로 UN은 국가들의 공조를 가능케 하는 ‘사전적 재보증(ex ante reassurance)’의 역할은 어느 정도 수행할 수 있지만, 제재와 관련한국제공조를 성실히 이행하지 않는 국가에 대한‘사후적 처벌(ex post punishment)’의 강제성은없다. 둘째, UN의 대북제재에 참여하고 있는주요 국가들의 제재에 대한 의지와 능력에 불일치성이 존재한다. 북한에 대해 가장 큰 정치적, 경제적 영향력을 보유하고 있는 중국은 대북제재에 적극적으로 참여하지 않고 있고, 제재를 주도하고 있는 미국은 북한에 대한 군사적 압박을 제외하고는 큰 영향력을 발휘할 수없는 것이 현실이다. 강력한 군사적 압박 수단은 미국의 세계전략 운영차원이나 동북아 정세를 감안할 때 실용적인 정책수단으로 활용되기에는 많은 제약이 있다. 한국도 대북 경제제재에 참여하고 있지만 북한과의 관계를 아주 단절할 수 없는 특수한 상황에 처해 있다. 따라서5·24조치에도 불구하고 개성공단의 사업은 계속 확장되어 대북 경제제재 효과가 감소한 것으로 판단된다. 셋째, UN의 대북제재는 제재대상국의 지배세력을 목표로 하는 선별적 제재이지만 실제로는 지배세력에게 큰 타격을 주지못하였고 오히려 국제사회의 인도적 지원 감소로 북한의 일반주민들에게 피해를 준 점도 부정적 요인으로 작용한다.
    결론적으로 보면, UN의 대북제재 효과를 감소시키는 가장 큰 요인은 주요 행위자인 미국과 중국의 국가이익이 대립했기 때문이다. 이에 따라 기타 국가들은 대북 경제제재 참여와관련한 정책적 선택의 폭이 넓어졌다. 중국이UN의 대북제재에 소극적인 이유는 첫째, 북한에 자국의 영향력을 확대하기 위해서이고 둘째, 미국 오바마 정부의 동아시아 회귀 정책에따른 역내 국가들의 친미 성향 강화에 대응하기 위한 전략적 선택이라고 판단된다. 앞으로도 동아시아에서 미국과 중국의 경쟁구도가 지속된다면 UN을 통한 대북 경제제재는 큰 효과를 거두지 못할 것으로 전망된다.
