선거운동 규제의 제도적 변화와 지속성 = The Institutional Change and Continuity of Election Campaign Regulations : A Focus on the Institutions Concerned with the Election Campaign of the National Assembly

국문 초록 (Abstract)

이 연구는 해방 이후 우리나라의 선거운동 규제가 어떻게 형성되었고, 변화하였는지를 분석하고자 한다. 건국 초의 선거운동 규제는 미국의 영향을 받아 자유주의적인 법제였으나 1958년 여야의 보수 세력이 합의하여 민의원·참의원 선거법 개정하고 선거운동에 대한 규제가 강화되었으며 현재까지 규제중심적인 선거법제의 제도적 지속성이 유지되고 있다. 향후 선거운동 규제의 제도적 개선방안으로는 대통령, 국회, 헌법재판소, 선관위등 주요행위자들의 아이디어의 전환이 필요하고, 급진적 변화보다는 내적 모순이 있는 규정과 유권자의 알권리 및 표현의 자유와 관련된 규정을 중심으로 점진적으로 제도를 변화시키며, 장기적으로 행태적 규제는 줄이고 비용규제를 강화하는 노력이 필요하다.

다국어 초록 (Multilingual Abstract)

This study is aimed to analyze how the election campaign regulations in Korea was formulated and changed since the nation was built in 1948. Although the election campaign regulations at first was liberal under the influence of the U.S. military trusteeship, they have been changed into strictly regulative regimes since the conservative political coalition in the national assembly revised election law in 1958. Such a suppressive regime has maintained institutional persistence until now. This study makes some suggestions that main actors like the president, the national assembly, the constitutional court and the national election commission should change the ideas on the election regulation and change the regulations that are inner-contradictory and concerned with the rights of expression gradually. It is also needed to decrease the behavior-related regulations and intensify the cost-related regulations.
