    I. The Article 250 of Korean Civil Code prohibits the bona fide acquisition of stolen or lost movables. It says: “If the movable mentioned in the preceding Article is a stolen or lost article, the suffering party or the owner of lost article may demand to return the article within two years from the time when the article was stolen or lost. However, this rule will not apply when the lost or stolen article is money.” Therefore the Art. 250 of Korean Civil Code makes an exception for the Art. 249 of Korean Civil Code which regulates the bona fide acquisition of movables generally. It also includes a proviso to itself, that is to say, an exceptional rule in order to grant the bona fide acquisition of money, although the money has been lost or stolen. This proviso of Art. 250 of Korean Civil Code has its own interesting history which is the topic of this paper. II. The Korean Civil Code has 3 provisions about bona fide acquisition of movables. In the gross, they are very similar to Art. 2276 and 2277 of French Code Civil. Nonetheless the conditional clause in Art. 250 of Korean Civil Code derives not from French law, but from German law. Its predecessors are provisions like Paragraph 935 section 2 of German BGB and Art. 935 of Swiss ZGB. So the Art. 250 of Korean Civil Code can be understood as a combination of French and German law about bona fide acquisition of movables. III. How was this combination of French and German law possible at the Art. 250 of Korean Civil Code? It was not an original work of Korean legislators. This kind of legislative combination was first achieved by the Art. 231 of Manchurian Civil Code which was the product of Japanese legal science of 1930s to avoid some problems of Art. 193 of Japanese Civil Code. Because the Art. 250 of Korean Civil Code was a solution to Japanese problems about bona fide acquisition of money, the Koreans needed not to import the Japanese theory about money which was an inevitable escapeway to cope with the problematic Art. 193 of Japanese Civil Code. However the Koreans fully accepted the Japanese theory about money, which can only be explained as an example of massive influence of Japanese legal science on Korea.
