소비자계약에 있어 철회권에 관한 횡단적 검토 = Study on a Right of Withdrawal in Consumer Contract

The primary aim of withdrawal rights is to allow the consumer time for further consideration (a so-called .cooling-off’ period) and for obtaining information. If the consumer withdraws from his declaration of intention within the period specified. The declaration must unambiguously reflect the consumer’s decision to withdraw from the contract. The withdrawal does not have to provide any grounds.68) The withdrawal period is seven days in Korea consumer law. Unless otherwise provided, it begins upon the contract having been concluded. If a consumer is given a right of withdrawal, then the consumer and the trader are no longer bound by their declarations of intention to conclude the contract. In the case of the contract being withdrawn from, the performance received is to be returned within three days. The DCFR and the CESL adopt similar approaches in regulating the exercise of the right of withdrawal. And in German law, the provisions on the rights of withdrawal are primarily based on European directives.
