This paper tried to show and outline why we have to see youth rights as distintive rights which are different from those which might be claimed by, or, for young children. The main aim of this analysis was to show the major problems being faced by youths, who are often infringing their rights of self-determination or rights of participation etc. These problems of infringing youth rights were mostly resulted from ambiguous point of view on youth, which treats youth as a little child. For seeking the distintive character of youth rights, the concepts, and interests of children and youth were reviewed and compared as follow. The first chapter examined the concepts of `childhood` and `youth` and explored how the meaning of these concepts had been changed since preindustrial society. Based on the historical analysis, it was found that semidependent period of youth is different from dependent period of childhood. The second chapter focused on different needs and interests between two groups: children and youth. The different needs of each group should be paramount in drawing up the children`s rights and youth rights. Finally, basing on the different concepts and needs between childhood and youth, which were analysed in previous chapters, in this part, paradigms of rights for each groups were provided. It showed that youth have distinctive rights which follow from the conceptualization of youth as a series of transitions from the relative dependency of childhood to relative independence of adulthood.
