공인중개사법상 중개보수의 문제점과 개선방안 = The Study on The Problems and Improvement of Brokerage`s Fees Under the Licensed Real Estate Agent Act

The role of a real estate agent is significantly important in the pre-existing real estate dealing. In case of making the sales and purchase or lease of a house in a daily life or the sales and purchase or lease of a shopping building, we will make a request to a professional real estate agent. The real estate agent will request a brokerage commission in consideration of the conclusion of such dealing. Because it deems that a real estate agent has professionality and is confident, we will pay a brokerage commission. The professionality varies from a person to a person and the difference of confidentiality may be occurred depending on real estate agent, size and employees. However, most of real estate agents claim their brokerage commissions about real estates without variation. It is doubtful whether the brokerage commissions received by them are proper and reasonable. Therefore, in order to cause the broker`s fee to be operated and claimed properly, we would like to make several proposals. First, it is required to clarify the consultation time of a brokerage commission under the Licensed Real Estate Agent Act. Second, it is necessary to make the rating of the brokerage commissions through the acknowledgement of a premium for a brokerage object. Third, it is necessary to make the brokerage commissions actualized owing to the reversal phenomenon of the brokerage commissions. It shall be found a plan to make them win-win by the actualization of the brokerage commissions.
