전자화폐의 법적 문제 = A Study on the Legal Problems of Electronic Money

다국어 초록 (Multilingual Abstract)

Electronic commerce become wide use than ever with the spread of computer and internet technology. Vitalizing electronic commerce needs more than a way to translate traditional payment systems to the electronic realm. Emerging electronic settlement systems are such as on-line credit card, electronic cash transfers, electronic money, electronic bill etc. Most of them is a conservative one, bent on adapting more familiar payment devices, such as magnetic stripe cards, credit cards, and cashier's checks, to the online environment. Nowadays on-line credit card is a most popular one, but electronic money is a unique one that to be fully electronic system so it will be more popular than others in the coming future.
Electronic money should offer equivalents of cash or certain banking transactions - particularly checks, drafts, and other credit or debit transfers - primarily in support of purchase transactions. But the legal problems of electronic money are not to clearly solved even though Electronic finance transaction law was enacted in Korea.
In this Article, the author identifies and discusses some of the obstacles to the legal issues of electronic money under Korean electronic finance transaction law. However, analysis of such obstacles is kept brief, for one reason. As high technology continues to evolve, such laws must, and surely will, change. Thus, this Article seeks to present a policy-oriented vision of what should be, rather than what is.
