불법으로 체류 및 노동을 하는 외국인근로자: 용어를 중심으로 = Foreigners Who Stay and Work on Going Against Legislations: Focused on Terms

다국어 초록 (Multilingual Abstract)

Every country has a limitation on emigration and immigration and labor of foreigners to protect natioanl interests and own peoples. In same purpose Korea has legislations like 「Act on foreign workers’ employment, etc」and 「Immigration Act」. Nevertheless there are foreigners who stay and work on going against legislations. The terms that are used to name them are not yet standardized: so diverse terms are used in literature and on document of civic group and government. But using standardized and obvious term is necessary to establish a clear notion and to set the range of discussion. This paper starts from this standpoint. In chapter Ⅱ, different terms which are used at present are introduced and it is explained why each of the terms is improper. In chapter Ⅲ, the requirement for legal stay are discussed on the base of 「Immigration Act」and the terms naming foreigners who are against the requirement are introduced . In chapter Ⅳ, the requirement to be legal foreign labors are discussed on the base of 「Act on foreign workers’ employment, etc」. The types of breach of the both legislations can be classified into three category: the case of breaking 「Immigration Act」, the case of breaking 「Act on foreign workers’ employment, etc」, and the case of breaking both legislations. And foreigners can not be legal foreign labors in any case of these. So in chapter Ⅴ, the term of ‘illegal foreign labors’ is suggested as proper to express every foreign labor who work on going against legislations.
