초국적 이주와 여성의 시민권에 관한 새로운 쟁점들

국문 초록 (Abstract)

이 글은 전지구화와 초국적 이주의 증가, 그리고 여성 이주의 경험들이 기존의 여성시민권 개념에 어떤 새로운 쟁점들을 제기하고 있는지 고찰하고자 한다. 이를 위해 기존의 시민권 이론을 비판하면서 페미니스트들이 제기했던 두 가지 논점에 초점을 맞춘다. 첫째, 많은 연구들은 산업화와 민주화의 결과 여성들이 ‘형식적’인 시민권은 획득하였으나 ‘실질적’인 시민권에서는 여전히 차별이 있다고 비판하였다. 그런데 최근 이주여성들이 직면하고 있는 체류권의 불안정성, 국적이나 영주권 취득의 장벽, 송환의 위험 등은 전지구화 시대에‘형식적’시민권의 중요성이 다시 부각되고 있음을 보여준다. 둘째, 페미니스트들은 시민권의 보편성과 포괄성 테제를 비판하고, 여성의 입장과 경험에서 본다면 시민권 형성과정은 오히려 선택성과 비대칭성이라는 특징을 갖고 있고 주장하였다. 시민권의 비대칭성과 파편화는 이주여성의 경험을 이해하는데 중요한 개념이다. 최근 이주동향을 보면 여전히 다수의 여성들은 가족 관련 지위를 통해, 즉 경제활동이나 정치적 망명 등 독자적인 권리의 주체로서가 아니라 다른 권리보유자와 연결된 ‘의존자’로서 이주하고 있다. 국제인권레짐에서 가족 재결합권이 확대되고 국적취득에서 성차별을 개선하는 변화들이 있었지만, 현실적으로 가족재결합권이 성별이나 인종, 가족규범에 대한 문화적 기준에 따라 일정하게 제약되는 사례들이 여전히 나타나고 있다. 한국에서도 여성의 노동이주는 매우 제한되어 있으며, ‘다문화가족’ 중심의 정책 프레임은 이주여성의 의존성을 한층 더 강화하고 있다. 국제인권레짐의 영향으로 폭력 피해여성이나 자녀를 양육하는 이주여성에게 체류자격을 인정하는 등 일정한 법 개정이 진전되어 왔다. 그러나 결혼 이주여성의 체류권과 국적취득, 자녀에 대한 권리(양육권, 면접교섭권), 그리고 사회권 등 다양한 권리들 사이의 모순과 상충은 여전히 해소되지 못하고 있다. 초국적 시민권에 대한 논의는 국민국가를 전제로 하는 시민권 개념을 비판함과 동시에 시민권에 내포된 가족(전통적 가족)에 대한 전제들도 재검토해야 한다.

다국어 초록 (Multilingual Abstract)

Regarding globalization and increasing transnational migration, particularly feminization of migration, this article observes several new issues in feminist citizenship discussion. Firstly, there has been a suggestion that women are included into the legal boundary of ‘formal’ citizenship in 20th century, so it is ‘substantial’ dimension of women’ citizenship which is at stake now both in feminist theory and practice. However, lots of migrant women from developing countries are now facing legal barriers such as uncertainty of rights to stay in host countries, threats of unexpected deportation and difficulties to access to permanent residency or nationality. This article emphasizes the basic rights and ‘formal’ citizenship of migrant women, regarding that most of women are crossing the national border as ‘dependent" members of family. Secondly, feminist researchers repeatedly argue that it is not universal and inclusive aspect but unequal and elusive aspect of citizenship system that compose most of women’ experience as being citizens and members of political community. This article is focused on the fragmented citizenship, in other words, internal contradiction among the different right systems, for example, legal status as alien residents, child custody and mother’ right to meet and care for children, women’ equal rights, basic right to social benefit, and right to being safe from violence.
