정의윤리와 배려윤리의 상보적 관계 = Complementarity of Ethics of Justice and Ethics of Care

다국어 초록 (Multilingual Abstract)

It is often the case that ethics of justice can be in conflict with ethics of care regardingmoral considerations in moral situations. Such conflicts cannot be solved merely by appealingto priority of one of justice or care, because the priority can be altered in each situation.
However, moral principles or rules are involved essentially in moral conflicts. It is the samewith conflicts between cares themselves as well as conflicts between justice and care. Viewedfrom the perspective of whole morals, justice and respect of rights presuppose caring.
However, in concrete moral problems we apply moral principles or rules first of all and solvethem taking the caring relation into consideration if necessary. Complementarity of justice andcare has to be considered in case of prevention as well as solution of moral problems. In caseof solution of moral problems ethics of justice plays more active role whereas in case of theirprevention ethics of care can do it exerting more powerful influence. Management of caringinstitutions or practices and cultivation of caring persons are needed in prevention of moralproblems on the ground of care ethics. We have to be concerned about ethics of care as wellas ethics of justice if we are interested both in the solution and prevention of moral problemsin moral education.

국문 초록 (Abstract)

도덕적 문제 상황에서 정의윤리와 배려윤리의 도덕적 고려사항들은 서로 충돌하는 경우가 많다. 그러한 갈등은 단순히 정의와 배려 중 어느 하나의 우선성에 의해 해결될 수는 없다. 그러나 도덕적 갈등에서는 본질적으로 도덕원리나 규칙이 관여된다. 도덕의 전체 맥락에서 볼 때에는 정의나 권리존중은 배려를 전제한다. 그러나 특정 도덕적 문제 상황에서 정의와 배려가 충돌함으로써 도덕 문제가 발생할 때에는 도덕원리나 규칙을 우선적으로 적용하고 상황에 따라 배려적 관계를 고려함으로써 문제를 해결한다. 정의와 배려의 상보적 관계는 도덕적 문제의 해결뿐만 아니라 예방 측면에서도 고려되어야 한다. 도덕적 문제의 해결측면에서는 정의윤리가 주도적 역할을 할 수 있지만, 예방적 측면에서는 배려윤리가 정의윤리보다 더 강력한 힘을 발휘하고 적극적 역할을 수행할 수 있다. 배려윤리의 예방적 측면에서는 배려적인 인간의 양성과 배려적인 제도나 관행의 운영이 고려될 수 있다. 도덕교육이 도덕적 문제의 지혜로운 해결과 함께 도덕 문제의 예방에도 관심을 가진다면 정의윤리와 함께 배려윤리에 대한 교육에도 신경써야 한다.
