성범죄자 신상공개제도의 타당성과 효과성, 그리고 배경에 대하여: 미국과 우리나라의 경우를 비교하여 = The Validity, Effectiveness and Backgrounds on Sex Offender Registration and Notification Acts: Comparing the U.S.A.`s and South Korea``s Cases

다국어 초록 (Multilingual Abstract)

Sex Offender Registration and Notification Acts (SORNA), which were legislated in the U.S.A. in 1993, were adopted by South Korea in 2001. After the acts were legislated in 2001 in South Korea, the information of sex offenders is being notified through internet from 2011. This paper investigates if the acts`` validity and effectiveness are supported in the U.S.A. as well as in South Korea. It is pointed out that the previous research results and criminal statistics do not support the validity and effectiveness of the acts not only in the U.S.A. also in South Korea. After the investigation of the validity and effectiveness of the SORNA, the backgrounds of the legislation of the acts were debated. It was proposed that SORNA were legislated by morally panicked citizens, who were raged through media``s exaggerated broadcasting of child sexual abuse. It was also suggested that the late modernity culture proposed by Garland(2001) sets the backgrounds of the legislation. Finally, It was pointed out that to make the acts more effective, considerations for sex crimes committed by acquaintances are required.
