풍속을 해치는 물품의 통관보류처분의 타당성 및 개선방안에 관한 연구 = A Study on the Withholding Customs Clearance of Sexual-device from the Sexual Self-determination Right

다국어 초록 (Multilingual Abstract)

According to Customs Act article 234(Prohibition on Export and Import), Books, publications, drawings, records, films, videos, sculptures and other similar goods which disrupt the constitutional order, disturb the public safety and order or corrupt public morals shall not be exported or imported. Where matters of obligation under the provisions of this Act are violated or the public health, the head of any customhouse may withhold customs clearance for the relevant goods(Customs Act article 237). Customhouse on the basis of this provision withholds customs clearance for sexual-device. Our courts have interpreted ``public morals`` as ``obscene``. However, ``obscene`` is depending on time and place that it is also subject to its meaning in the indeterminate concept. Withholding customs clearance for sexual-device seems to saction administrative intends to limit to sexual self-determination right. Sexual self-determination right may be limited according to Constitution Article 37 in order to maintain the public welfare. However, the right can not be limited by the intrinsic contents, and even limit the infringement of the principle of the minimum. Legislatively it is necessary to change ``public morals`` to ``pornography``, which is a technical concept. Among pornography, the soft-core pornography is principally allowed to import. Sexual-device is also contained soft-core pornography. But the head of any customhouse may withhold customs clearance after examinating by a judging committee. However, the children``s pornography, even soft-core pornography, that should be prohibited when considering the importance of children sex protection.
