경찰 정당성이 법의식에 미치는 영향에 관한 연구 = A Study on the Effects of Police Legitimacy on Legal Consciousness

국문 초록 (Abstract)

준법행위는 사회통제의 요체인 까닭에 경찰학의 주요 연구대상이 되었다. 준법행위는 이면의 동인에 따라 능동적이거나 수동적이다. 보상과 처벌을 활용한 수동적 준법행위는 일시적이며 불안정한 반면 정당성에 기인한 능동적 준법행위는 개인의 내적인 태도와 결부되기에 자발적이며 장기적이다. 이에 경찰학에서는 경찰 정당성의 원인과 결과가 지속적으로 고찰되었다. 다만 경찰 정당성의 결과로서 준법행위만 논의된 점은 한계로 분석되었다. 경찰 정당성에서 출발하는 준법 행위의 근간에는 법규범에 대한 내적인 가치 판단이 존재하는 까닭이다. 이에 이 연구에서는 준법행위와 내적인 가치 판단을 법의식이라는 상위의 개념으로 포괄한 후 경찰 정당성의 영향력을 검증하였다.
다중회귀분석을 실시한 결과 경찰 정당성은 준법행위에만 통계적으로 유의미한 정(+)적 영향을 미치는 것으로 확인되었다. 비록 경찰 정당성이 법규범의 우호성이라는 정서를 유발하지는 못하였으나, 준법 행위는 유도하는 만큼 정당성의 의의를 역설하였다.

다국어 초록 (Multilingual Abstract)

Law-abiding acts have become a major subject of research in police science because it is an vital element of social control. The law-abiding acts are active or passive depending on drivers behind them. While passive law-abiding acts using compensation and punishment are temporary and unstable, active law-abiding acts due to legitimacy are voluntary and long-term because they are related to an individual's internal attitude. Thus, causes and consequences of police legitimacy have been studied in police science. However, the fact that only law-abiding acts were discussed as a result of police legitimacy was considered as a limitation. This is because behind the law-abiding acts, which start with police legitimacy, there is an internal value judgment on the law and criminal. Hence, this study included law-abiding acts and internal value judgment as a higher concept of legal consciousness and then verified the influences of police legitimacy.
Multiple regression analysis shown that police legitimacy had a statistically significantly positive effect on law-abiding acts only. Although police legitimacy did not arouse legal favorability, the importance of legitimacy was not denied as it still induced the law-abiding acts.
