다문화주의와 여성주의의 충돌 = A Clash between Multiculturalism and Feminism: The Case of Cultural Defense in the US

국문 초록 (Abstract)

다문화 사회가 발전하면서 직면하게 되는 문제 중의 하나는 상충된 문화 혹은 가치의 충돌이다. 여기에는 주류 문화와 소수 이민자 문화 간의 충돌로 있지만, 소수 집단의 문화적 관습과 보편적 가치와의 충돌도 포함된다. 특히 여성주의자(페미니스트)들이 최근 주목하고 있는 것은 소수 이민자 집단이 용인하고 수용하고 있는 문화적 관습 중에 여성의 보편적 인권과 충돌하는 부분이 상당히 있다는 사실이다. 이러한 충돌이 발생할 경우, 국가는 어떻게 대응해야 할 것인가?
본 연구는 다문화주의와 여성주의 간에 발생하는 충돌을 미국의 소수 이민자 집단에게 적용되어 온 "문화적 항변" 제도를 중심으로 살펴본다. 먼저 다문화주의와 여성주의와의 관계 및 충돌을 구성주의적 문화관에 입각하여 새로운 시각에서 재조명한 후, 이러한 새로운 시각에서 미국의 형사재판 과정에서 발생한 문화적 항변 사례를 구체적으로 살펴본다. 이러한 사례를 통해서 얻을 수 있는 결론은 문화적 항변을 무조건 포기하거나 무조건 인정하는 방식보다는, 이의 인정 여부를 각 사안별로 신중하게 판단해야 한다는 것이다. 그리고 이러한 판단 과정에서 관련자들의 참여와 의견을 독려함으로써 민주적 심의를 실현해야 할 것이다. 이러한 해결방법은 비단 문화적 항변 사례뿐만 아니라, 다문화주의와 여성주의가 충돌하는 경우 일반적으로 적용될 수 있다.

다국어 초록 (Multilingual Abstract)

One of the inevitable problems resulting from the progressing of a multicultural society is the possibility of conflicts between different cultures, and between culture and universal values. In particular, feminists have been focusing, in recent years, on the possibility that some of the minority groups" cultural practices accommodated by Western democratic countries might infringe upon the universal rights of women. When such a conflict occurs, how should a state respond?
This study examines this conflict between multiculturalism and feminism with the case of cultural defense in the US. After presenting a constructivist view on culture, the study critically examines, from this new perspective, a few specific cases where cultural defense were applied to protect minority groups in the US. One conclusion derived from the case study is that instead of accepting or denying cultural defense unconditionally, we should carefully judge whether to accept cultural defense or not in each criminal case. In the process of reaching the judgement, we should take an approach of democratic deliberation by encouraging participation and opinions from all the concerned people. This deliberative approach, of course, can be applied not only to the case of cultural defense, but also to the resolution of any conflicts between multiculturalism and feminism.
