Each year the number of Internet subscribers in Korea increases exponentially. As a result, as for Internet service, which began regularly more than ten years before, Korea came to boast the world’s highest Internet penetration rate. So, discussions are required for a solution of various problems occurred with rapid Internet environmental changes. In the United States, the concept of network neutrality was discussed while amending the Communication Act of 1996. However, there has been on hiatus in provisions, caused from negative views on network neutrality and a variety of problems due to conflict of interest. It’s also true in Korea.
Recently, beyond the traditional wired Internet services, with development of wireless Internet markets made by spread of smart phone, introduction of net neutrality is a hot topic of discussion in the wireless Internet service. The m-VoIP service, offered through a wireless network with wireless Internet service, is the most controversial service in the wireless Internet network neutrality. Therefore, through such an issue, it’s regarded to be possible to identify a point of future discussions on network neutrality.
This paper intends to examine network neutrality of the existing and that of m-VoIP service from a legal point and review the relevant cases.
