m-VoIP 서비스에서의 망 중립성에 대한 법적 검토 = A Study on the Issues of Network Neutrality for m-VoIP Service in Law

Each year the number of Internet subscribers in Korea increases exponentially. As a result, as for Internet service, which began regularly more than ten years before, Korea came to boast the world’s highest Internet penetration rate. So, discussions are required for a solution of various problems occurred with rapid Internet environmental changes. In the United States, the concept of network neutrality was discussed while amending the Communication Act of 1996. However, there has been on hiatus in provisions, caused from negative views on network neutrality and a variety of problems due to conflict of interest. It’s also true in Korea.
Recently, beyond the traditional wired Internet services, with development of wireless Internet markets made by spread of smart phone, introduction of net neutrality is a hot topic of discussion in the wireless Internet service. The m-VoIP service, offered through a wireless network with wireless Internet service, is the most controversial service in the wireless Internet network neutrality. Therefore, through such an issue, it’s regarded to be possible to identify a point of future discussions on network neutrality.
This paper intends to examine network neutrality of the existing and that of m-VoIP service from a legal point and review the relevant cases.

국문 초록 (Abstract)

우리나라는 인터넷 가입자의 수가 매년 기하급수적으로 증가하여 이제 세계 최고의 인터넷 보급률을 자랑하게 되었고, 이러한 빠른 인터넷 환경 변화를 통해 나타난 다양한 문제들의 해결 방안에 대한 논의가 필요하게 되었다. 미국에서 망 중립성이라는 개념이 1996년 통신법 개정 과정에서 논의된 이래 망 중립성을 규정화하려는 작업이 계속되고 있으나, 이에 대한 부정적 시각과 다양한 이해관계의 충돌 문제로 인하여 규정에 난항을 겪고 있으며, 이는 우리나라에서도 다르지 않다.
최근에는 기존의 유선 인터넷 서비스를 넘어 스마트폰 보급으로 인한 무선 인터넷 시장의 발달로 인하여, 무선 인터넷 서비스에도 망 중립성 도입에 관한 논의가 뜨겁게 진행되고 있다. 그 중 m-VoIP 서비스는 무선 인터넷의 망 중립성에서 가장 논란이 되고 있는 서비스이므로, 이 이슈를 통해 장차 망 중립성에 관한 향후 논의에 대해 파악할 수 있을 것이라고 본다.
본 논문에서는 기존의 망 중립성과 m-VoIP의 망 중립성을 법적인 관점에서 검토한 뒤, 관련 사례를 살펴보고자 한다.
