이 글은 사회권의 범위 안으로 포섭되는 권리자격 자체가 성별화되어 있다는 점에 착안하여 여성의 사회권에 대한 담론을 여성의 세 가지 지위, 즉 아내, 어머니, 노동자로서의 여성으로 나누어 살펴보고자 한다. 아내의 사회권은 유급노동자인 남성 배우자의 지위에 부수하는 파생적 권리이며 배우자 수당이나 소득공제, 유족연금 등의 제도형태로 나타난다. 아내의 사회권은 가족 임금제도가 실패할 경우 최소한의 보호를 사회가 제공하는 것으로 볼 수 있다. 유급노동에의 참여는 여성의 사회권에 중요한 권리자격이지만 노동시장 외부 혹은 주변부에 있는 여성들을 포괄하는데 결코 충분하지 않다. 어머니의 사회권은 약자로서의 여성에 대한 보호와는 구분되는, 어머니가 수행하는 돌봄 자체를 권리자격으로 인정하는 것으로 정의할 수 있다. 무급노동으로 수행되는 돌봄에 근거한 보편적 권리자격의 사례는 가족수당(모성급여)에서 찾을 수 있는데 유급노동에 근거한 급여에 비해 소득보장의 수준이 매우 낮은 경향이 있다. 여성의 사회권은 ‘보호’의 논리와 ‘책임’의 논리 사이에 끼어 있다. 보호에 수반하는 나약함과 의존성과 같은 부정적 낙인을 극복하고 독자적인 행위자로서의 자율성을 획득할 때, 또 과도한 책임과 희생에서 벗어나 돌봄에 대한 마땅한 사회적 존중을 받을 때, 여성은 온전한 시민으로써 사회권을 보장받을 수 있다. 최근 복지재편의 과정에서 유급 노동은 모든 시민의 의무와 책임으로 강조되고 있지만, 노동의 영역 밖에서 시민이 갖추어야 할 미덕, 공동체 활동에의 참여, 의존적 약자를 돌보는 일 등은 매우 가치로운 것이며 또 반드시 필요한 것이다. 복지와 시장을 조화시키는 복지혼합(welfare mix)에 대한 관심 못지않게 사회적 삶을 유지하는데 반드시 필요한 사회적 책임을 어떻게 분담하는가의 문제(responsibility mix)에 대한 본격적 논의가 필요하다.

Based on the feminist idea that the modern citizenship regime has a gender-differentiated characteristics, I’d like to investigate the formation of the women’s social rights from the three differentpositions of women as wives, mothers, and workers. The social rights of woman as a wife has been derived from her husband’s status as a paid worker and it has been institutionalized as tax credit and survivors’ pension in social insurance system. These benefits are designed to protect wives and other dependents of male breadwinners when so called family wage system wouldn’t work. The social rights of woman as a worker is very important entitlements to enhance women’s status as independent citizens who are able to pay tax and contribute to social insurance system. But the effect of this kind of social rights is severely limited in reality. It is very hard for lots of women to access to the decent jobs which contains lots of entitlements as a citizen-worker. Social rights as mothers are based on the recognition of unpaid care work which is mostly fulfilled by women. There are some policy examples which give universal entitlements to women as mothersfamily allowance to every mother with dependent children. But the degree of income redistribution of benefits based on the status of mother has been very limited when we compare it to that of other benefits given to paid-workers.
After describing the three-fold dimensions of women’s social rights, the conclusion is not to pick up the most relevant one from these three layers but to find out the dynamic processes and diverse realizations (and limitations) of women’s social rights which are varied with time and place. I think the position of women in social rights discourse is very obscure and very frail to normative criticism. As an object of protection women cannot be recognized as an autonomous and independent citizen. On the other hand, women as mothers who have responsibilities to care for children and weak family members cannot escape their burdenand have to restrict their participation as active citizens outside the domestic area. To suggest the alternative arguments for the women’s social rights as an able citizen, we have to discuss ‘the responsibility mix’ to maintain the adequate living standards of citizens in both public and private spheres.
