장애인 이동권과 차별구제 – 대법원 2021. 4. 1. 선고 2018다203418 판결을 중심으로 –

국문 초록 (Abstract)

대법원 2021. 4. 1. 선고 2018다203418 판결은 장애인차별금지 및 권리 구제 등에 관한 법률 제48조 제2항에 따른 적극적 조치 청구에 대해 대법원이 본안 심리를 통해 인정한 최초의 판결이다. 대상판결은 그간의 장애인 이동권 보장 수준의 개선을 보여주는 판결이면서, 동시에 장애인이 여전히 인격실현과 사회참여의 전제인 ‘지역 간 이동’에서도 어려움을 겪고 있는 우리 사회의 현실을 여실히 보여주는 것이기도 하다. 대상판결은 휠체어 승강설비가 설치된 버스에 길이 1.3m, 폭 0.75m 이상의 휠체어 전용공간을 설치할 의무가 있다고 판단하고 이에 부합하는 휠체어 전용공간의 설치를 명령하였는데, 판단 과정에서 장애인 당사자의 관점을 고려하였다는 점에서 특히 의미가 있다. 장애인의 이동권을 보장하기 위해서는 장애인이 집에서 나와 목적지에 들어가는 전 과정에서 연속적인 이동이 가능하도록 이동의 장애를 제거하기 위한 지속적인 노력이 요구된다.

다국어 초록 (Multilingual Abstract)

The Supreme Court Decision 2018Da203418 is the first ruling that the Supreme Court recognized a claim for remedial measures under Article 48(2) of the Act on the Prohibition of Discrimination against Persons with Disabilities after a review on the merits. The subject ruling shows the improvement of the level of guaranteeing the right to access to transportation of persons with disabilities, and at the same time it also clearly presents the reality of our society, where the disabled are still struggling with cross-regional movement, which is a premise of personality realization and social participation. The subject judgement ordered the installation of exclusive space for wheelchair users, which is particularly meaningful in that it took into account the perspective of the disabled party in the process of judgement. In order to enhance the right to access to transportation of the disabled person, continuous efforts are required to remove obstacles throughout the entire consecutive process from leaving the house to entering the destination.
