독일과 한국의 한부모가족을 위한 공공부조제도 비교 - 개별성의 원칙과 관련하여 -

국문 초록 (Abstract)

우리나라의 한부모가족을 위한 사회보장제도로는 저소득 한부모가족을 위한 「국민기초생활보장법」상 생계급여, 「한부모가족지원법」상 아동양육비를 제시할 수 있다. 그러나 생계급여는 양부모가족의 욕구를 기준으로 설계된 복지급여로 한부모가족의 추가적인 욕구를 반영하지 못하여 구체적 타당성을 결하고 있다. 구 「한부모가족지원법」은 생계급여를 수급하는 한부모가족의 경우 동법상 아동양육비를 수급하지 못하도록 규정하고 있었는데, 2020. 10. 20. 개정에 의해 생계급여를 수급하는 한부모가족에게도 10만 원의 아동양육비가 병급되는 근거를 마련하였다. 본고에서는 개정된 「한부모가족지원법」을 살펴보고 이에 대하여 평가하며, 독일의 한부모가족을 위한 사회보장제도를 살펴보아 우리 법에 시사하는 바를 살펴본다.

다국어 초록 (Multilingual Abstract)

There are the livelihood benefits of 「National Basic Living Security Act」 and benefits of 「Single-Parent Family Support Act」 as social security systems in Korea for single parent family. However, since the livelihood benefits are designed based on the needs of non-single parent family, the benefits lack specific validity because the benefits do not consider the additional needs of single parent family. The former 「Single-Parent Family Support Act」 ruled that the single parent family which receives the livelihood benefit could not benefit from the benefits of 「Single-Parent Family Support Act」. But newly revised 「Single-Parent Family Support Act」 ruled that even if the family receives the livelihood benefit, the family can receive childcare expenses. Therefore single families now can receive the livelihood benefit and 100,000 won of childcare expenses at the same time. In this paper, we examine the newly revised 「Single-Parent Family Support Act」, evaluate it, and look up the social security system for single parent family in Germany to examine the implications for our system.
