미국 장애인교육법과 우리나라 특수교육법에서 개별화교육프로그램(IEP) 고찰 = The Legal Comparison of IEPs between Korea and the United States

다국어 초록 (Multilingual Abstract)

Since the passage of Education for All Handicapped Children Act(EHA, P.L. 94-142), many countries adopted the Individualized Education Program(IEP) to improve the quality of education for children with disabilities. The Korean Ministry of Education amended the Promotion Act of Special Education in 1994 and adopted IEP for betterment of special education. Recently, the Special Education Act for Individuals with Disabilities and the Like has been enacted in Korea. At this point of time, This study reviewed and compared with the Promotion Act of Special Education and the Special Education Act for Individuals with Disabilities and the Like in Korea and the Individuals with Disabilities Education Art(IDEA, 1997) and the Individuals with Disabilities Education Improvement Act(IDEIA, 2004) in the United States. The purpose of this study was to analyze IEPs in the aspects of special education laws and to compare the differences between IEPs of two countries. In the results of analysis, Korea focused more on individualized instruction but the United States focused more on individual needs of the students they served as required. We should consider development of IEP including special factors, IEP team attendance, reviewing and revising the IEP, parents participation et. al. in the future amendment of this law.

국문 초록 (Abstract)

본 연구에서는 개별화교육프로그램(IEP)과 관련하여 가장 큰 변화가 있었던 미국의 1997년 장애인교육법(IDEA)과 가장 최근에 개정된 2004년 장애인교육향상법(IDEIA) 및 우리나라의 특수교육진흥법(1994)과 장애인 등에 대한 특수교육법(2008)에 나타난 IEP 내용상의 특징을 구성요소, 팀 구성원, 개발 시 고려사항, 팀 구성원의 회의 참석, 아동의 진전도 보고, IEP 작성 시기 및 교육조치, 부모참여, 점검과 수정 등에 대해 항목별로 구체적으로 알아보고 차이점을 비교하였다. 양국법령의 차이점 비교를 통하여 향후 우리나라 특수교육의 IEP관련법 개정과 기타 관련 정책 수립 과정에서 기초자료로 활용될 수 있으며 발전적 개선방안을 모색하는데 기여할 수 있을 것으로 기대한다.
