Korea is faced with the tendency of Free Trade Agreement(FTA) on a global scale, which has been already realized with the effectuation of Korea-Singapore FTA and Korea-Chile FTA, and the promotion of Korea-U.S FTA. However, the deepening of FTA is ineluctably attended with a high risk of illegal trade in the international market. Now it is time to analyze the present condition of illegal trade and to figure for it.
So this study made use of Border Procedure Model as a analytical framework and categorized illegal trade into customs, unfair trade, narcotic, and security crime.
Moreover, it made a general survey of categorized illegal trades and in special measure inspected the present status of customs crime minutely.
As a scheme for crime response system in the perspective of new institutionalism, it suggests an institutionalization model and governance conception which comprises issue identification, institutional design, institutional implementation, and feedback. To put it more concretely, the suggestion comprehends the accuracy of law and prescription, the integration of the border procedure bureaus in the phase of institutional design.
