헌정주의의 조건으로서의 주권과 헌법제정권력 = 독일 헌정사를 중심으로

국문 초록 (Abstract)

이 글은 독일의 헌정주의를 크게 세 시기로 나누어 각 시기의 헌법의 조건과 기능 그리고 문제를 고찰하였다. 중세 신분제 국가에서 헌법은 상위 통치자와 하위 통치자의 협약으로 양자의 권력관계를 규정하는 것이었다면‘입헌국가’에서 헌법은 군주와 국민이 합의하거나 군주가 하사 하는 방식으로 절대군주의 권력을 제한하는 역할을 했다. ‘헌법국가’에서 헌법은 국민의 헌법제정권력에 의해 만들어지고 권력의 제한이 아니라 권력의 원천이 된다. 독일헌정사에서 입헌주의의 실패(1848)와 성공(1871)의 조건을 헌법과 주권 및 헌법제정권력의 관점에서 보면 정치적 요인 이외에 헌법에 대한 개념 전도적 이해와 기대라는 현상을 발견할 수 있으며 이는 19세기 유럽에서의 입헌주의 운동의 의미와 한계일 뿐만 아니라 20세기 동아시아에서의 입헌주의“열풍”의 배경에 대한 하나의 해석이 될 수 있다. 반면에 헌법국가에서는 국가와 국민 그리고 헌법의 상호 전제의 상황이 야기하는 최고 주권자의 문제가 주요 쟁점이라고 할 수 있다.

다국어 초록 (Multilingual Abstract)

In Germany the constitution have played different roles during three eras. In the Medieval the constitution ruled the relation between the superior and inferior rulers. In the constitutional monarchy the constitution was a result of mutual concent between the monarch and his subject, or the monarch granted a constitution. In ‘Verfassungsstaat(constitutional state)’ the people appeared as pouvoir constituante and the constitution became not more limitation of the monarchial power but the source of the sovereignty. But faced a state of emergencey the Verfassungsstaat could be led to a acute conflict for the consequent sovereign among the people as pouvoir constituant and the constitution as source of sovereignty. In the Debate on this question must be considered that the people as pouvoir constituante is the people who exist before the Verfassungsstaat, and the people in the Verfassungsstaat can only exercise his sovereignty within the limit allowed by the constitution. But in the case of emergency which the people must decide his destiny he could appear as pouvoir constituante, but he stand just out of the Verfassungstaat.
