국제재판소의 수적 확대로 인한 재판관할권 및 법규범의 충돌가능성 및 해결방안 = A Study on a Conflict of Jurisdiction and International Rules of Law for Multiplication of International Courts and Its Solutions

국문 초록 (Abstract)

21세기 들어 국제재판소의 숫자는 많이 늘어났다. 가령 ICJ, ITLOS, ICC, ICTY, ICTR, ECJ 등이다. 국제재판소가 늘어나는 현상은 장단점이 있다. 한편으로는 국제법의 전문화 측면에서는 바람직한 현상이나, 다른 한편 동일 내지 유사한 사건이 여러 국제재판소에서 다룰 수 있기 때문에 관련 국제법의 조화로운 적용과 해석에 문제가 생길 수도 있다. 법이론적으로는 재판관할권의 충돌을 막을 기술은 존재한다. 가령 소송계속중 항변 , 강제적 재판관할권 택일 , 잔여 재판관할규정 , 불편한 법정지 주장 및 일사부재리 원칙 등이다. 하지만 지금까지 각 국제법 분야, 가령 국제형사법, 국제환경법, 국제해양 및 수산법, 국제경제법 등에 있어서의 판례를 분석 검토한 결과에 따르면 재판관할권 충돌 및 국제법 적용에 있어 실제로 문제가 발생한 적은 없다고 보여진다. 이는 각 국제재판소가 나름대로의 재판관할권 충돌을 사전에 예방하고 국제법규 적용 및 해석에 있어서 일관성 유지를 노력한 덕분이라고 보여진다.

다국어 초록 (Multilingual Abstract)

From the 1990 s, the diversification and the multiplication of international courts and tribunals, for example ICJ, ITLOS, ICC, ICTY, ICTR, ECJ, etc., has been a significant development in international law and international society. Such a new phenomenon has had both positive and negative effects on international law. On the one hand, a diversification of international courts provides an opportunity for international law to be more specialized. However, on the other hand, it might cause difficulties concerning the harmonious and uniform application and interpretation of rules of international law as the same or similar litigation might be claimed before different international courts. Some principles or techniques of judicial procedures to prevent a conflict of jurisdiction exists for example, lis alibi pendens, the residual jurisdiction clause, the doctrine of forum non conveniens, the principle of res judicata, etc. Also a careful examination of current international jurisprudence in various fields of international law, for example international criminal law, international environmental law, international law of the sea and fisheries, international economic law, informs on that, fortunately thus far there have been no cases in which a conflict of jurisdiction has occurred. This might be due to the efforts taken by international courts or tribunals by themselves to prevent such a conflict between them.
