신제도경제학과 법개발학

국문 초록 (Abstract)

‘신제도경제학’은 제도와 경제 간의 관계를 연구하는 분야이다. 따라서 법이 경제발전에 미치는 영향도 제도경제학의 분석 범위에 들어간다고 볼 수 있다. 이와 관련하여 법이 경제와 사회발전에 미치는 영향에 관해 연구하는 ‘법개발학’(law and development)에 관한 이해가 요구되는 바, 본 논문은 법이 경제와 사회발전에 영향을 미치는 구체적인 메커니즘을 설명하는 ‘법개발학의 일반이론’(General Theory of Law and Development)을 소개하고. 이와 관련하여 ‘경제개발의 신일반이론’(New General Theory of Economic Development)에 관해서도 간략히 소개한다.

다국어 초록 (Multilingual Abstract)

‘Neoinstitutional economics’ studies the interrelationship between institutions and the economy, including the impact of law on economic development. The latter requires an understanding of ‘law and development’, an area of academic inquiry that explores the impact of law on economic and social progress. This article introduces the ‘General Theory of Law and Development’, which clarifies the mechanisms under which law impacts development. This paper also introduces the ‘New General Theory of Economic Development’, which is also relevant to this inquiry.
