      소방산업진흥기금 설치에 대한 법적 소고 = Legal study on the establishment of the fire industry promotion fund

      It is true that the fire industry has been excluded from the priority list according to the government’s policy judgment, and the development of the fire industry has lagged behind other projects due to the construction industry's subcontracting practices or market size restrictions due to the characteristics of public goods. However, since the fire industry is a safety-related industry that is directly related to the lives of the people, its importance should be emphasized more than any other industry, and measures to promote the underdeveloped fire industry should be reviewed. As an alternative to this, it may be possible to review the provision of funds for the promotion of the fire industry through the fund. In the meantime, the government failed to actively respond to the fire industry promotion because financial resources for the fire industry promotion were not secured.
      With the establishment of the fire Industry Promotion Fund, it will be possible to overcome market failures in the fire industry at the national level and to preemptively respond to the diversification and complexity of fire types. Unlike general and special accounts, the fund is operated outside the budget and is not subject to revenues and expenditures, so it is relatively free from the control of the National Assembly. It has features that allow the use of resources. Although these funds are operated outside the budget and are useful for flexible business operation, they can be established only by law, as the main means of securing funds for the fund is mainly in the form of quasi-taxes such as private contributions in addition to government contributions. Therefore, the contents of the 「National Finance Act」 and 「Fire Industry Promotion Act」 should be amended to prepare the foundation for the fund.
