기업내 공동결정권을 둘러싼 쟁점과 핵심내용 - 독일의 사업장평의회를 중심으로 - = Labor Disputes and the Issue of Codetermination : - Focused on "Betriebstrat" in Germany -

국문 초록 (Abstract)

오늘날 우리의 경제사회적 상황에서 대립적 노사관계 대신에 동반자적 노사 문화의 정립은 중요한 사회적 현안으로 등장하고 있다. 이 글에서는 노사 동반자적 협력관계 형성에 중요한 기반이 되는 공동결정권의 역사적 전개와 발달, 그리고 주요 쟁점에 대해 살펴보기로 한다. 특히 독일적인 기업 상황에서 법으로 규정되어 있는 기업 내 공동결정권의 핵심내용을 검토함으로써 노사 간의 바람직한 노동문화 창출에 이바지하고자 한다. 말하자면 독일사회에서 공동결정이 중요한 경제사회적 현안으로 등장해 발전하였는지를 검토해보고, 그런 토대 위에서 단위 기업 내에서 행사되는 공동 결정의 제도인 사업장평의회의 목표와 과제 그리고 구체적 내용 등을 밝혀보고자 한다. 이런 시도를 통해 우리는 한국적 상황에서 노사분규가 발생할 때 어떻게 대처하여 해결책에 이를 것인가에 대한 중요한 시사점을 얻을 수 있으며, 동시에 치열한 경쟁적 자본주의 상황에서 노동인간화 내지 경제민주화를 실현 할 수 있는 바람직한 노동관계의 설정에도 많은 함의를 받을 것이다.

다국어 초록 (Multilingual Abstract)

Nowadays our economic-social structures are showing antagonistic relations between entrepreneur and workers. But we can say that this contending relation is about to be replaced by a partnership. We want to show in this article that codetermination is the very fundamental of such a partnership relation. We will investigate especially the German model of codetermination on the factory level which is obligatory by law in that country. We want to introduce the codetermination on the level of the factories by setting up a so-called "Betriebsrat". This can provide us a concrete example of codetermination. We hope also to show a proper way to overcome labor disputes happening on the level of the factories. Finally, we propose that "Betriebsrat" could contribute to the humanization of labor and economic democratization in the world of extreme competition within capitalism. By doing so we hope that we can contribute to the establishment of good labor relations in Korean society.
