to Prevent the Claim through Dispute Case Studies of
Public Construction Projects
-focused on Design Phase-

Many studies on cause and prevention of claim have been carried out but they were mostly intended to come up with the improvement measures, improvement system or the measures to deal with the claim, which consequently lacked the substantial ways to identify the details of claim for prevention purpose. That is, there's in fact no tool, in preparation for potential claims, to identify and review the major potential causes at design stage to mitigate the claim and thus, it's necessary to develop the tool such as checklist needed to prepare the claim-supporting documents, check the relevant laws as well as to identify the cause of claim.
Hence the study, given the fact that cause of claim is mostly generated at the design stage though the claim itself tends to occur at the construction stage, was aimed at developing the checklist based on contract document such as design documents at design stage for public construction projects in a bid to prevent the potential claim occurred at the design stage.

The outcome of the study is summarized as follows.

(1) Based on review of 90 claims, with regard to contract document, sorted from 95 cases of Korean Commercial Arbitration Board and 668 cases subject to authoritative interpretation by the Ministry of Strategy and Finance, the cause of claim and the stage when the claims occurred were analyzed.
(2) Various causes of claims including discrepancy in contract documents, nonfulfillment of administrative procedures, neglection of design document review, different site conditions and lack of management procedures were categorized into contract management, design management, document control and relevant laws to identify the management system.
(3) The cause of claim and items to be incorporated into the checklist were identified from the precedents to develop the inquiries for survey in a bid to identify the need, and the evaluation index to help the project participants understand the need of items for checklist was developed.
(4) The consultation with the experts on checklist developed was performed to ensure the checklist will be necessary, together with the effect of the checklist, and the checklist was supplemented accordingly.

The checklist recommended in the study is expected to mitigate the claim and enhance the learning effect, thereby reducing the potential claims and furthermore, the following effects are expected.

1) The data on cause of claim could be shared among the claim-related persons as well as will be used for effective communication, just like the design checklist.
2) Effective dealing with the claim among the client, designer, contractor and CMr through prior consultation at the site.

Development of checklist focusing on contract documents at design stage, which was intended to prevent the claims in public construction projects in this study has a significant meaning. Given the study was focused on CMr, a further study from the diverse viewpoints of the project participants to make use of the checklist for claim prevention purpose in Korea is more than important.

클레임의 발생원인과 예방에 대하여 많은 연구들이 진행되어 왔으나, 개선방안 혹은 제도 개선, 대응방안 등에 대한 연구가 대부분이었다. 잠재되어 있는 클레임에 대한 구체적인 내용들을 정리하고 예방을 하기 위한 실무적인 연구는 미흡한 실정이다. 향후 발생할 수 있는 클레임에 대하여, 그 중 설계단계에서 잠재될 가능성이 큰 원인들을 미리 검토 및 재확인하여 클레임을 예방할 수 있는 수단이 부족한 실정이기 때문에, 클레임 근거서류를 준비하고, 관련법규 적용규정을 확인하면서, 클레임 발생 원인을 짚어볼 수 있는 체크리스트와 같은 도구가 필요하다.

본 연구는 클레임이 발생되는 시기는 대부분이 시공단계이지만 클레임 발생원인은 설계단계 시기인 점에 착안하였다. 그리고 공공공사 설계단계에서 잠재된 클레임의 예방을 위하여, 설계단계의 설계서 등을 포함한 계약문서를 중심으로 연구를 진행하였다.

본 연구의 주요 결과는 다음과 같다.
1.1.1.1.1. 대한상사중재원의 분쟁사례 95건과 기획재정부 668건의 유권해석 사례에서 설계서 등 계약문서와 관련되어 발생된 클레임에 해당하는 90건을 분류하여, 클레임 발생원인, 발생시기를 분석하였다.
1.1.1.1.2. 계약문서 상이, 행정절차 이행 미흡, 설계검토 미흡, 현장여건의 상이, 관리업무 절차 부재 등 다양하게 얽힌 클레임 발생원인을 계약관리, 설계관리, 근거서류관리, 관련법률 규정 등으로 분류하여 관리체계를 도출하였다.
1.1.1.1.3. 분쟁사례 클레임 발생원인과 선행연구에서 체크항목을 추출하여 체크항목의 필요성을 파악할 목적으로 설문을 실시하였다. 또한 설문조사 결과를 바탕으로 체크항목에 대한 사업참여자들의 필요성 정도를 알아볼 수 있는 평가지수를 산출하였다.
1.1.1.1.4. 이상의 내용을 기반으로 클레임 예방을 위한 체크리스트를 개발하였으며, 개발된 체크리스트에 대하여 전문가 설문과 면담을 통하여 보완하였다.

본 연구에서 개발된 체크리스트가 클레임의 발생을 억제하고 대응할 수 있는 학습효과를 높임으로써 향후 클레임 발생을 예방하는데 충분한 역할을 할 수 있을 것이며, 다음과 같은 효과가 기대된다.

1) 클레임 업무 관련자간에 클레임의 발생원인을 공유하고, 설계도서 체크리스트와 같이 의사소통의 자료로 활용될 수 있다.
2) 발주자, 설계자, 시공자, 건설사업관리자 간에 사전 협의를 통하여 클레임 처리를 원활하게 하는 데 도움이 될 수 있을 것이다.

본 연구는 공공공사의 설계단계에서 클레임을 예방하기 위하여 설계서 등 계약문서를 중심으로 체크리스트를 개발한 점에 의미가 있다고 할 수 있다. 그러나 건설사업관리자의 관점을 위주로 진행하였기 때문에, 설계자 및 시공자 등의 다른 사업참여자들의 다양한 관점을 반영한 추가적인 연구가 필요하다.
