생명권의 헌법적 근거와 연명치료중단에서의 생명권의 보호범위

과학기술과 의학이 발전하면 할수록 인간 생명의 시작과 끝에서 생명권의 주체가 될 수 있는 경계선이 모호해진다. 생명의 끝에서 본다면, 연명치료중단, 의사조력자살이 생명권 침해나 제한에 해당되는지 최근 논란이 되고 있다. 헌법의 개정사를 통해 생명권의 근거가 되는 헌법 조항을 살펴본바 다음과 같은 결과에 도달하였다. 생명권은 기본권의 가장 본질적이고 핵심적인 보호 영역이면서 기본권 보장의 기초와 토대가 되며, 우리 헌법에 명시적으로 나타나지는 않지만 제헌헌법부터 현행헌법까지 명문화된 신체의 자유, 열거되지 아니한 권리의 경시 금지 조항으로부터 도출할 수 있고, 1962년 5차 헌법 개정에서부터 도입된 인간의 존엄과 가치 조항을 근거로도 인정될 수 있다. 무엇보다도 생명권은 기본권의 본질적이고 핵심적인 영역으로서 헌법에 명문 규정이 없더라도 인정될 수 있는 기본권이나, 생명권은 그 중요성과 기본권 체계 내의 질서를 감안할 때 독자적인 기본권으로 헌법에 규정하는 것이 바람직하다고 판단된다. 생명의 끝과 관련한 생명권의 최근 해석을 보면, 임종기에 직면한 환자의 연명치료중단의 권리는 생명권의 침해가 아닌 생명권의 보호범위 내에 있는 것으로서 환자의 의사결정에 의거하여 인정될 수 있는 헌법상 권리이다. 죽음이 임박한 환자에 대한 연명치료 중단은 생명권의 포기나 침해가 아닌 생명 활동의 보호이자 생명권 자체의 특성으로부터 도출되는 것으로서 인간으로서의 존엄과 가치와, 본인이 원치 않는 신체 침해를 배제할 권리 즉 치료거부권을 포함한 헌법상 자기결정권으로부터 나오는 것이다. 죽음에 이르는 과정도 삶의 일부분이며, 불치의 질병이나 신체손상에 의하여 죽음에 이르는 것이 생명활동의 자연스러운 현상이므로 환자의 진지한 의사결정에 기한 연명치료중단의 권리는 생명권을 보호하는 헌법 질서와 상통하는 삶의 마지막 권리라고 할 수 있다. Scientific and medical advances have made unclear the boundary line of one's life- the object of the right. From the viewpoint of the end of life, it has been a controversial issue whether the forgoing treatment and physician-assisted suicide apply to the violation and restriction in right to life. After studying articles of constitution through the constitutional history in Korea, I came to the conclusion as the followings. The right to life is the fundamental and essential protection area of constitutional right. Moreover, it is the foundation and basis for protection of constitutional rights though it has not been clearly implied in Korean constitution. The right to life is based on the personal liberty and the article which is about the right to prohibit the disparagement of other right and liberty only because of enumeration. These articles has been implied since the first constitution of Korea. It is based on the dignity of man which has been implied since the fifth amendment in 1962. It can be acknowledged as constitutional right regardless of legalizating its regulation. However it is desired that it is implied in Korean constitution in respect of the order system of constitutional rights. The recent interpretation of 'right to life' in the end of life is the following. The right of withholding or withdrawing of life-sustaining treatment for terminally ill is not the violation of right to life, but protection of the right and constitutional right which is based on the dignity of man and the constitutional right of self-determination. The process from life to death in the end of life is the part of living and natural phenomenon occurring in activity of life. Therefore the right of withholding or withdrawing of life-sustaining treatment according to terminally ill's genuine decision-making is the last right which coincides with constitutional order system to protect right to life and the right which is based on the right to life because of the nature of itself.

본고에서는 생명권의 헌법적 근거, 생명권의 주체와 내용 등에 관한 주요 쟁점들을 살펴보면서, 특히 생명권에 대한 제한과 본질적 내용침해 금지와 관련된 문제에 대해 중점적으로 검토하였다. 인간의 생명은 다른 어떠한 것과도 바꿀 수 없는 것이기 때문에 생명권은 가장 소중한 가치를 가진 인권이라 할 수 있다. 우리 헌법상 명문으로 규정되어 있지 않지만, 가장 근본적인 기본권이라 할 수 있으며, 헌법상 보장되는 모든 권리들의 전제가 된다. 따라서 국가는 생명권의 보호를 위하여 적극적인 노력을 기울여야 할 의무를 진다. 이념적으로 인간의 생명은 절대적 가치를 가지지만, 사람의 생명은 예외적으로 법적인 평가의 대상이 될 수 있다. 왜냐하면 타인의 생명을 구하거나 보호하기 위해서 부득이하게 특정인의 생명을 박탈하지 않으면 안 되는 예외적 상황이 존재하기 때문이다. 따라서 생명권도 다른 기본권과 마찬가지로 헌법 제37조 제2항에 따라 법률유보의 대상이 될 수 있으며, 국가는 그러한 예외적 상황에서 특정인의 생명권을 제한하는 조치를 취할 수 있다. 그런데 생명권은 본질적 내용으로만 이루어져 있는 기본권이라고 할 수 있다. 이에 따라 생명권의 제한은 언제나 생명권을 형해화시키는 생명의 박탈을 초래하게 된다. 하지만 그것이 엄격한 예외적 상황에서 과잉금지원칙에 따라 정당화될 수 있다면, 그러한 생명권의 제한은 헌법상 금지되는 기본권의 본질적 내용침해에 해당하지 않는다고 본다. This Study reviewed the constitutional issues on the right to life, especially whether the right to life may be restricted under Article 37 Section 2 of the Constitution and the restriction on the right to life infringes the essential aspect of that right. According to my study, human life is the most important value and human right in law because it is not irreplaceable with any other things. While the right to life is not expressly enumerated in the Constitution of Korea, we can admit that the right is the most fundamental right and precondition to all the rights set forth in the Constitution. Thus the government has a duty to make proactive efforts to protect the human right to life. Even if a person"s life in an ideal sense is regarded to have an absolute value, legal assessment on a person"s life can be permissible as an exception. Because there can be exceptional circumstances where a person"s life must be inevitably taken away in order to protect or save another’s life. As a result the right to life may be subject to the statutory reservation under Article 37 Section 2 of the Constitution and the government may take measures to restrict on a particular person"s right to life in such exceptional circumstances. Since the right to life consists only of essential aspect of the right, any restriction on the right to life always results its total deprivation. However the right to life is a fundamental right that may be justifiably restricted in exceptional cases. If the restriction on the right to life may be justified under the principle of proportionality. it shall not be deemed as an infringement of the essential aspect of the right to life.
유럽인권협약 제2조 생명권의 해석과 적용에 관한 연구 - 유럽인권재판소 결정례를 중심으로 -

본 연구는 유럽인권협약이 보장하는 권리 중 가장 중핵적인 제2조, 즉 생명권에 대한 해석과 적용에 대하여 검토하고자 한다. 생명권은 모든 인간이 태어나면서 가지게 되는 가장 기본적이고 중요한 권리이다. 이는 사람의 생명을 보호하고, 그 생명을 무단으로 박탈당하지 않도록 하는 권리를 의미한다. 모든 국가와 사회의 기본 원칙은 개인의 생명을 존중하고 보호하는 데 있으며, 이러한 원칙은 국제적으로도 인정받고 있다. 생명권의 보호 이유는 여러 가지로 볼 수 있다. 첫째, 생명은 개인에게 가장 소중한 자산이기 때문에 그 자체의 중요성에서 보호해야 한다. 둘째, 사회적 차원에서 보면 생명의 존중은 사회의 안정과 발전을 위한 기본 조건이며, 생명권이 보장되지 않는 사회는 궁극적으로 혼란과 붕괴 위험에 직면할 수 있다. 셋째, 윤리적 관점에서는 모든 생명은 그 자체로 가치가 있으며, 인간이나 국가가 그 가치를 임의로 박탈하는 것은 허용될 수 없다. 이와 같이 생명권은 모든 인간의 기본적인 권리를 대표하며, 이에 대한 적절한 이해와 보호가 개인의 자유와 인권 존중의 기본적인 토대라는 것은 어떠한 국가와 지역을 불문하고 공통적으로 인식하고 있다. 유럽인권협약은 유럽 지역에서 인간으로서의 기본적인 권리와 자유를 보장받을 수 있도록 하는 중요한 문서이다. 유럽인권협약 제2조인 생명권은 이러한 협약의 핵심이며, 모든 인간이 가진 기본적인 권리 중 하나를 보장한다. 하지만, 이 생명권에 대한 이해와 적용은 다양한 사회적, 정치적 맥락에서 복잡한 이슈를 일으킬 수 있다. 이러한 이유로, 본 연구는 생명권의 복잡한 문제들에 대한 깊이 있는 검토를 하고자 한다. 본 연구의 목표는 유럽인권재판소의 결정례 통하여 생명권이 인간의 존엄성을 보장하고 사회적 공정성을 추구하는 데 어떠한 역할을 하는지를 검토하고자 한다. 이를 기반으로 생명권에 대한 일반적인 개념과 유럽인권재판소의 생명권에 대한 해석을 소개하고, 이를 통해 생명권의 이론과 실제 사이의 차이점을 좁혀 나가는 방안으로 고찰하고자 한다. This study examines the interpretation and application of Article 2, the right to life, which is one of the most central rights guaranteed by the European Convention on Human Rights. It is universally recognized that the right to life represents a fundamental right of all human beings and that its proper understanding and protection is a fundamental basis for individual freedom and respect for human rights. The European Convention on Human Rights is an important document that ensures that individuals in Europe are guaranteed their fundamental rights and freedoms as human beings. Article 2, the right to life, is at the heart of the Convention and guarantees one of the most fundamental rights that every human being has. However, the understanding and application of this right to life can raise complex issues in different social and political contexts. For this reason, this study aims to provide an in-depth examination of the complexities of the right to life. The aim is to examine the role of the right to life in ensuring human dignity and promoting social justice through the case law of the European Court of Human Rights. Based on this, the general concept of the right to life and the interpretation of the right to life by the European Court of Human Rights will be introduced in the next chapter, followed by an analysis of the Court's main decisions, with the aim of bridging the gap between the theory and practice of the right to life.

The natural process of the birth, sustenance and extinction of life has been originally understood within the area of the God with which human beings can never interfere. Based on this understanding, a right to life, constitutional and human right, has been recognized. However, due to the stunning development of science and technology, technology has taken part in the natural process of life and resulted in the issue of the artificiality of life. Accordingly, discussion regarding the right to life which have developed surrounding the constitutional limitability of such right has entered a new phase. Novel and various issues that have never been considered, to be precise, were not even imaginable when the right to life was established as a constitutional right or human right, have emerged and are now challenging the constitutional law. We thereby face cases where traditional understanding of the right to life cannot be applied. We even observe the collapse of the absolute nature of the right to life which has gradually collapsed through discussions regarding its limitability. However, it is questionable whether every discussion in relation to constitutional rights in relation to life should be understood and addressed through the right to life. Rather, consitutional law may rather overburden the right to life by considering the issues relating to the protection of life solely as the issues relating to the right to life. In order to resolve this issue, I propose to distinguish the right to life and the right to extend life. That is, I would like to contend that the protection of the right to life does not necessarily mean the protection of life. Distinguishing between the right to life and the right to extend life may continue to guarantee the protection of life in the new challenging area and enable an appropriate mean to handle newly emerging issues, taking into account the new circumstances. 생명의 탄생과 유지 그리고 소멸이라는 자연적 과정은 본래 신의 영역으로 인간이 개입할 수 없는 영역으로 이해되었다. 이러한 인식을 바탕으로 생명권이라는 인권과 기 본권이 출발하였다. 그러나 과학기술이 눈부시게 발전하면서 과학기술은 생명에 관한 자연적 과정에도 개입하여 생명의 인공성이라는 문제를 낳았다. 이로 말미암아 헌법학 에서 제한 가능성을 중심으로 치열한 논쟁이 있었던 생명권은 새로운 국면을 맞고 있 다. 즉 과거에 생각하지 못하였던, 정확하게 말해서 생명권을 인권이나 기본권으로 정 립할 당시에는 상상도 하지 못하였던 새롭고 다양한 문제가 나타나서 헌법학에 새로운 과제를 부여한다. 여기서 생명권에 관한 전통적 내용을 그대로 관철하기 곤란한 사례들 이 적지 않게 발견된다. 그에 따라 제한 가능성 논의를 통해서 조금씩 허물어지기 시작 한 생명권의 절대성이 맥없이 무너지는 모습이 목격되기도 한다. 그러나 모든 생명에 관한 기본권 논의를 생명권을 통해서만 이해하고 다루는 것이 정당한 것인지는 의문이 제기된다. 오히려 헌법학에서 생명 보호를 모두 생명권 문제로만 봄으로써 생명권에 과 부하가 걸리는 것이 아닌지 의심스럽다. 이러한 문제를 해결하기 위해서 생명권과 생명 을 연장할 권리를 구별할 것을 제안한다. 즉 생명권 보호가 생명 보호의 모든 것이 아 닐 수 있음을 주장하고자 한다. 생명권과 생명을 연장할 권리의 구별은 생명권을 통한 높은 보호수준을 새로운 문제영역에서도 여전히 유지할 가능성을 확보하면서 새롭게 등장한 여러 문제를 새로운 상황을 충분히 고려하여 적절하게 해결할 가능성도 열어줄 수 있다.

이 글은 낙태의 헌법적 문제를 생명과 생명권, 인간의 존엄성, 자기결정권 등을 중심으로 고찰한다. 헌법학의 영역을 넘어서 보다 넓은 관점에서 낙태에 대한 헌법적 논의를 시도한다. 낙태는 산모와 태아의 양자관계를 전제로 한다. 태아를 자신의 몸 안에 두고 있는 산모와 산모의 일방적인 보살핌 속에서 그 온전함을 보장받는 종속적 지위의 태아가 있다. 그리고 이 양자는 각각 헌법상 임신중절의 자기결정권과 생명권의 주체가 될 수 있다. 인간의 생명이 언제 시작되는가에 대한 논의를 떠나서 태아가 생명권을 가진다는데 이견은 없다. 이에 반해 산모의 임신중절의 자기결정권은 태아의 생명권 침해를 전제로 하기 때문에 그것을 인정하기는 어렵다. 만약 헌법상 행복추구권에 근거하여 산모의 임신중절의 권리를 인정하게 되면 다음의 몇 가지 문제가 상정된다. 첫째, 산모의 임신중절 자기결정권과 생명권의 대립은 기본권 충돌의 문제가 된다. 둘째, 헌법상 산모의 자기결정권이 인정되면 현재 모자보건법상의 예외 사유를 제외하고 임신 주기와 관계없이 모든 낙태행위를 처벌하는 형법 제269조 부녀의 자기낙태죄 규정과 제270조 업무상 동의낙태죄 규정은 그 위헌성이 문제된다. 셋째, 헌법상 임신중절 자기결정권이 형법상 낙태죄 규정에 의해 제한되는 것은 헌법 제37조 제2항의 기본권 제한의 문제로 볼 수도 있다. 다만 이러한 논의는 산모의 자기결정권의 인정을 전제로 한다. 그러나 산모의 자기결정권은 태아의 생명권의 침해를 전제로 하기 때문에 그 허용은 어렵다. 우리 헌법 제10조의 인간의 존엄과 가치에 기초하는 생명 존중의 원리에 의할 때 태아의 생명권을 보장하고 그 어떤 낙태행위도 태아의 생명권 앞에서 상대화되는 것은 법논리적으로 맞는다. 그러나 낙태행위에 대한 우리나라의 이러한 엄격한 처벌 규정에도 불구하고 실제 일어나는 낙태는 대단히 많은 수준이고, 이것은 일정한 기한 내에는 비교적 자유롭게 낙태를 허용하는 다른 나라와 비교할 때 훨씬 높은 수준이다. 이러한 법과 현실의 괴리가 발생하는 상황에서도 생명권의 절대적 우위를 주장하는 것이 옳은지는 그 논의를 필요로 한다. 임신 초기에는 태아가 완전한 인간으로 진행되는 과정에 있기 때문에 산모의 고통과 절충할 만한 여지가 있는 것은 아닌가 생각된다. 따라서 산모와 태아의 관계에 대한 여러 학설들에 기초하여 현재 대단히 협소한 적응규제형에 방식에 임신 초기에는 기한규제형을 도입하여 양자의 절충을 시도하는 것도 현재 낙태행위를 둘러싼 법과 현실의 간극을 메울 수 있는 방도가 될 수 있을 것이다. 이러한 과도기적 조치가 실효를 거둔다면 현재의 생명권의 절대적 우위의 상태로 복귀하는 것도 가능하다고 할 것이다. This study examines the constitutional issue of abortion, mainly in terms of human life and the right to life, the dignity of human beings, the right of self-determination and so on. It attempts to discuss constitutional matters on abortion from a rather broad perspective beyond the boundaries of constitutional studies. Abortion presupposes the relation between the two, a pregnant woman and a fetus: the former has a fetus in her body and the latter is in a subordinate status whose security is ensured only by the pregnant's one-way care. Moreover, the two can be entitled the subjects of the right to life and the self-determination on abortion, both of which are drafted up on the constitutional right to pursue happiness. There is no doubt that a fetus has the right to life, regardless of the debate on when human life, or personhood, begins. In contrast, a pregnant woman's decision on abortion seems to be unapproved because the decision will infringe a fetus's right to life. Some constitutional issues can be considered on the condition that a mother's right to abortion is approved according to the right to pursue happiness under the Constitution. First, the conflict of the self-determination and the right to life raises the problems with the contrasting basic rights. Second, if a mother's self-determination is approved based on the Constitution, the criminal law that bans all abortions regardless of pregnancy periods, the regulation on criminal autonomic abortion under Article 269, and the regulation on work-related consented abortion under Article 270 can conversely violate the Constitution, apart from exceptive clauses underthe mother and child health law. Third, the regulations on abortion under the criminal law limit the right to self-determination on abortion under the Constitution, which could be regarded as a restriction on the basic rights stipulated in Article 37, Section 2 of the Constitution. But the debate presupposes an approval of a mother's right to self-determination. However, such approval is not easily granted because a mother's right to self-determination will infringe a fetus's right to life. In light of law logic, it makes sense that a fetus's right to life is guaranteed by Article 10 of the Constitution of Korea based on the principle of respect for life according to the dignity and worth of human beings, and that a fetus's right to life is relatively above any rights to abortion. In spite of such severe punishment, Korea witnesses a large number of abortions performed in reality and it is at a higher level than other countries where in comparison, abortion is freely available within a certain period. Even in the situation that there is a big gap between the law and the reality, it is necessary to discuss whether claims about absolute superiority of the right to life are valid or not. In the early period of pregnancy when a fetus is in the process of becoming a complete human being, there might be much room for compromise between a fetus's right and the agony of a woman seeking to have an abortion. Therefore, on the basis of various theories of the relation of a pregnant woman and a fetus, making a compromise between the two different rights by adopting a period restriction measure in case of the early pregnancy, along with the current adaptability restriction measure which is very limited, could be a key to narrowing down the current gap between the law and the reality regarding abortion. If the transitional step produces actual results, it would be possible to return to the current state of absolute superiority of the right to life.

생명공학과 의학의 비약적 발전으로 헌법학은 예상하지 못한 어려운 문제에 직면하게 되었다. 생명공학의 발전이 언제부터 인간인가의 문제를 제기하고 있다면, 의학의 발전은 언제까지가 인간인가의 문제를 제기하고 있다. 전자는 인간생명체, 특히 초기 배아의 헌법적 지위에 대한 정립을 요구하며, 후자는 안락사 및 연명치료중단의 헌법적 규명을 요구하고 있다. 그간의 생명문제는 태아가 생명권 및 존엄권의 주체인가 정도였는데, 생명공학의 발달로 착상 전 배아의 헌법적 지위를 정리하지 않을 수 없게 되었다. 더 나아가 생명공학은 수정방식이 아닌 핵이식방식을 통한 체세포 복제배아를 만들어 내는데 성공하게 됨으로써 인간이란 무엇인가의 가장 본질적 질문에 대한 답을 요구하고 있고, 어디까지 인간생명을 연구할 수 있으며, 복제된 배아를 어떻게 이해하며 어디까지 연구대상으로 삼을 수 있는가에 관한 고민을 더해주고 있다. 생명권과 관련하여 판례와 학설이 생명권은 일반적 법률유보의 대상으로 보기에 적합하지 않다고 하면서도 결국에는 일반적 법률유보의 적용은 불가피하다고 결론을 내리고 있는데, 생명권이 헌법 제37조 제2항의 적용대상으로 보아야 하는지 아니라면 이에 대한 해결방안은 없는지 검토할 가치가 있다고 생각한다. 인간생명체의 시작은 수정란부터로 보아야 하지만, 헌법학의 생명권의 주체는 수정 후 약 14일이 지나 자궁에 착상한 때부터로 보아야 한다. 착상이 되어야 인간으로서의 개체성이 충족된다고 보기 때문이다. 인간의 존엄권의 시작을 수정란부터 또는 착상시점부터 보아야 한다는 다툼이 있는데 인간의 존엄권은 출생한 이후 성체 인간에게만 허용된다고 보아야 한다. 인간생명체의 보호는 생명권으로 족하며, 출생한 인간이 아닌 인간생명체에게 존엄권을 인정할 이유도 실익도 없기 때문이다. 엄격한 조건하에 이루어지는 착상 전 유전자진단은 허용되어야 한다. 또한 잔여배아의 보존기관을 5년으로 한 것이나, 폐기된 배아를 연구목적으로 사용하도록 한 생명윤리법을 합헌으로 본 헌법재판소의 결정은 타당하다. With a dramatic development of biotechnology and medical science, Constitution is being faced with a difficult problem unexpectedly. The development of medical science raises the issue of the time until when the human being is, on the other hand, the development of biotechnology raises the issue of the time from when the human being is. Biotechnology requires the establishment of the constitutional status of the human life particularly early embryo, and medical science requires the constitutional identification for euthanasia and stopping life prolong treatment. So far, the principal problem of life has been whether the fetus has the right to life and dignity, but now the development of biotechnology forces to clarity the constitutional status of the pre-implantation embryo. Furthermore, according to the bio-technological success of producing a cloning embryos by nuclear transfer method not by insemination, the answer to the most fundamental question, what is human being, is required. And also biotechnology raises the issue of where to study human life and how to understand cloned embryos and what to choose for study object. Related to the right to life, cases and theory say the right to life is not suitable for the object of general legal base. But eventually, they conclude it is inevitable for the right of life to be applied to general legal base. It is worthy to review whether the light to life can be the subject to Article 37 paragraph 2 of the Constitution. If not, review for solving this problem is needed. The beginning of human life should be considered from the embryo, but the object of life in Constitution should be viewed from the time of implantation in the uterus about 14 days after fertilization. This is because individuality as a human being must be conceived as of implantation. Even though there is a debate about the time of human dignity right, embryos or implantation, the human dignit right must be considered to allow to the human after birth. This is because there is no reason or no profit to protect the human dignity to human life not by birth. Pre-implantation genetic diagnosis should be allowed under strict conditions.

우리나라에서 최근에 논의되고 있는 생명의료윤리 주제들과 관련하여 항상 전면에 나서는 것이 인간의 존엄, 국가의 생명보호의무, 생명권이다. 인간의 존엄은 어떠한 입장을 취하더라도 근거로 제시할 수 있는 동전의 양면과 같아 논증의 도구로 적절해 보이지는 않는다. 따라서 인간의 존엄보다는 시민의 생명권과 국가의 생명보호 의무를 중심으로 살펴보는 것이 타당해 보인다. 그런데 생명보호와 생명권이 같은 것으로 오해되는 경우가 많다. 대법원도 김할머니 사건에서 생명권과 생명보호를 오해한 내용을 판결이유에서 드러냈다. 이 글은 생명권의 의미를 시민이 자신의 의사에 반하는 생명, 신체에 대한 침해를 방어할 권리로 이해하는 입장을 취한다. 이를 근거로 의사에게 설명의무가 부과되며, 환자는 자신이 원하지 않는 의료행위를 거부할 수 있는 권리를 갖는다. 반면에 국가는 인간존엄의 생물학적 기초가 되는 시민의 생명을 보호해야 할 의무를 진다. 하지만 국가의 생명보호의무와 시민의 생명권 행사가 항상 같은 방향에서 이루어지는 것은 아니다. 만약 환자가 생명유지의 필수적인 의료행위를 거부하는 경우, 국가는 환자의 생명유지를 위하여 의료행위를 해야 하지만 시민의 생명권은 침해된다. 반면 시민의 생명권을 보호하여 의료행위를 중단한다면 국가는 시민에 대한 생명보호 의무를 다하지 못하게 된다. 이 글에서 필자들은 인간존엄, 기본권의 주체는 인간에게 한정된다는 입장과 시민의 생명권 행사가 이루어지는 곳에서 국가의 생명보호 의무는 한계에 서게 된다는 입장을 논증하였다. 이러한 관점에 따라 최근에 논의되는 생명윤리의 문제인 착상전 유전자진단, 산전 유전자진단, 배아줄기세포연구, 원치 않는 아이, 연명치료중단의 문제에 대하여 검토하였다.

오늘날 쟁점이 되고 있는 ‘배아의 연구나 이용은 정당화될 수 있는가’라는 물음에 답하기 위해서는 무엇보다 배아에게 생명권이 있는가를 따져 보아야 한다. 이를 위해서는 인간 성인을 살펴 그 생명권의 근거는 무엇인지 밝힌 다음 이 근거를 배아도 가지고 있는가 확인해 보면 된다. 성인을 죽이면 주변의 사람들은 극심한 불안과 공포를 느끼게 되므로 이런 해악을 방지하기 위해 성인에게 파생적으로 생명권이 부여된다. 하지만 배아의 죽음은 주변에 극심한 불안과 공포를 불러 일으키지 않으므로 이런 근거에서는 생명권이 있다고 할 수 없다. 성인을 죽이는 것은 또한 그로부터 정신적인 고차원의 삶을 박탈하므로 성인은 이런 해악을 입지 않을 생명권을 갖게 된다. 배아는 만약 그것이 그로부터 자라날 성인과 동일한 존재라면 같은 근거에서 생명권을 갖겠지만 아직 쌍둥이 가능성이 있어서 그렇게 볼 수 없다. 실제로 배아가 죽임을 당할 때 빼앗기는 것은 십수일의 무의식적인 삶으로 생명권의 근거가 되기에는 미흡하다. 그렇다고 배아로 부터 자라날 성인의 ‘존재할 권리’에서 배아의 생명권이 파생된다고 볼 수도 없다. 이렇게 어떤 근거에 비추어 보아도 배아에게 생명권이 있다고 인정하기는 힘들어 보인다. In order to answer the question whether or not the using of an embryo is justified, we must answer first whether or not the embryo has the right to life. We can answer this question by considering whether or not the grounds of the right which we can find in an adult are found in an embryo. When an adult is killed, people who are around the one feel extreme fear and anxiety. This is one ground of the right. But when an embryo is killed, its death does not evoke same fear and anxiety. Therefore it can not have the right to life on this ground. When an adult is killed, he is deprived of his high-level and spiritual life. This is another ground of the right. If an embryo were same with the adult who is grown from the embryo, it would have the right. But we can not see like this because the embryo has the possibility of twins. When an embryo is died he is only deprived of a few unconscious days. We can conclude that an embryo has no right to life.

인권은 인간의 속성과 연관된 권리이며 기본권은 헌법이 명시한 권리이다. 따라서 인권이 자연법적인 권리라고 한다면 기본권은 실정법의 권리인 것이다. 중요한 점은 기본권이 인권에 의하여 추론되는 권리임으로 생명을 중시하는 인권의법 해석은 매우 중요하다. 그러나 생명의 개념이 광의적임에도 불구하고 한국의 헌법에 근거한 생명권과 기본권에 대한 적용은 그 영역이 매우 협소하다. 헌법재판소는“구 생명윤리 및 안전에 관한 법률”제13조 1항인“누구든지 임신외의 목적으로 배아를 생성하여서는 아니된다.”라는 법률과 연관된 초기배아의 기본권과 배아연구와 연관된 위헌소송에서 인간의 생명과 연관된 기본권과 생명권을 정의하고 판시한 바 있다. 필자는 이 글에서 헌법재판소에서 판시한 배아의 생명권을 살펴보고 판시의 문제점을 지적하고, 그리고 뇌과학의 관점에서 생명윤리정책에서 고려되어야 할 요소들을 고찰하고자 한다. 필자가 다루고자 하는 주요 쟁점은 배아의 생명권과 이와 연관된 뇌과학의 관점이다. 뇌 과학의 기본적인 입장에서 보면, 생명의 시작은 뇌가 만들어지는 순간, 즉 수정부터 시작된다. 특히 배아 이전의 정자나 난자와 같은 유전적 요인을 통하여 임신 3-4주부터는 배아가 본격적으로 두뇌를 생성하기 시작한다. 필자는 이 글에서 배아의 연관된 뇌의 사유능력을‘기능’과‘의식’의 구분 없이 사용하며, 다만 인간의 사유는 뇌의 시작과 연결되며, 배아의 능력이 뇌를 좌우한다는 관점에서 논지를 전개한다. 인간 개체의 생명은 뇌를 통하여 항상성을 유지하기 때문에 뇌가 없는 인간은 상상할 수 없다. 이 항상성을 지키기 위한 뇌의 목적은 바로 생명의 보호에 있으며 우리가 법에서 말하는 자유나 평등과 같은 개념 또한 인간의 뇌에서 작동하는 정신작용이며 또한 생명의 특징이기도 하다. 물론 인간의 생명은 유전인자와 같은 일차적인 요소와 신체의 외부적인 사회 환경의 상호작용에 의하여 지속되기때문에 생명을 뇌의 기능적인 관점에서 보는 뇌결정론의 한계는 있지만 뇌를 구성하는 배아단계부터 인간의 기본권과 생명권을 인정해야 한다는 입장에서 뇌를 강조하는 것은 의미가 있다고 본다. 뇌의 항상성은 생명권뿐만 아니라 인간의 존엄성에 기초가 되는 자아개념이나 의지와 같은 정신작용과 관계가 있다. 필자는 이점을 부각시키기 위하여 뇌과학의 이론 중에서“해방생물학(liberation Biology)”을 강조하며, 배아단계부터 형성되는 뇌의 도덕적 주체성을 고찰한다. 이를 뒷받침하는 이론들은“부수적 현상론(epiphenomenalism)”, “이원적 상호론(dualistic interactionalism)”, “실체이원론(substance dualism)”, “심신일원론(mind/brain identity theory)”과“유심론(mentalism)”등이다. 이러한 이론을 소개하는 목적은 인간의 도덕적 주체성에 대한 뇌과학의 해석을 통하여 배아초기부터 작동하는 뇌의 정신 활동과 이에 따른 인간의 주체성에 대한 이해에 다양한 해석이 공존하고 있음을 살펴보기 위함이다. 다양한 관점의 공통성은 배아의 유전적 정보로 말미암아 인간은 인간다운 항상성을 유지하며 사유와 자기책임의 도덕적 특징을 가진다는 점에 있다. 한편, 결론으로 필자는 생명윤리정책에 있어서 법의 사유의 확장과 도덕적 능력의 배양을 강조하면서 생명윤리와 같은 영역에 인간의 책임과 생명에 대한 두려움과 경외의 필요성에 대하여 강조한다. According to the main purpose of Bioethics and Safety Act, “no one shall produce embryos other than for the purpose of pregnancy.” However, under the current Act, the human embryo should not be regarded with the same legal status as a human being. It does not admit the right to life of the human embryos. But the increasing knowledge of the human brain has opened a new horizon for the understanding of human beings and found that the human embryos can be treated with the same legal standard as a human being because they are linked to the origins of the human life. In this regard, neuroscience encompasses various issues in connection with the brain and the embryo, allows us to understand how the human embryos contribute to the moral and ethical judgements in the course of the early stage of the brain growth. In the discussion of neuroscience in regard to the issues of moral potential of the human embryos, the theories of epiphenomenalism, dualistic interactionalism, substance dualism, mind/brain identity theory, and mentalism are engaged to explore the meaning of human life, free will, and moral subjectivity. After considering all the factors of the above issues briefly, this paper comes to a conclusion that the right to life of the human embryos must not be limited but be considered as valuable as that of a human being. To achieve this goal, the government and scientific communities are encouraged to revise the standard of the right to life for the human embryos, earliest forms of human beings, and reestablish supervision on life ethics.
유럽연합 기본권 헌장상 생명권과 심신 온전성의 권리에 대한 고찰

유럽연합 기본권 헌장(Charta der Grundrechte der Europäischen Union)은 유럽연합 차원에서 가장 광범위하고 포괄적으로 기본권 보장에 대해서 명문으로 그 내용을 규정하고 있다. 이러한 점에서 기본권 보장의 실질적 실현을 위해 의미있는 내용을 담고 있는 좋은 본보기 될 수 있다. 실질적 기본권 보장을 위한 논의는 유럽연합 소속 주요 개별 국가의 공법학계에서 지속적으로 세분화 된 내용으로 심도 깊은 논의가 계속 이어져 오고 있다. 이러한 다양한 논의 내용은 우리에게도 시사하는 바가 크다고 할 수 있다. 특히, 제2조 생명권과 제3조 심신 온전성의 권리 또는 이른바, 심신을 훼손당하지 않을 권리에 대한 주요 규정 내용과 의미 등에 대해서 좀 더 자세히 살펴볼 필요가 있다. 기본권 보장의 실질적 의미와 보호영역을 중심으로 그 내용을 구체적으로 비교하여 검토하는 것은 매우 중요한 의미를 갖는다. 유럽연합 기본권 헌장은 총 7개의 장과 54개 기본권 조항으로 구성되어 있다. 기본권 헌장 제1장 인간의 존엄에서는 제1조 인간의 존엄, 제2조 생명권, 제3조 심신 온전성의 권리, 제4조 고문 금지와 비인간적 또는 굴욕적 형벌 및 대우 금지 그리고 제5조 노예제 및 강제노동 금지를 규정하고 있다. 기본권 헌장 제1조에서 규정하고 있는 인간의 존엄이 지니고 있는 의미와 이념을 바탕으로, 모든 사람에게는 생명권이 보장되며 그리고 사형 선고와 집행(제2조), 신체적ㆍ정신적 온전성의 침해(제3조), 고문과 비인간적 대우(제4조), 노예제와 인신매매(제5조) 등은 그 누구에게 어떠한 경우와 이유로도 인정될 수 없다. 기본권 헌장 제2조에서는 생명권을 하나의 독자적인 기본권 조항으로 규정하고 있다. 우선, 제1항에서는 모든 사람은 생명권을 갖는다고 규정하고, 제2항에서는 사형제 폐지에 대해서 규정하고 있다. 기본권 헌장 제2조는 기본적으로 기본권 주체인 사람의 생물학적ㆍ육체적 존재인 생명을 핵심 보호영역으로 한다. 이어서 제3조는 심신 온전성의 권리 보장을 규정하고 있다. 제3조 제1항과 제2항에서는 특히, 의학과 생물학 영역에 적용될 상당히 특징적인 새로운 내용이 등장한다. 제3조 제1항에서는 한 개인이 신체적ㆍ정신적으로 훼손당하지 않을 권리보장을 위해서, 기본적으로 모든 사람은 심신의 온전성, 즉 신체적ㆍ정신적 온전성의 권리를 갖는다고 규정하고 있다. 그리고 제2항에서는 특히 의학과 생물학 영역에서 네 가지의 구체적인 심신의 온전성 보장을 위해 반드시 유의해야할 내용을 규정하고 있다. 즉 첫째, 법률에 개별적으로 정한 바에 따른 사전 설명 후의 당사자의 자유로운 동의, 둘째, 우생학적 처치 금지, 특히 인간 선별을 목적으로 하는 우생학적 처치 금지, 셋째, 신체 전부와 그 일부의 이윤 목적을 위한 이용 금지, 그리고 넷째, 인간복제 금지를 세분화하여 규정하고 있다. 기본권 헌장 제3조 제1항과 제2항의 규정 내용은 기본적으로 생명권 보장을 위한 하나의 통일된 기본권을 구성하고 있으며, 특히 제2항에서는 생명권에 대한 좀 더 구체적이고 세분화된 특별한 내용을 규정하고 있다고 할 수 있다. 생명과학, 생물학, 의학 등 인간 생명에 대해서 직ㆍ간접적인 관련을 맺고 있는 모든 학문 영역 및 과학기술 영역에서 인간의 신체적ㆍ정신적 완전성과 그 존엄성에 대한 일종의 위험 요소와 위험 상황 그리고 그 형태 등을 나타내고 있다는 의미를 함께 도출할 수 있다. In dieser Arbeit handelt es sich um das Thema das Recht auf Leben und Recht auf körperliche und geistige Unversehrtheit in der Charta der Grundrechte der Europäischen Union. Die Charta der Grundrechte der Europäischen Union führt zu einer erheblichen Stärkung des Grundrechtsschutzes in der Ebebe der Europäischen Union. In der verfassungsrechtlichen Diskussion über die Bedeutung und den Inhalt der einzelen Grrundrechten spielt die Charta noch eine wertvolle Rolle in der EU. Die Charta der Grundrechte der Europäischen Union ist nicht einfach ein Text oder Programsatz zum Schutz der Grundrechten, zahlreiche abstrakte Grundsätze festzulegen. Sie muss sondern jedes Mal beachtet werden, wenn staatliche Gewalt, Organe oder Einrichtungen der EU tätig werden oder wenn EURecht zur Anwendung kommt, so dass die Menschen tatsächlich in den Genuss ihrer Grundrechte kommen können. In der Europäischen Union wird der Schutz der Grundrechte sowohl auf nationaler Ebene durch die Verfassungssysteme der Mitgliedstaaten gewährleistet, als auch auf EUEbene durch die Charta. Die Charta der Grundrechte der Europäischen Union besteht aus sieben Kapitel und umfasst 54 Artikeln. Das erste Kapitel der Charta trägt die Überschrift “Würde des Menschen” und formuliert in Artikel 1 “Die Würde des Menschen ist unantastbar. Sie ist zu achten und zu schützen”. Dem Menschenwürdegrundsatz folgen Artikel über das Recht auf Leben (Art. 2), Recht auf körperliche und geistige Unversehrtheit (Art. 3) sowie das Verbot der Folter (Art. 4), der Sklaverei (Art. 5 I) und der Zwangsarbeit (Art. 5 II). Mit 54 Artikeln erweist sich die Charta für einen Grundrechtekatalog als außerordentlich umfangreich. Ihre sieben Kapitel - von der Würde des Menschen über Gleichheit und Solidarität bis hin zu den justiziellen Rechten - regeln das Verhältnis des Einzelnen zur europäischen hoheitlichen Gewalt umfassend. Die Charta klammert dabei keinen Lebensbereich aus, sie positioniert sich sogar zu aktuellen Fragen der Medizin und Biotechnologie(Art 3). Dies führt jedoch dazu, dass die Regelungsdichte der Charta beispielsweise nicht hinter der des Grundgesetzes oder anderer Verfassungen der Mitgliedstaaten der Europäischen Union, in denen Grundrechte verankert sind, liegt. Vielmehr reicht sie auf dem Gebiet moderner Grundrechte, aber auch bei den sozialen Grundrechten zumindest über die des Grundgesetzes hinaus. Zur Bioethik liegt ein neuer Art. 3 der Charta vor, zuerst die freie Einwilligung des Betroffenen nach vorheriger Aufklärung entsprechend den gesetzlich festgelegten Einzelheiten, das Verbot eugenischer Praktiken, insbesondere derjenigen, welche die Selektion von Menschen zum Ziel haben, das Verbot, den menschlichen Körper und Teile davon als solche zur Erzielung von Gewinnen zu nutzen, und das Verbot des reproduktiven Klonens von Menschen. Neben dem Recht auf körperliche, genetische und geistige Unversehrtheit stehen Grundsätze für Medizin und Biologie wie das Verbot eugenischer Praktiken oder das Verbot des Klonens.
