연명치료결정에서 의학적 무의미함의 정의(定義)에 대한 광범위한 합의는 아직 이루어지지 않았으며 의사에게 환자의 의사(意思)에 반하여 일방적으로 치료를 중지할 수 있는 권한을 부여하는 절차적 정책은 많은 비판을 받고 있다. 그러므로 연명치료를 요구하는 환자와 그 치료가 무의미하다고 생각하는 의사 사이의 갈등을 의학적 무의미함의 정의화(定義化)와 절차적 정책으로 해결하려는 시도는 성공적이라 할 수 없다. 일반적 치료와 달리 다른 대안이 없는 연명치료에서 환자의 가치판단은 존중되어야 하며 의료윤리원칙과 의사의 자율성 및 전문직 충실성은 환자의 자기결정권보다 우위에 있다고 할 수 없다. 의학의 목적이 단순히 환자의 신체적 개선에 있지 않고 전체로서의 환자 이익의 증진에 있다면, 의사의 자율성과 전문직의 충실성은 연명치료 거절의 이유가 아니라 환자의 정확한 정보와 합리적 판단을 통한 자기실현에 기여하는 근거가 되어야 한다. 연명치료결정의 갈등 해결을 위한 환자와 의사의 열린 대화와 지속적인 사회적 토론과 합의가 필요하다. 그러나 그 중심은 항상 환자의 최선의 이로움을 지향해야 한다. In making a decision for life-sustaining treatment, there is no extensive consensus of medical futility, and the procedural policy that gives a physician an authority to decide unilaterally whether to withdraw or withhold treatment against the intention of patient or family has been criticized vigorously. Therefore, any attempts to resolve conflicts between patients demanding life sustaining treatment and physicians thinking it futile by defining medical futility and performing procedural policy have been unsuccessful. In life sustaining treatment, unlike general case, in which any alternatives do not exist, patient's own value judgement should necessarily be respected and physician's autonomy or professional integrity can not be superior to patients' right to determine on their own. If the goal of medicine is not merely to improve body condition, but to promote patient's benefit as a whole, physician's autonomy and professional integrity must contribute to patient's self-realization by his own reasonable judgement through accurate medical information rather than to refusal of patient's demand. The solution of conflict in decision making for life-sustaining treatment needs constant open conversation between patient and doctor, social discussion and consensus. But most importantly, the patient's benefit should always precede all others.
