THE PERTURBATION FOR THE DRAZIN INVERSE

A representation for the Drazin inverse of an arbitrary square matrix in terms of the eigenprojection was established by Rothblum [SIAM J. Appl. Math., 31(1976) :646-648]. In this paper perturbation results based on the representation for the Darzin inverse $A^D\;=\;(A-X)^{-1}(I-X)$ are developed. Norm estimates of $\parallel(A+E)^D-A^D\parallel_2/\parallel A^D\parallel_2$ and $\parallel(A+E)^#-A^D\parallel_2/\parallel A^D\parallel_2$ are derived when IIEI12 is small.

COMPARISON THEOREMS IN RIEMANN-FINSLER GEOMETRY WITH LINE RADIAL INTEGRAL CURVATURE BOUNDS AND RELATED RESULTS

We establish some Hessian comparison theorems and volume comparison theorems for Riemann-Finsler manifolds under various line radial integral curvature bounds. As their applications, we obtain some results on first eigenvalue, Gromov pre-compactness and generalized Myers theorem for Riemann-Finsler manifolds under suitable line radial integral curvature bounds. Our results are new even in the Riemannian case.

금융혁신의 산물인 주식연계 복합증권은 주식(또한 주가지수)의 기초자산으로 증권과 파생상품의 속성을 이중적으로 가지고 있는 복합적으로 구조화된 금융상품이다. 주식, 채권 및 금융파생상품 등으로 자본시장을 서로 연계시킬 수 있을 뿐만 아니라 각국 자본시장과도 연결시킬 수 있다. 위안화 국제화가 지속적으로 추진되고, 한중 FTA가 체결됨에 따라 동아시아지역 자본시장도 부단히 융합하고 있다. 한국의 주식연계 복합증권시장은 세계적으로 발달된 시장이다. 또한 성숙된 상품구조와 시장환경을 갖추고 있기 때문에 동아시아지역 주식연계 복합증권에 대한 법률문제를 연구하는 중요한 시발점이다. 특히 ELS 등 주식연계 복합증권 관련 분쟁 사례 연구는 그 의의가 작지 않다. 금융시장 발전의 시기적 단계에 따라 법률이 보호하고자 하는 중점과 정도는 다소 상이하다. 즉, 금융시장이 발달하는 초기와 확장기에는 전체적인 경제발전에 치중한다. 금융시장이 일단 어느 정도 성숙되어 안정기에 접어들면 중소투자자들의 이익보호에 중점을 두고, 금융시장질서를 확고히 정립한다. 중국 금융시장의 발전과 대외개방 정책에 따라 중국과 동아시아국가 자본시장에서 후강통(沪港通)과 같은 촉매제가 빠르게 출현될 것이다. 후강통을 통해서 중국 본토와 홍콩 자본시장간 금융상품의 구조 및 법률체계가 서서히 상호 적응 과정을 거치고 있다. 이는 동아시아 자본시장의 융합 가능성에 대한 시금석이라고 할 수 있겠다. 중국과 한국 자본시장을 연계시키기 위하여 후강통과 유사한 후한통(沪韩通)의 실시 여부에 대해서도 연구가 진행 중이다. 이러한 현상으로 미루어 볼 때 동아시아 자본시장 융합은 빠르게 진행될 것이다. 이런 관점에서 각국마다 상이한 법률체계하에서 어떻게 동아시아 자본시장의 융합을 도모할 것인지에 대한 과제가 오늘날 동아시아 법률가에게 부여되고 있다. 현재 동아시아 각국은 금융시장 발전단계가 서로 같지 않다. 동아시아 자본시장의 융합과정에서 각국과 동아시아 전체 금융발전정황 및 금융시장건설과 투자자 보호간의 형평 등을 종합적으로 고려하면서 추진하여야 할 것이다. With the development of global financial innovation, the financial instruments become to be more personalized and complicated. In the meantime, the structure is also changed from a single form to multiple forms. If the individual equity is described as a kind of “dotted” financial product in East Asian capital market, then the Equity-linked hybrid securities are just like “linear” financial products which connect those “dotted” products. Along with the trend of East Asian capital market’s integration, some legal regulation problems are revealed also. The Korean ELS case is an important entry point of rethinking legal regulation system of equity-linked hybrid securities. Especially, a premise question confronting us is, which interest is more significant in legal regulation of equity-linked hybrid securities market, financial market promotion or investors protecting? There is no denying the answer that both of them are important. However, this standpoint is only existed in the ideal state, not in a real world. That’s why different stage of financial market needs to be focused on different interest. With the development of Shanghai-Hong Kong Stock Connect Program, the market of equity-linked hybrid securities in Mainland China is forced to be improved by the Hong Kong market. Besides Shanghai-Hong Kong Stock Connect Program, Shanghai-South Korea Connect Program and other programs will also come out in future. These will promote the East Asian capital market’s integration. A balance between investors protection and market promotion is essential.

Recurrence after Anatomic Resection Versus Nonanatomic Resection for Hepatocellular Carcinoma: A Meta-analysis

The impact of anatomic resection (AR) as compared to non-anatomic resection (NAR) for hepatocellular carcinoma (HCC) as a factor for preventing intra-hepatic and local recurrence after the initial surgical procedure remains controversial. A systematic review and meta-analysis of nonrandomized trials comparing anatomic resection with non-anatomic resection for HCC published from 1990 to 2010 in PubMed and Medline, Cochrane Library, Embase, and Science Citation Index were therefore performed. Intra-hepatic recurrence, including early and late, and local recurrence were considered as primary outcomes. As secondary outcomes, 5 year survival and 5 year disease-free survival were considered. Pooled effects were calculated utilizing either fixed effects or random effects models. Eleven non-randomized studies including 1,576 patients were identified and analyzed, with 810 patients in the AR group and 766 in the NAR group. Patients in the AR group were characterized by lower prevalence of cirrhosis, more favorable hepatic function, and larger tumor size and higher prevalence of macrovascular invasion compared with patients in the NAR group. Anatomic resection significantly reduced the risks of local recurrence and achieved a better 5 years disease-free survival. Also, anatomic resection was marginally effective for decreasing the early intra-hepatic recurrence. However, it was not advantageous in preventing late intra-hepatic recurrence compared with non-anatomic resection. No differences were found between AR and NAR with respect to postoperative morbidity, mortality, and hospitalization. Anatomic resection can be recommended as superior to non-anatomic resection in terms of reducing the risks of local recurrence, early intra-hepatic recurrence and achieving a better 5 year disease-free survival in HCC patients.

We first extend the notions of weighted curvatures, including the weighted flag curvature and the weighted Ricci curvature, for a Finsler manifold with given volume form. Then we establish some basic comparison theorems for Finsler manifolds with various weighted curvature bounds. As applications, we obtain some McKean type theorems for the first eigenvalue of Finsler manifolds, some results on weighted curvature and fundamental group for Finsler manifolds, as well as an estimation of Gromov simplicial norms for reversible Finsler manifolds.

We establish the generalized Myers theorem for Finsler manifolds under integral Ricci curvature bound. More precisely, we show that the forward complete Finsler n-manifold whose part of Ricci curvature less than a positive constant is small in $L^p$-norm (for p > n/2) have bounded diameter and finite fundamental group.

中國證券市場上市制度研究

오늘날 한중양국은 경제적인 측면에서 매우 긴밀한 동반자 관계가 되었기 때문에 향후에도 양국 간의 경제 및 금융 분야에서 지속적으로 발전할 것으로 예상된다. 중국의 증권시장은 고속성장을 이어져 왔고 특히 최근 십여 년 사이에는 괄목상대한 성과를 이루었다. 따라서 중국증권시장의 제도변화 및 규모성장은 한국의 금융시장에서도 중요한 관심사로 등장하기 시작했다. 따라서 본 논문은 중국 증권시장에 참여하는 한국의 투자자 보호와 한국증권시장에 상장한 중국기업에 대한 이해의 전제조건으로서 중국증권시장 상장제도를 면밀히 연구할 실질적인 필요를 밑받침하기 위해서 연구 분석한다. 이를 위하여 중국 증권시장 상장제도 변천과정을 70년대 말 중국이 개혁개방 정책 실시의 영향을 받아 중국 증권시장의 상장제도가 태동하기 시작한 80년대부터 현재까지 4단계의 시기로 나누어 고찰해 보고, 중국 증권법 및 상해증권거래소규칙과 심천증권거래소규칙 등에 산재되어 있는 증권시장 상장조건에 대해서는 자본금, 공개발행비율 등 항목별로 나누어 일목요연하게 살펴본다. 중국 증권시장 상장절차와 관련하여서는 상장 심의기구 등 상장주체와 아울러 거래정지 및 상장폐지에 대해서도 그 사유와 효력을 고찰한다. 특히 중국 증권시장의 상장절차 가운데 보증추천제도(保?制度)를 별도로 편제하여 상세히 다루었다. 이는 현재의 중국 보증추천제도(保?制度)는 홍콩의 보증추천제도를 참고하여 증권투자자 보호를 위하여 도입한, 한국에서 실시되고 있지 않는, 중국 증권시장에서 중요한 제도이기 때문이다. 이 제도를 심도 있게 분석하는 한편, 한국 증권시장에서 증권투자자 보호를 위하여 유사한 제도인 대표주관회사의 주의의무와 중국 보증추천제도와 상호 비교하여 각 제도의 유사점과 차이점에 대해 고찰한다.
