        전자정보 접근 방법의 법적 문제 - 진술거부권과 관계를 중심으로 -

        최근 전자정보에 대한 압수ㆍ수색에서 아이디, 패스워드와 같은 ‘접근권한정보’ 또는 ‘암호화 정보’ 취득과 그 적법성의 문제가 중요한 문제로 떠오르고 있다. 본 문헌은 ‘접근권한정보’나 ‘암호화 정보’의 규범적 성격을 밝히고, 그 취득을 위한 수사기관 활동의 적법성 판단기준을 특히 특히 진술거부권과 관계를 중심으로 논의하였다. 접근권한정보, 암호화 정보를 이용한 전자정보 수집에는 다양한 방법이 존재하며 그에 따라 살펴봐야 할 법적 쟁점에 차이가 있다. 본 문헌은 ① 접근권한정보 등의 ‘진술’, ② 접근권한정보 등을 입력하는 ‘행위’, ③ 접근권한정보 등으로 사용되는 ‘생체정보’로 유형화한 후, 특히 진술거부권과 관계에서 적법성 판단기준을 살펴보았다. 접근권한정보와 암호화 정보는 진술거부권의 보호 대상이며, 접근권한정보 등을 입력하는 ‘행위’, 접근권한정보 등으로 사용되는 ‘생체정보’에도 상응하는 보호가 이루어져야 할 것이다. 물론 ‘접근권한정보 등’에 진술거부권에 의한 보호를 인정하려는 시도가 실체진실의 발견을 저해하는 결과가 된다는 반론도 가능하다. 우리의 암호 관련 법 제도는, 정부도 민간에 대한 암호화 관련 규제를 하지 않지만, 다른 한편으로 형사소송법 등의 관련 절차에 어긋나지 않는 한 수사기관의 암호해제 시도 그 자체를 따로 제한할 법적 근거도 없는 것이라 할 수 있다. 본 문헌은 위와 같은 현재의 법 상태가 암호를 통한 프라이버시 보호라는 사익과 수사를 통해 달성하는 공익이 나름의 균형을 이룬 상태라는 전제에서 논의를 전개하였다. 향후 암호 관련 적절한 규제 수준과 그 평가방법은 어떠한 것인가라는 문제에 대하여도 진지한 논의가 필요할 것이다. Recently, issues of “access information” or “encryption information” such as IDs and passwords have emerged as important issues in the searches and seizures of electronic information. This paper reveals the normative nature of access information and encryption and discusses the criteria for determining the legality of investigative agency activities for its acquisition, especially focusing on the right to silence. First, I classified various methods for collecting data into (1) asking the ‘statement’ of access information, (2) requesting ‘actions’ such as entering access information, and (3) collecting ‘biometric information’ used as access information. Then, I reviewed the judging criteria for legality in relation to the right to silence. Access information and encryption should be protected by the right to silence. In addition, corresponding protection should be provided for ‘biometric information’ used as access information and ‘actions’ such as entering access information. It is possible to argue that attempts to recognize protection by the right to silence on access information and encryption will result in hindering the discovery of the truth. Our legal system does not impose encryption-related regulations on the private sector, but on the other hand, there is no legal basis to restrict the investigative agency’s attempts to decrypt unless they violate the criminal procedure law. This paper developed the discussion on the premise that the current legal system is balanced between the private interest of protecting privacy through encryption and the public interest achieved through investigation. In the future, serious discussions will be needed on the issue of appropriate levels of regulation on passwords and how they are assessed.

      • Convergence of the Sport Tourism as a Leisure Culture

        Purpose: This study is to research in Sport Tourism Studies as leisure culture, and also to suggest the future direction of this area in the perspective of convergence. Method: The methods used in the study are the literature analysis which is the method of using the Electronic Journal Database System of the National Assembly Library (http://www.nanet.go.kr), the Korean Studies Information Service (http://www.kstudy.com ), and the Online Library of the University of Brighton (http://libguides.brighton.ac.uk). Result: Firstly, there needs to be a conceptual shift in our thinking about this area with a new approach to the convergent concept of Sport Tourism, rather than considering each individual area separately. A convergent sport tourism model that is suggested in this study corresponds well with the notion of Sport Tourism. Secondly, as leisure culture is an expanded model of a modified convergent sport tourism which includes culture and art, researching on this area also helps to understand the nature of leisure and its behaviour as well as leisure industry. Thirdly, we are desperately in need of more conferences and seminars prior to hosting the 2018 Winter Olympics in Pyeongchang, and we also keep up with the latest relevant studies in the same level of world standard. It also should be encouraged to research on the related subjects such as Globalization, Nationalism and Identity, Leisure Constraint Negotiation Strategies, Serious leisure, Urban Regeneration, Sustainability, and Active Sport Tourism. Finally, academic courses in Sport Tourism should be offered widely in universities for a degree and even a master’s degree. To make this happen, we need to design a new syllabus and develop the relevant textbook contents in a diverse perspective. Conclusion: The Ministry of Culture, Sports and Tourism should take the head in supporting the convergence of Sport and Tourism, and Culture and Arts to maximize the benefits of Sport Tourism on each level of world/nation/local. And also the articles of sport tourism for convergence should be reflected in the National Assembly, Budget, Legislation, Publication, and Reports. English Academic journals should be established to lead our research on Active Sport Tourism to success in the perspective of convergence, by providing wider publicity of our events and functions to the world. It would be also helpful with either holding of a number of international conferences or event hosting.

        Effects of Ga contents on properties of CIGS thin films and solar cells fabricated by co-evaporation technique

        This study examined the effects of Ga content in the CIGS absorber layer on the properties of the corresponding thin films and solar cells fabricated using a co-evaporation technique. The grain size of CIGS films decreased with increasing Ga content presumably because Ga diffusion during the 2nd stage of the co-evaporation process is more difficult than In diffusion. The main XRD peaks showed a noticeable shift to higher diffraction angles with increasing Ga content, which was attributed to Ga atoms substituting for In atoms in the chalcopyrite structure. Band gap energy and the net carrier concentration of CIGS films increased with Ga/(In + Ga) ratios. Regarding the solar cell parameters, the short circuit current density (JSC) decreased linearly with Ga/(In + Ga) ratios due to the lack of absorption in the long-wavelength portion of the spectrum, while the open circuit voltage (VOC) increase with those. However, VOC values at high Ga/(In + Ga) regions (>0.35) was far below than those extrapolated from the low Ga contents regions, finally resulting in an optimum Ga/(In + Ga) ratio of 0.28 where the solar cell showed the highest efficiency of 15.56% with VOC, JSC and FF of 0.625 V, 35.03 mA cm-2 and 0.71, respectively.

        Synthesis of GaAs/SiO2 Nanocomposite Films by Using an Alternating Sputtering Method

        We fabricated GaAs/SiO$_2$ nanocomposite films at room temperature via the sequential sputtering of very thin layers of GaAs and SiO$_2$, which resulted in GaAs nanoparticles uniformly dispersed in a SiO$_2$ glass matrix. The high-resolution transmission electron microscopy (HRTEM) examination showed that the diameter of GaAs nanoparticles embedded in SiO$_2$ matrix depended on the nominal thickness of the GaAs layers. The blue-shift of the absorption edges gave not only the corroborating evidence for the systematic variation of the GaAs-nanoparticle size but also enabled us to estimate the diameter of GaAs nanoparticles quantitatively, which turned out to be consistent with the HRTEM observation. In addition to confirming the results of stylus, HRTEM, and Rutherford backscattering spectrometry (RBS) measurements, the analysis of variable-angle spectroscopic ellipsometry (VASE) spectra based on the effective medium theory revealed an interesting size-dependence of the complex refractive index of the GaAs nanoparticles.

        The Control of Spring-Mass-Damper Convergence System using H∞ Controller and μ–Synthesis Controller

        H∞ 제어와 뮤-합성 제어 방법을 사용하여 두 가지 상황, 즉 불확실성이 포함되지 않았을 때와 20% 불확실성이 포함되었을 때, 하에서 스프링-매스-댐퍼 시스템의 진동을 최소화하였다. 두 컨트롤러의 안정성 및 성 능 파악을 위해 GM와 PM 값을 사용하여 분석되었다. 중앙 수치 미분법과 RMS 방법을 사용하여 출력 응답의 신호 강도가 비교되었다. 끝으로, 안정성 비교를 위하여 3가지 다른 Wperf1 가중함수의 경우에 대해 총 40개의 H∞ 제어기와 뮤-합성 제어기 무작위 표본이 생성되었다. 전반적으로, 40개 플랜트 모델에서 얻어진 결과 값의 견고한 안정성과 성능 값에 따르면, 뮤-합성 제어기가 H∞ 제어기보다 진동 관리에 효과적임이 입증되었다 With a given spring-mass-damper system, ∞ and -synthesis control methods are used to build system controllers which minimize vibrations at two major natural frequencies in two cases; without uncertainty; with 20% uncertainty. In order to check the stability and performance of two controllers, those are examined using GM and PM values. The signal strength of output responses is compared using the concept of central numerical differentiation and then results are quantified using the RMS method. Lastly, 40 random samples of H∞ and μ–synthesis controllers are obtained for three different Wperf1 weighting functions and drawn in the time domain in order to compare the stability. Overall, μ-synthesis controller manages the vibrations much better than H∞ controller according to the robust stability and performance values obtained by simulating random samples of 40 plant models.

        Optimal Battery Pack Design Tool for the Delivery UAV

        무인항공기 산업이 성숙해짐에 따라 촬영, 정찰, 구조 등 많은 분야에 무인항공기가 적용되고 있으며, 이로 인하여 신속한 무인항공기의 하드웨어의 설계, 특히 배터리팩의 설계가 필요하게 되었다. 수직이착륙 형태의 배송용 무인항공기의 편리한 배터리팩 구성 설계를 위한 자동 배터리팩 설계 툴을 개발하였다. 전류, 전압 패턴, 여러 셀 사양, 원하는 배터리팩 전압 등의 입력을 하면, 자동 배터리팩 설계 툴이 균질 셀 또는 이종 셀들을 결합하여 최소 중량과 최대 용량을 갖는 배터리팩을 계산한다. 또한 이 툴은 설계된 배터리팩 구성의 사용에 따른 용량 감소 경향을 예측할 수 있다. As the UAV industry is getting matured, various types of UAVs have appeared in many application fields, including filming, reconnaissance, rescue, and etc. and it requires the quick hardware designs, particularly a battery pack, of the UAV. We developed the automatic battery pack design tool for the convenient battery pack configuration design of the hoverable type delivery UAV. With inputs, including current profile, voltage profile, various kinds of cell specifications, desired battery pack voltage, and etc. the automatic battery pack design tool calculates a pack having the minimum weight and the maximum capacity by combining either homogeneous cells or heterogeneous cells. Also, the tool could predict the capacity fading trend of the designed battery pack configuration.

        IT Convergence UAV Swarm Control for Aerial Advertising

        소형 무인항공기의 가격이 저렴해지고 제어가 쉬워짐에 따라, 고정익 또는 회전익 무인항공기를 사용하는 항공 어플리케이션이 최근 많이 등장하였다. 본 논문에서는 4대의 회전익 무인항공기를 사용한 새로운 공중 광고법 이 제안되었다. 무인항공기 군집 제어를 통해, 4대의 무인항공기가 7.07 × 7.07 m2 사이즈의 정사각형 현수막을 사 전에 정의된 비행경로를 따라 운반하며 공중 광고를 한다. 시뮬레이션 결과에 따르면, 무인항공기들이 669 × 669 m2 크기의 영역에서 전체를 비행하며 공중 광고를 수행하는 데는 총 270 s 가 소요되며, 무인항공기들 사이의 최소 거리는 0.45 m 로서 충돌이 발생하지 않음이 밝혀졌다. 몇몇 급격한 방향 전환이 필요한 경로로 인하여 무인항공기 들이 정확한 정사각형 군집 비행을 수행하기 어려운 구간이 있으며, 이때 정사각형 편대 비행의 최대 및 최소 변의 길이는 10.35 m와 1.96 m로 밝혀졌다. 또한, 정사각형 편대 비행의 최대 및 최소 대각선 길이는 각각 14.75 m와 2.78 m로 파악되었다. As the price of small UAVs is getting cheaper and its controllability is getting greatly increased, many aerial applications using both fixed-wing and hoverable UAVs have appeared in recent years. In this paper, a new aerial advertising method is proposed using four hoverable UAVs. Using the UAV swarm control method, four UAVs are maneuvered to carry a 7.07 × 7.07 m2 square banner along collision-free and predefined waypoints for aerial advertising. According to simulation results, it takes about 270 s for UAVs to perform aerial advertising in 669 × 669 m2 size area and the minimum distance among UAVs turns out to be 0.45 m which proves there is no any collision. Due to abrupt direction changes of UAVs along the predefined waypoints, UAVs cannot always maintain exact square formation and it results the maximum and minimum side lengths of square formation to be 10.35 m and 1.96 m, respectively. Also, the maximum and minimum diagonal lengths of square formation turn out to be 14.75 m and 2.78 m, respectively.
