      • 특허심판에서 제3자의 참가에 관한 검토

        특허심판원에 특허심판이 제기된 경우에 이해관계인은 자신의 법률상 지위를 지키지 위해 그 심판에 참가할 수 있다. 이해관계인이 당사자로 참가하는 것을 공동소송적 당사자참가라고 하며, 당사자의 승소보조자로 참가하는 것을 공동소송적 보조참가라고 한다(특허법 제155조 제1항・제3항). 공동소송적 당사자참가는 민사소송법의 공동소송참가(민소법 제83조)와 유사하며, 공동소송적 보조참가는 민사소송법의 공동소송적 보조참가(민소법 제78조)와 유사하다. 민사소송법은 소송결과에 이해관계를 가지는 자의 통상의 보조참가(민소법 제71조), 소송목적의 전부 또는 일부가 자기의 권리임을 주장하거나 소송의 결과 권리의 침해를 주장하는자의 독립당사자참가(민소법 제79조)를 인정하고 있는데, 특허심판에 이러한 통상의 보조참가 또는 독립당사자참가가 가능한지 문제된다. 결정계 심판인 특허거절결정에 대한 심판과 정정심판에서는 심판의 결과에 법률상 이해관계를 가지는 사람은 통상의 보조참가를 할 수 있다고 본다. 그리고 독립당사자참가의 경우에도 그 요건을 충족하면 허용될 수 있으므로, 모인특허를 무효사유로 하는 특허무효심판에서는 진정한 발명자는 권리주장참가를 할 수 있고, 권리범위 확인심판에서는 심판의 결과 자신의 권리가 침해된다는 것을 주장하는 전용실시권자는 사해방지참가를 할 수 있다고 본다. 이처럼 특허심판에 참가할 수 있는 다양한 참가유형을 인정하는 것이 특허심판을 통해 관련 분쟁을 일거에 해결할 수 있는 방안이 되며 특허심판에서의 참가를 활성화할 수 있을 것이다. In case a patent trial was filed in the Korean Intellectual Property and Appeal Board, the interested party may intervene into the trial in oder to protect his or her own legal interests. The participation of the interested party in the trial as a co-litigant is called as the intervention as a party of joint action, and participating as a winning assistant for the interested party is called as the intervention for assistance of joint action (The Patent Law Article 155 Section 1 and Section 3). The intervention as a party of joint action for patent trials is similar to joint participation in litigation in the Civil Procedure Act (The Civil Procedure Act Article 83), and the intervention for assistance of joint action for patent trials is similar to the intervention for assistance of joint action in the Civil Procedure Act (The Civil Procedure Act Article 78). The Civil Procedure Act allows that any third party interested in the result of a lawsuit may intervene in order to assist either party, so called supplementary intervention (The Civil Procedure Act Article 71), and that any third party who claims that the whole or part of the object of lawsuit is his/her own right, or that his/her rights are likely to be infringed pursuant to the result of lawsuit, may intervene in the lawsuit as a party, so called intervention as independent party (The Civil Procedure Act Article 79). Thus, whether the above-mentioned supplementary intervention or independent party intervention is allowed in the patent trials becomes a question. It is deemed that the party legally interested in the result of the trial is allowed to usually intervene for assistance in the ex parte trial, namely, the trial for a rejection of patents, and the trial for correction. Further, as the independent party intervention can be allowed when it meets the requirements, it is considered that the true inventor to claiming the rights in the trial on invalidity by the nullity of grounds based on the misappropriated patent rights, and the exclusive license older to claiming an infringement of the rights for individual invasion prevention in the trial to confirm scope of rights can be allowed to participate. Therefore, acknowledging the various types of participation available in the patent trials will be a solution for settling related conflicts in one action thorough the mentioned trials, and invigorating the participation in patent trials.

      • 신호분리를 위한 Diplexer에 관한 연구

        본 논문에서는 신호의 분리와 합성이 가능한 Diplexer를 제작하였다. 저역 통과 여파기와 고역 통과 여파기의 특성을 정합하여 Diplexer로 구현함으로써 신호의 분리와 합성이 가능하다는 것을 시뮬레이션을 통해 확인하였다. 또한 신호의 분리와 합성의 가능성을 입증하기 위해 실제 마이크로스트립구조의 Diplexer를 제작, 측정한 결과 각각의 통과 대역폭 내에서 0.4dB, 0.8dB이내의 삽입손실과 -20dB의 반사손실이 됨을 실험결과를 통해 알수 있었고 또한, 인덕터의 구현 방법을 마이크로스트립으로 하여 주파수 특성과 재현성을 높였다.

      • CdS-polyphosphate system을 이용한 태양에너지의 화학적 저장

        Various artificial photolysis systems such as vesicle-stabilized or suspended semiconductor particle systems have been developed by previous workers. The use of inorganic semiconductor powders is certainly attractive in view of the active high-surface area in the photoprocess and the simplicity of the system. Yet, low efficiencies due to light reflection, recombination of photogenerated electron-hole pairs are serious disadvantages. And so various methods for the preparation of semiconductor particles were developed in recent years. These include stabilization of colloidal particle aggregates by polymers and vesicles. In this paper, CdS-polyphosphate system, stabilized system of colloidal particle aggregates by polymer(polyphosphate), is used to produce hydrogen by photolysis of water.

      • 紅蔘大補湯의 抗癌活性 및 抗轉移 效果에 關한 硏究

        To evaluate the antitumor activity and antimetastatic effects of Hongsam -daibotang(HDT-C), studies were done experimentally. The results were obtained as follows: 1.In cytotoxicity against A549, SK-OV-3 and B16-BL6 concentration inhibi ting cell growth up to below 30% of control was recognized at 10^-3g/ml of HDT-C. 2.The T/C% was 145.4% in HDT-C treated group in S-180 bearing ICR mice. 3.In Inhibitory effect on activity of DNA topoisomerase I, the IC?? was shown 100-200 ㎍/㎖ of HDT-C. 4.The expressing TNF-α was increased in HDT-C treated group as compared with control. 5.The expressing MMP-9 was decreased in HDT-C treated group as compared with control. 6.HDT-C extracts exhibited efficient adhesive effect of A549, B16-BL6 cell to complex extracellular matrix. 7.In CAM assays, angiogenesis was significantly inhibited in HDT-C treated group than control group. 8.In pumonary colonization assay, a number of colonies in the lungs were decreased significantly in HDT-C treated group as compared with control group. 9.In hematological changes in B16-BL6 injected C57BL/6, numbers of WBC and were decreased insignificantly and also those of platelet were increased insignificantly in HDT-C treated group as compared with control. 10.In the histological changes of lung in B16-BL6 injected mice, infiltration of cancer cells were inhibited effectively in HDT-C treated groups whereas many cancer cells were infiltrated into erivascular and peribronchiol of control group. These results suggested that HDT-C extracts might be usefully applied for prevention and treatment of cancer.

      • 2자유도 서스펜션 시스템의 주파수 응답특성 분석

        Automotive suspension system is mechanism for isolation of the vibration coming from the road inputs. However, the passive suspension system has limitation to improve the vibration isolation both low frequencies and high frequencies. To improve the performance of the passive system the active and semiactive suspension systems have been developed. In this paper, to show the effect of performance improvement for the active suspension system compared to the passive one the technique for frequency response analysis is introduced theoretically. At this time fairly complicated two degrees of freedom vehicle model is used and both sprung mass response and wheel response are compared. Finally, to confirm the improvement of performance of the active suspension system the computer simulations is carried out.

        자궁내막에 발생한 점막 연관 림프조직 (MALT) 림프종 1예

        Non-Hodgkin's 림프종의 약 40%는 결절외(extranodal) 림프종으로 대개 위장관에서 발생하며 이들 중 점막 연관 림프조직(mucosa-associated lymphoid tissue: MALT)에서 기원한 림프종은 MALT 림프종으로 분류된다. 위 외의 부위에서 원발성으로 발생하는 MALT 림프종은 매우 드물지만 실제 거의 모든 신체 장기에 발생하는 것으로 알려져 있는데, 가장 흔한 부위인 위 외에도 폐, 갑상선, 침샘, 눈물샘에 발생하고, 드물게 안구, 유방, 방광, 신장, 흉선 등에도 보고된 바 있다. MALT 림프종은 오랜 기간동안 원격 전이하지 않고 국소 병변으로 남아 있는 특징이 있어 치료 방향 또한 국소 병변의 치료에 집중되며, 예후도 림프절 기원의 림프종에 비해 양호한 것으로 알려져 있다. 본 저자 등은 자궁 내막에 원발성으로 발생한 MALT 림프종 1예를 경험하였기에 문헌 고찰과 함께 이를 보고하고자 한다. Mucosa associated lymphoid tissue (MALT) lymphoma can rarely develop primarily in extranodal sites other than stomach which is the most common site for it. Other rare primary sites are small intestine, colorectum, esophagus, lung, thyroid, salivary gland, lacrymal gland, breast and skin. MALT lymphoma represents a distinct clinicopathologic features: it is usually localized to their original site for a long time and shows much more favorable prognosis than lymphoma at other site, but some MALT lymphoma can arise simultaneously or successively in different organ or give rise to another MALT lymphoma of other organ and can be multifocally disseminated or recurred. We report a very rare case of high grade B-cell lymphoma of mucosa associated lymphoid tissue (MALT) of the uterine endometrium, which was confirmed by immunohistochemical assay.

        Kim Si-Seup(1435-1493), the first significant writer of imaginative, wrote his immortal Geum-o-sin-hwa influenced by Jeun-deung-sin-hwa. The book enjoyed a great popularity in Korea. But Kim Si-Seup was originally a man who turned from reality, because he could not come to terms with the demand for the renunciation of instinctual satisfaction as it was first made, and who then in fantasy-life allowed fully play to his erotic and ambitious wishes. In Geum-o-sin-wha, Kim Si-Seup's wishful phantasy remains repressed. It is also instructive to consider Geum-o-sin-hwa in the relation of anxiety-dreams. In the dreams, a repressed wish has found a means of evading censorship and the distortion which censorship involves. In Geum-o-sin-hwa, Kim Si-seup's obsessional self-reproaches also appear.

      • 시스템 고장시 안전성이 보장되는 자동차용 동력 지원 스티어링 시스템에 관한 연구

        When human power is not sufficient to turn the actuating device in the vehicle steering control system the power assist systems are used. There are a variety of means for achieving a power assist system, for example, a fly-by-wire or drive-by-wire, etc. Such power assist systems have a basic disadvantage that results in an uncontrollable system under failures in the sensors, actuators, and signal processor. Here, two complementary power assist systems in which a mechanical back-up function can be provided for fail safe operation are suggested. The fact that two systems have distinct capabilities when used for power steering or vehicle stabilization and handling enhancement and are safe for complementary actuator failures is discussed. Furthermore, the two systems have a merit which affect the back relations related to the feel that a human operator would sense in quite different ways.

      • 상부소화관출혈에 있어서 내시경적 분말약제산포의 효과

        Background : Bleeding after endoscopic procedure of the stomach carries an increased risk of morbidity and mortality. In case of oozing hemorrhage, not in active hemorrhage, powdered sodium alginate may play a role in control of bleeding with convenience. Therefore, we evaluated the clinical effect and efficacy of sodium alginate powder in upper G-Ⅰ bleeding. Methods : Forty-five patients who had upper G-Ⅰ bleeding after endoscopic procedure were enrolled in this study. Twenty-five patients of them were managed by the application of powder preparation of Sodium alginate(ALTO). The others were observed without treatment. The next day, we performed endoscopy in all patients to ascertain the hemostasis. Results : Of 25 patients managed with Sodium alginate, only two patients(8%) had bleeding (hemostatic rate : 92%), On the other hand, of 20 patients who did not receive any treatment, 3 patient(15%) had bleeding (hemostatic rate : 85%). There was no statistical difference between the two groups(p>0.05). Using other endoscopic procedure, We successfully treated the patient who continued to bleed. Conclusion : We evaluated the effect of the spary of sodium alginate on oozing hemorrhage. Although there was no statistical significance in our study, it seems that the spray of sodium alginate may be a useful method for the prevention of bleeding after endoscopic procedure.
