영국은 임대주택의 안정적인 제공과 관리를 위하여 「주택법」, 「주택과 도시재생법」 등의 법률을 규정하고 있다. 그러나 2017년 영국의 저소득층과 이민자들이 주로 거주하고 있던 고층 아파트에서 발생한화재 사건을 계기로 잠재되어 있던 임대주택의 안전 문제를 재검토하게 되었다. 특히 이 사건은 최소한의안전장치가 마련되어 있었다면 피해자를 줄일 수 있었을 것이라는 점에서 정부의 임대주택 규제 방식을개선해야 한다는 논의가 활발하게 이루어졌다. 수년간의 논의 끝에 정부는 2023년 임대주택에서 거주하는 임차인의 안전을 보장하고 임대주택의 주거환경을 개선하기 위하여 「2023년 임대주택(시행규정)법(Social Housing (Regulation) Act)」을 제정하였고, 임대주택 규제 기관의 역할을 강화하였다. 「임대주택(시행규정)법」에서 기존의 임대주택의 관리와 규제에 관한 법률이 개정됨에 따라, 안정적인 삶의 기준을 충족하지 못하는 주거지의 임대인에게 개선을 요구할 수 있는 예방적 접근방식의 촉매제가 될 것으로기대한다. 본 논문에서는 「임대주택(시행규정)법」의 규정 중 임대주택의 임차인을 보호하기 위한 규정을 중심으로 주요 내용을 분석하여 소개한다. 현재 우리나라 국회에서는 공동주택의 관리와 관련한 법안, 정부의 영구임대주택 공동관리비 지원 법안 등이 논의되고 있어, 임대주택 및 공동주택 시설 관리의 규제 및 감독에대한 법제 정비에 있어 영국의 이번 개정법의 입법적인 측면을 참고할 수 있을 것이다. The UK stipulates laws such as the Housing Act and the Housing Reorganization Act to ensure the stable provision and management of social housing. However, a fire incident that occurred in a high-rise apartment in the UK in 2017, where low-income people and immigrants mainly lived, served as an opportunity to reexamine potential safety problems in social housing. In particular, this case raised the need to improve the government's method of regulating social housing, as the number of victims could have been reduced if minimum safety measures had been in place. In response to this incident, a law was enacted in 2023 to improve the safety of social housing and the living environment of tenants, strengthening the role of social housing regulatory agencies. The law is expected to be a catalyst for a proactive approach to regulating social housing and taking action against landlords who do not meet standards. In this paper, analyze the main contents of the 2023 Social Housing (Regulation) Act) and introduce the provisions of the law for the protection of social housing tenants. As bills related to the management of apartment complexes and the government's bill to support joint management costs for permanent social housing are still pending in the Korea National Assembly, the UK's revised law on the facility management of apartment complexes by regulatory agencies can be used as a reference for the legislative aspect.
