오늘날 사회현상에 있어서는 수많은 갈등이 발생하고 있다. 공법영역에서도 거대한 공공사업의 시행과 관련하여 많은 갈등이 생기고 있다. 법치국가에 있어 갈등은 원칙적으로 소송절차를 통해 해결되지만, 소송은 갈등을 회피하거나 완화하는데에는 큰 도움이 되지 않는다. 갈등의 회피나 완화를 위한 수단으로 비소송적 수단이 새롭게 주목을 받고 있으며, 이는 국가와 사회의 관계에 있어 변화하고 있는 국가성의 태양으로 나타나고 있다. 중재는 갈등의 사회적 자율 및 협력적 공공복리구체화의 형태이며, 현대국가에 있어 하나의 특징으로 나타나고 있다. 중재의 개념 이해에 있어서는 한국과 독일의 경우에 있어 큰 차이가 없다. 한국에 있어 중재는 1980년대에 와서 문헌에서 논급되기 시작하였으며, 사법적 구제절차에 대한 관계에 있어 선택적 구제수단으로 인정되었다. 이 점에서 중재는 비소송적 구제수단으로 파악되고 있다. 환경법 영역에 도입된 중재제도는 그 예이다. 그 외에도 건축분쟁조정위원회에 의한 조정, 건설산업분쟁조정위원회에 의한 조정, 하천분쟁조정위원회에 의한 분쟁조정 등이 있는데, 특징은 행정기관의 하나인 행정위원회가 소송의 전단계에서 분쟁조정을 주도함에 있다. 본 논문은 공법영역에서 갈등해결을 위한 수단으로 비소송적 수단을 규율하고 있는 건축법, 환경분쟁조정법, 건설산업법 등을 중심으로 분쟁조정 절차를 고찰하였다.

The study on starting point of negative prescription caused by the infringement of the right of light Hyun-Seok Lee As the society has been developed and diversified, the activities among people may have an effect on one another. There are several cases where this complexity of the society causes unintentional damages. In most cases, environmental pollution is the effect of legal activities. In order to rule whether damage is illegal or not, it is needed to make a balance between parties. Also it should be considered that the damage exceeds limit that common person could bear. When there happens to be environmental damages, legal aid would be restrained to reduce the pollution and compensate the damage. According to the civil code article 766-1, to deal with tort, there is a three-year sunset from the date that victim or his proxy knew the damage and its attacker. The law regulate this extinction prescription to be short-term one so that the victim can decide whether he would accept the compensation or not and the attacker would be provided the right under the principle of reliability. The trial clearly ruled on the range of compensation and the standing point of reckoning the negative prescription. The court said when the damage is not severe to get rid of the building but exceed the limit, the plaintiff can only claim for damages. The amount of indemnity regarding property damage and mental loss would start counting from the day the pre-delivery inspection is finished which is the plaintiff knew the damage. On the other side, there were dissent opinions that the right to have sunlight is not only the civil right regarding property but also the constitutional right relating to environmental right and personal right. But it also point out that the majority only consider this case as in the category of property right. This approach might not fully guarantee rights. The reality is that the court counts the mental loss to be also covered in the name of the property damage. Unless the plaintiff argues for specific circumstances and has responsibility for proving evidences, it is not allowed to ask for compensating the mental loss separately. For these reasons, this trial judgment made clear the concept and the legal aspects of the right to have sunshine. Furthermore, it is important to recognize that this was the first decision on the issue of starting point of extinction prescription.

칼라 히스토그램과 엔트로피를 이용한 동영상 장면전환 검출

In content-base video data retrieval, the detection for scene change is needed. Color histogram approaches are generally used. Color histogram approaches are simple and more robust to object and camera movements but they ignore the spatial information and fail when two different frames have similar histograms. We propose a new algorithm to use color histogram and entropy to enhance the false-positive occurred by brightness variation and the miss by similar color histogram. At the experiments, it is more robust to brightness variation and have spatial information.

조혈모세포이식 환자에서 침습성 진균 감염에 대한 Micafungin의 예방 효과 및 안전성

Background: Micafungin, a potent inhibitor of 1,3-β-D-glucan synthase, is a novel antifungal agent of the echinocandin class. In vitro study showed that micafungin was effective against Aspergillus species as well as Candida species, but clinical data on the prophylactic efficacy against invasive fungal infections (IFIs) other than candidiasis are still lacking. Materials and Methods: We identified 60 consecutive adult hematopoietic stem cell transplantation (HSCT) recipients who received at least 3 doses of micafungin during neutropenic period. Micafungin was started as an alternative in patients who were intolerant or had adverse events (AEs) to primary prophylactic antifungal agents. We retrospectively reviewed the medical records and analyzed the efficacy and safety of micafungin for prophylaxis against IFIs. Results: The patients either had autologous (n=9) or allogeneic (n=51: 1 syngeneic, 24 sibling, 26 unrelated donor) HSCT. Itraconazole oral solution (n=58) was the most frequently used first line antifungal agent for prophylaxis and was administered for median 11 days. The most frequent cause of switch to micafungin was vomiting (n=42). The duration of neutropenia and micafungin administration was median 13 and 12 days, respectively. A successful outcome was achieved in 45 (75%) patients. Empirical antifungal therapy was initiated in 13 (22%) patients. There were 2 cases (3.3%) of breakthrough fungal infections which comprised a probable invasive pulmonary aspergillosis and a possible invasive fungal sinusitis. There was no case of invasive candidiasis. A total of 53 (88%) patients experienced at least one AE regardless of causality during micafungin administration. The most frequent AEs were hypokalemia, vomiting, diarrhea, and elevated serum aspartate aminotransferase or alanine aminotransferase. Among the aforementioned AEs, only 1 case of diarrhea could be classified as a probable relation with micafungin when causality was assessed. There was no AEs that caused discontinuation of micafungin. Conclusions: Micafungin seems to be a safe and effective agent for prophylaxis of IFIs including aspergillosis as well as candidiasis in HSCT recipients. However, further large, prospective, and randomized comparative studies are warranted for aspergillosis.

Baik, Seok-Hyun. Logos of Curse and Rescue in Absalom, Absalom! The New Studies of English Language & Literature 49 (2011): 65-77. The paper, regarding multiple biblical parallels that pervade the novel, aims to understand the true nature of good and evil inherent in human life that Faulkner’s characters show, and further to understand the sense of history that Faulkner wants to reveal. Sutpen with Davidic parallels shows the powerful and paternal authority of the Old South, whose career and fate reflect the contradictions that prevail in the Southern society. Indeed, the nature of his success only originates from his distorted and egocentric ambition, which exposes the evil of racism, fratricide, the contradictions of patriarchy, and also results in the inevitable collapse of the South: the divine curse upon Sutpen. His son, Charles Bon, analogous to Amnon in the Bible, is related to incest-miscegenation, which after all brings about the fratricide, destroying Sutpen’s dream of founding a dynasty, as implied by the novel’s title. And he is also used as a metaphor for a Christ Figure: a symbol of suffering, sacrifice, and love that Faulkner seeks to embody in the novel. The biblical parallels, reshaped and recreated by Faulkner in the novel, seem to warn man of his arrogances and corruptions, regarding the timelessness and universality of human history that Hebrew history shows. 국소성 분절성 사구체 경화증의 완전 관해 후 발병한 IgA 신병증 1예

We report a rare case of primary glomerular disease with IgA nephropathy in a 43-year old man. 7-years ago, he was diagnosed with minimal change nephrotic syndrome. After treatment with steroid for 1-year, azotemia and proteinuria were improved. But, nephrotic range proteinuria was relapsed within 1 week after cessation of steroid. Renal biopsy revealed focal segmental glomerulosclerosis, and achived a complete remission with the use of steroids and cyclophosphamide. Then, he was followed up with normal renal function for 4-years. On admission, the patient showed generalized edema and marked proteinuria. In 3rd renal biopsy, mesangial proliferative glomerulonephritis with diffuse global sclerosis was observed. Electron microscopy showed electron-dense deposit on the mesangium with slight mesangial proliferation, and immunofluoroscence microscopy showed granular deposits of IgA and IgM. These features were consistent with IgA nephropathy, different from results of previous biopsies. The pathogenesis of IgA nephropathy occurred with primary FSGS is not clear, as well as treatment. Now, proteinuria is improving, steroid and cyclophosphamide are probably useful for the disease.

초등학교 5,6학년의 경험적 내러티브 분석 연구 -학급 내 발표 상황에서 생성된 담화를 중심으로-

이 연구의 목적은 초등학교 5·6학년 학생의 경험적 내러티브 담화를 분석하고, 양적·질적인 면에서 해석함으로써 교육적 시사점을 모색하는 것이다. 연구의 목적을 이루기 위해 연구자는 경험적 내러티브가 지니는 초등교육, 국어 교육, 인성 교육적 측면에서의 의의를 고찰하였다. 그리고 서울, 경기, 대구 등 세 개 지역의 5,6학년이 생성한 내러티브 담화를 수집하였다. 최종 선정된 104개의 담화를 분석한 결과, 학급 내 발표 상황에서 5·6학년 학습자의 경험적 내러티브 평균 발화 시간은 36.87(초)이 었으며, 내러티브 당 에피소드는 평균 1.9개, 평균 2.34개의 문장과 4.26개의 C-unit을 포함하였다. 경험적 내러티브 구조의 발달 수준은 평균 3.84(SD=1.791)로 분석되었다. 5·6학년의 경험적 내러티브 담화를 서현석 외(2013)에서 분석한 1·2학년의 경험적 내러티브 담화와 비교한 결과는 다음과 같다. 첫째, 5·6학년의 경험적 내러티브에서 좀 더 많은 부가 관계의 말하기 양상이 포착되었다. 이는 인과관계를 효과적으로 구사하여 내러티브를 구성하는 능숙한 화자의 말하기로 볼 수 없는 것이다. 둘째, 5·6학년 학습자의 경험적 내러티브의 구조 발달 수준은 1·2학년의 경험적 내러티브 구조의 발달 수준(평균 5.39 /SD=1.743)보다 낮은 것으로 분석되었다. 이러한 결과는 학년이 올라갈수록 점차 늘어나는 학습량을 일정한 수업 시간 내에 다루어야 하기에 좀 더 교사 중심적인 수업이 되는 것과 관련이 있다고 해석할 수 있다. 즉, 5·6학년 학생들은 진정한 자기표현이 기회 대신에 자신의 경험과 멀어지는 추상적인 학습 내용에 집중하게 되어 오히려 1·2학 년의 경험적 내러티브 구조 발달 수준보다 낮은 수준을 보였다. Purpose of this study is analyzing personal narrative discourse of elementary fifth and sixth graders and seeking educative implication by interpreting quantitative and qualitative side. To achieve purpose of this study, researcher considers personal narrative’s meaning on aspect of elementary education, Korean language education and character education. Researcher also analyzes 104 narrative discourses generated from elementary fifth and sixth graders of Seoul, Gyeonggi, Daegu. The analysis shows that at presenting context in class, the average speaking time of the learner’s personal narrative is 36.87 seconds and the average number of the stories per one narrative is 1.9. It also includes 2.34 sentences and 4.26 C-units on average. And the level of development of personal narrative structure is 3.84(SD = 1.791) on average. Researcher compares the fifth and sixth grader’s personal narrative discourse with the first and second grader’s analyzed by Seo, Hyun-Seok et al(2013). First of all, in the fifth and sixth grader’s personal narrative, more modes of telling with additive relation are detected. This is rather far from telling of skillful narrator that constructs narrative by expressing causal relation efficiently. Secondly, the fifth and sixth learner’s level of development of personal narrative structure is analyzed lower than the first and second learner’s(5.39 on average /SD=1.743). This result shows that the higher grade students move, the more teacher-centered class is. Because more quantity of learning must be treated in fixed class hour. In other words, the fifth and sixth students concentrate abstract learning contents instead of true self-expression. This rather influences the result that the fifth and sixth learner’s level of personal narrative fulfillment is lower than the first and second learner``s.

信號의 特性을 利用한 벡터 量子化에 關한 硏究

In this paper, we have proposed a VQ algorithm which quantize feature vector of speech signal using a generating order. The proposed algorithm inspect which codeword follows present codeword and add new index to established codebook, when quantizer is mapping speech signal. We present a variable bit rate for new codebook, and propose efficient compression way of information. In this way , the number of computation and the number of codewords to be searched is reduced dramatically. The performance of the proposed VQ algorithm is evaluated by spectrum distortion measure and bit rate. The obtained spetrum distortion is reduced about 0.149[dB] and the bit rate is saved over 1 bit/ frame.

간세포암과 감별이 어려웠던 악성중피종 치험 1예

Malignant peritoneal mesothelioma is a rare neoplasm that arises from the mesothelium of a serosal cavity and is a rapidly fatal disease with a median survival of 4 to 12 months for untreated cases. Recently, we experienced a case with malignant peritoneal mesothelioma who was suspected hepatocelluar carcioma by abdominal CT scan and was confirmed by biopsy including immunohistochemical stain(calretinin) after surgery. We performed tumor excisions and wedge resection of the liver(segment Ⅷ)and inserted Tencoff catheter in abdominal cavity at 25th day of post-operation. We treated with intraperitoneal paclitaxel(25mg/m^(2)/day for 5 days) six courses monthly. She was well tolerable and is still living without any evidence of recurrence for 14th month of post-operation.
