        Goretex를 이용한 융비술

        융비술시 실리콘 고무는 다루기 쉽고 조직 반응이 적어 현대 많이 돌출의 합병증이 생길 수 있다. 저자등은 이러한 실리콘의 단점을 보완할 수 있는 goretex를 사용하여 융비술을 시행하고 비첨에 대해서 자가연골을 이식하여 만족할 만한 결과를 얻었기에 goretex가 안면부 연조직의 증강을 위한 이식재료로 적합하다고 생각되어 문헌고찰과 함께 보고하는 바이다. Many different materials have been used to provide augmentation of the nasal dorsum. this include both autogenous and homogenous materials,as well as allografts. Silicone among the artificial materials has been most widely used. The silicone has some advantages and disadvantages. Goretex(expanded polytetra-fluoroethylene) which has widely used in vascular surgery and abdominal surgery can be used for facial soft tissue augmentation. The author presemts 2 cases of nasal augmentaion using goretex with literature review.

      • 외부광궤환에 의한 레이저 다이오드의 출력특성

        외부 광궤환 반도체 레이저의 출력 특성을 비율방정식의 수치해를 이용하여 분석하였다. 출력의 세기와 위상과 전자밀도를 시간에 대한 함수로 알아보았다. 또한 bifurcation diagram과 phase diagram을 통하여 궤환비율 k에 따른 레이저의 동작 특성을 조사하였다. 궤환광이 없을때는 이완발진이 감쇄한 후 안정한 출력특성이 나타나지만 되먹임 비율이 증가하면서 안정한 해의 갯수가 증가하다가 ??????이상의 매우 강한 광궤환에서는 출력특성이 극도로 불규칙해지고 무수히 많은 해를 갖는 혼돈현상이 나타남을 알 수 있었다. The output characteristics of a laser diode with external optical feedback were analyzed by numerical solutions of rate equations. The output power, phase and carrier density were plotted as a function of time. Dynamics of external cavity laser were investigated by the bifurcation diagram and the phase diagram with respect to the feedback rate k. If there was no feedback, relaxation oscillation reduced and laser showed stable output. For increasing feed back level, the number of stable state was increased. In very strong feedback rate above ??????, laser output showed extremely unstable and chaotic behavior.

        비복신경이식을 이용한 긴 거리의 말초신경 결손부 수복

        The surgery of oral and maxillofacial area poses the risk of cranial nerve damage such as trigeminal nerve or facial nerve. Inferior alveolar nerve is prone to damage in the third molar extraction, implant installation, orthognathic surgery, open reduction and rigid fixation, and tumor ablation surgery. On the other hands,facial nerve is likely to be damaged or sacrificed with trauma or parotidectomy. In case of inferior alveolar nerve injury, the incidence is reported to be about 1.3%. The nerve function will almost recover in minimal damage, but it won't recover at last in total damage of a part of nerve unit. In latter cases, nerve regeneration in intended by allograft as nerve substitute or various route of merve condit. But the recovery with autograft is believed to be most relialbe mrthod in the rapair of long-span(longer than 15㎜)nerve defect. We have performed autologous sural nerve graft in the repair of nerve defect, which is caused by resection of benign or malignant tumor. Hereby we report the method of nerve harvesting, recovery of defected peripheral nerve and the complications of donor site with the discussion of sural nerve anatomy.

        하치조신경 및 설신경 손상 평가를 위한 한국인 정상 성인의 하순-이부 및 혀의 감각 조사

        In the head and neck area, there are so many sensory nerves, which are sometimes injuried iatrogenically or inadvertently so that involved patients complained of the loss of sensations. In such cases, it is important to judge the degree of injuries and regeneration of nerve for better diagnosis and treatment. Seddon and Sunderland's classification, which is commomly used, is focused on histological change and nerve conduction. As times goes by, it is difficult to access patient's sensory disturbance by this method. Until now, so many methods such as contract threshold, direction, two-point discrimination, pin prick, thermal discrimination and current perception threshold have been introduced for sensory evaluation. However, there hasn't been enough information regarding each methodology nor integrated standard methodology for the measurement. the purpose of this study is to get Korean adult normative sensory values of lower lip,chin and tongue using modified methods of contact thershold, ditection, two point discrimination, pin prick, thermal discrimination and assess degree of regeneration of sensory nerve damage.

      • 특허권침해의심물품에 대한 국경조치시 세관의 역할 재정립 방안

        Section 4 of the TRIPS Agreement stipulates special requirements related to border measures and Article 51 stipulates suspension of release against goods being suspected of infringing patent rights by customs authority. Meanwhile, the procedure must be available at least in respect of pirated copyright and counterfeit trademark goods. A reason to limit the application of the measure to "visibly infringing" goods, is that certain customs authorities may not be equipped to properly identify goods which may infringe, e.g. a patent claim of intricate patented-goods. From this point of view, this paper investigates the Customs' roles of the U.S., EU, Japan and China against suspected patent-right-infringing goods and draws a result that it is not easy for the Customs in the countries to decide whether the goods infringe the patent right or not. Recently, according to the concluded Korea-EU FTA, the Customs is going to enact provisions including patent right in subject matters pending customs clearance. With regards to this, this paper suggests a kind of ways to reestablish the roles of the Customs after considering the relationship the Korea Trade Commission which has implemented investigation and a substantial infringement-decision against suspected patent-right-infringing goods and the conformity with the TRIPS provisions: 1) the Customs staff need to enhance their expertise for suspending clearance against suspected patent-right-infringing goods which is difficult to seemingly clearly decide; 2) it is desirable that the Customs is responsible to not substantially decide infringement but only suspend suspected patent-right-infringing goods by considering a relationship with the roles of the Korea Trade Commission and TRIPS provisions; 3) to build up the conformity of suspending clearance by the Customs, the Council which is deliberative body temporarily operated by the Customs needs to be restructured to higher body as a decision-making body permanently operated; and 4) if the right holder lodge an application in writing with the Korea Trade Commission for a substantial infringement-decision, the application must be adopted with an evidence by amending the Customs Act Enforcement Order in order that the Customs can maintain the suspension of suspected patent-right-infringing goods.

        Symmetry-bridging phase as the mechanism for the large strains in relaxor-PbTiO<sub>3</sub> single crystals

        <P><B>Abstract</B></P> <P>Relaxor-PbTiO<SUB>3</SUB> piezoelectric single crystals have been of a great interest, since the discovery of ultrahigh piezoresponse demonstrated in <001> -oriented crystals of the composition at the rhombohedral side of morphotropic phase boundary. It has been proposed that the exceptionally large piezoelectric properties should originate from an electric-field-induced polarization rotation that involves a reversible phase transformation between rhombohedral and tetragonal via monoclinic symmetry. However, this commonly accepted polarization rotation mechanism has its limit in explaining still the excellent piezoelectricity even at a small excitation field far below the coercive field. Here, we show by a comparative study using single crystals from two distinct processing techniques, the polarization rotation has, if ever, little influence on the strain properties of <001 > -oriented rhombohedral relaxor-PbTiO<SUB>3</SUB> single crystals. Instead, they may come from a reversible shear-mode piezoelectric contribution from electric-field-susceptible ‘symmetry-bridging’ unit-cell-level phases, the polarization direction of which spans monoclinic symmetry.</P>

        ‘공익법 운동’은 법률구조, 법률가의 공익활동, 소수자의 인권 보호, 민주화와 국가권력 감시를 모두 포함하는 상당히 포괄적인 개념으로 해석하게 될 수 있다. 공익법 운동은 ‘법’과 관련된 운동을 의미하지만, 반드시‘법률가’ 중심의 운동을 의미하지는 않는다. 사법접근권은 기본적 인권이고 사법접근권의 보장의 문제는 헌법상 기본권 보장의 문제이다. 사법접근권의 보장은 ‘어떤 내용의 권리를 누가어떠한 요건과 절차 하에서 실질적으로 행사할 수 있도록 보장되고 있는가’에 대한 객관적이고 명확한 평가와 개선을 의미한다. 사법접근권은 법적 문제로 인식되지 못한 법적 문제가 존재하는 상황에서 법적 문제로 인식되어지는 과정에서부터 그 해결에 이르기까지의 전 과정에 있어서의 권리라고 보아야 하며 그 전 과정에서 개입되는 주체, 법률서비스의 내용, 비용 등이 충분히 평가되고 고려되어야 한다. 현행 사법접근권 보장제도는 현존하는 법적 지원의 수요를 충족시키지 못하고 있으며, 접근 가능한 양질의 법률서비스를 충분히 제공하고 있지못하다. 따라서 현행 정부·사법부 주도 사법접근권 보장제도의 전면적인 개선이 요구된다. 변호사 공익활동 의무제도의 실질화, 변호사단체 인권위원회 등의 공익활동 프로그램의 안정화, 개인, 로펌 등의 공익활동을 활성화하기 위하여 다양한 프로그램이 개발되어야 한다. 무엇보다도 국가기관, 변호사단체, 시민단체 등이 법률서비스중개나 법률교육 등을 통해 상호 연결시킬 수 있는 방안을 강구하고 실천에 옮겨야 한다. 법학전문대학원 공익인권교육의 형해화의 원인으로 1) 로스쿨의 엄격한 학사관리 제도 및 변호사시험의 정원제라는 구조, 2) 전문분야로서 공익인권교육의 제도화 미비, 3) 임상법학의 위상 불명료 등을 들 수 있다. 관련 제도의 변화, 체계적인 프로그램의 제도화가 관건이고 법조인의 양성시스템에서 공익적인 가치를 주류화시키는 것이 중요하다. 전업적 공익변호사(단체)들은 주로 개인들의 풀뿌리 모금을 중심으로 비영리로 운영되고 있거나 기존 비영리 공익단체의 상근자로 활동한다. 제안되고 있는 ``법무법인(공익)`` 제도는 신생 공익변호사단체 등이 포함될수 있도록 다양한 형태를 수용하는 형식을 취할 필요가 있고, 정부나 대법원의 지원이 가능한 ``법률구조단체``의 요건을 완화할 필요가 있다. 공익변호사에 관한 정보제공 및 멘토링을 시스템화할 필요가 있고 재정적인 취약성을 극복할 수 있는 제도적인 대책들이 입안되고 실행되어야 한다. ‘The public interest law movement’ can be interpreted as a fairly comprehensive term that encompasses legal aid, lawyers` pro bono, human rights protection of the marginalized, democratization and monitoring of the power of the state. The public interest law movement is ‘law-related’ but it is not necessarily ‘lawyer-centered’. Access to justice is a fundamental human right and the issue of guaranteeing access to justice is the issue of guaranteeing Constitutional Basic Rights. Securing access to justice means an objective and clear review and improvement of ‘which contents of rights are ensured to be practiced substantially by whom and under which requirement and through which process.’ It should be noted that access to justice is a right in the whole process from identifying a legal problem where the problem was not perceived as a legal problem to the solution of it. In this whole process, involved actors, contents of legal services and their costs, etc. should be fully evaluated and considered. The present access to justice system does not meet the existing demand for legal assistance. In addition, it dose not provide enough accessible high-quality legal services. There is a need for sweeping reforms in the present government or court-led access to justice system. Various institutions and practices must be improved in order to make the lawyers` mandatory pro bono hours functional, stabilize public interest law programs of bar associations, and to promote pro bono activities of individuals and law firms. Above all, the way to interconnect governmental bodies, bar associations and the civil society through the mediation of legal services and legal training should be pursues and put into practice. The causes of the disfunctional public interest and human rights law education in law schools are: 1) the strict coursework management in law schools and the structure of a quota system in bar exams; 2) the lack of institutionalization of public interest and human rights law education as a field of specialization; 3) the ambiguous status of clinical legal education, etc. It is essential to have changes in relevant institutions and the institutionalization of systematic programs. It is important to mainstream public interest values into the training system of legal professionals. Full-time public interest lawyers(or their groups) generally are run non-for-profit based on grass-root fundraising or work as staff attorneys at existing non-for-profit public interest organizations. The proposed system of ‘public interest law firms’ should embrace various forms to include newly established public interest lawyers` groups, and the requirements of ‘legal aid organizations’ which can receive support from the government or the Supreme Court should be alleviated. There is a need to systematize the provision of information and mentoring of public interest lawyers, and institutional measures to overcome financial vulnerabilities should be formulated and implemented.

        출발실시료율의 설정을 시작점으로 하는 FRAND 실시료(율) 산정방법에 관한 연구 : 미국의 합리적 실시료(율) 산정방법의 분석을 중심으로

        Standard-Essential Patent (SEP) holders make certain commitment, which requires that the holders license their SEP on Fair, Reasonable and Non-Discriminatory (FRAND) terms. In case of SEP patent infringement, thus, the issue is marked by determination of royalties for the SEP. In this regard, this article has thoroughly examined the meaning of the FRAND commitment, and has figured out that a core issue would be to calculate a reasonable royalty (rate) in taking a view of the FRAND commitment in terms of royalty. Furthermore, the FRAND royalty, especially the FRAND royalty rate calculation methodology has been derived by using the reasonable royalty calculation methodology in cases of non-SEP infringements as a link based on understanding of the meaning of the FRAND commitment. Recently, the importance of assessing a royalty base has been particularly emphasized due to application of apportionment ratio when a reasonable royalty is calculated for patent infringement damages, but it is because the main issue is generally to calculate a reasonable royalty rate. Specifically, this article asserts that it is necessary to have a specific formula or algorithm in determining the FRAND royalty rate, and emphasizes an importance on seeking a proper starting-point-royalty-rate. In this regard, this article has examined methodologies that the U.S. courts has considered when setting the starting-point-royalty-rate for calculating a reasonable royalty rate in patent infringement litigations. As a result, the U.S. courts tend to narrowly interpret the scope of a comparable license agreement, and therefore it is practically more difficult to find a sufficiently comparable royalty rate. Given that practical difficulty, this article suggests that Korea courts may find the starting-point-royalty-rate by considering either an average industry royalty rate in the comparable businesses technically relevant to the patents-in-suit or (if necessary) 25% rule of thumb, depending on the specific circumstances of the given cases. Similarly, this article asserts that Korea courts can apply the methodology to find the starting-point-royalty-rate for calculating a reasonable royalty rate for non-SEP infringement damages when calculating the FRAND royalty rate. Specifically, Korea courts may derive a comparable royalty rate by putting different weights on evidence for the comparable license agreements in the following order. 1) existence of an established FRAND royalty rate, 2) a rate received by the patentee for license to the SEPs-in-suit, 3) a rate paid by the licensee for the use of other patents comparable to the SEPs-in-suit. Where there is no any comparable license agreement, however, this article suggests that Korea courts may consider a rate in a patent pool related to the SEPs-in-suit, or top-down approach that is added by 25% rule of thumb, depending on the circumstances of the given cases. On the other hand, the importance of measuring an apportionment ratio cannot be disregarded, which is a different issue apart from the matter of royalty stacking. In the U.S., court’s practice has emphasized the requirement that a royalty base be smallest salable patent-practicing unit (SSPPU), but such practice has been subject to strong criticism by legal scholars. Thus, it is needed to conduct an additional study regarding the measurement of the apportionment ratio, and a follow-up research would be prepared for the future.

        4주간의 고관절 내전근 운동이 월경전 증후군 여대생의 고관절 내전근 근파워와 생리통증정도에 미치는 효과

        The purpose of this study is to analyze how 4-week hip adductor muscle exercise influences a degree of adductor muscle power and pain of female students with premenstrual syndrome. The study subjects were 8 female students in their 20s going to K-university in S city of Gyeongsangbuk-do, who had pain caused by premenstrual syndrome. VAS test as a study method was applied to look into a subjective pain degree. Isokinetic test was conducted to look into hip adductor muscle power. The results are summarized as follows : 1. According to the test on hip adductor muscle power, Peak torque weight 60°/sec was significantly different in the right sides(p<.05), and left sides(p<.01). Average power 60°/sec was statistically and significantly different in the right and left sides(p<.01). Total Work 60°/sec was statistically and significantly different in the right and left sides(p<.01). 2. According to VAS test, pain was significantly alleviated(p<.01). It is expected that more research on premenstrual syndrome will be conducted.
