        위험사회에서의 형사소송법의 변화에 대한 검토

        위험사회에서의 인간의 생명과 재산권을 위협하는 위험원은 계속 출현하고 있다. 이에 위험형법의 역할과 범위가 계속 확장되고 있지만, 그에 따라 선량한 국민들의 인권이 제약되고 기존의 전통적인 법치국가의 틀이 위협을 받은 상황을 초래하고 있다. 위험사회에서 인간을 위협하는 위험원들을 국가형벌권의 확장과 엄격한 법집행으로 이를 적극적으로 예방하고 다스려 안전을 도모하는 것도 중요하지만, 과도한 국가형벌권의 행사로 억울하게 인권을 침해당하는 현상이 발생하지 않도록 예방하는 것도 중요하다. 위험사회에서 위험형법의 문제점이 계속 드러나고 있는 상황에서 이를 시정하기 보다는 안전사회를 구현한다는 미명 아래 형사소송법의 적극적인 기능의 확대는 순기능 보다는 역기능이 더욱 드러나는 현상을 초래할 것이다. 위험형법의 기능이 다하지 못한다고 하여 적극적인 불심검문, 과학적 수사기법의 확장, 전자감시제도의 확대, 공소시효의 배제 및 연장, 내사의 확대, 디지털 증거에 대한 적극적인 압수수색, 유죄협상제도, 사법방해죄 제도, 중요 참고인의 출석제도, 면책조건부 증언제도의 도입하자는 주장은 수사기관을 비롯한 형사사법기관의 권한을 강조하는 제도들이다. 이와 같은 제도들은 수사기관의 권한을 강조하여 실체적 진실발견을 촉진하여 형사소송절차의 효율성을 도모할 수 있으나 기존의 형사소송제도의 탈정형화를 지향하게 되어 적지 않은 문제점을 야기할 뿐이다. 오히려 위험사회에서의 형사소송법의 기능과 역할의 확대는 피의자에 대한 인권침해의 위험성과 실체적 진실주의 이념, 적정절차의 이념을 훼손시키고, 민사사건의 형사사건화 심화의 위험성을 높이는 부작용을 초래하고 있다. 따라서 위험사회에서의 형사소송법의 운용은 그 기능을 무작정 확대하고 강조하기 보다는 인권국가에 부합하는 국가형벌권을 행사하고 사회통합을 위한 형사소송법의 정책을 수립하고 실현하는 것이 필요하다. 그리고 위험사회에서 발생하는 위험원은 형사법의 선제적인 투입보다는 법치국가의 기본원칙에 충실하는 법 운영과 적용이 우선되어야 한다. 그것이 인권국가에서 올바른 형사소송법의 올바른 운용의 모습이자, 선량한 국민들의 인권과 기본권을 보호하는 국가적 책무를 다하는 길이기 때문이다. In risk society, risk sources that threaten the live and property of people continuously appear. The role and scope of risk criminal law is continuously expanding; however, it also results in the situation, in which the human right of good people is restricted and the frame of traditional law-governed state is being threatened. In risk society, it is important to actively prevent risk sources that threaten people and secure the safety of society by expanding the state punishment right and strictly enforcing law; however, it is more important to prevent unfair infringement of human right by excessive exercise of state punishment right. In the situation, in which such problematic issues of risk criminal law continuously appear in risk society, the active function expansion of criminal procedure law under the guise of realizing safe society will result in the increase of adverse function in criminal procedure law instead of increase of positive function. There are opinions suggesting to introduce active police questioning, expansion of scientific investigative techniques, expansion of electronic watch system, statute of limitations exclusion/extension, expansion of internal investigation, active seizure and search of digital evidence, plea bargaining system, obstruction of justice offense system, key testifier attendance system and witness immunity from prosecution system; however, these systems all reinforce the authority of criminal justice agencies including investigation agencies. These systems emphasize the authority of investigative agencies, promote the finding of substantive truth and enhance the efficiency of criminal case procedure; however, they also cause many problems by departing from the standards in existing criminal procedure system. On the contrary, the expansion of criminal procedure law function and role in risk society has the infringement risk of suspect human right, damages the principle of substantive truth and the due process idea and causes the adverse effect of increasing the risk of making a civil case into a criminal case. Therefore, the application of criminal procedure law in risk society should not expand and emphasize the function of it. Instead, establishing and realizing criminal procedure law policies, which would enable the exercise of state punishment right in human right state and integrate society, is required. The risk sources occurring in risk society should be dealt by application of law faithful to the basic principle of law-governed state; instead of anticipative application of criminal procedure law. This is the right application of criminal procedure law in a human right state and this is the way to fulfill the duty of state, which is protecting the human right and basic right of good people.

      • 장기복무 제대군인의 재취업위기와 전직지원프로그램

        본 연구의 목적은 장기복무 후 전역한 제대군인의 악화된 재취업 환경을 분석하고 그에 따른 대응방안으로서의 전직지원프로그램에 대한 개선안을 도출하는데 있다. 분 석결과 현재 우리 군에서 운용 중인 장기복무 제대군인을 위한 전직지원프로그램이 기능적인 측면에서 매우 제한적일 뿐만 아니라 실효성 측면에서도 기대에 미치지 못 함을 확인하였다. 따라서 오늘날과 같이 고용 없는 성장과 고실업의 사회경제적 환경 에서 일자리가 부족으로 인해 직면하게 될 재취업희망 제대군인들의 취업위기에 효 율적으로 대응할 수 없다. 개선안으로 우선 전직지원프로그램에서 심리적 지원을 강 화할 필요가 있다. 지속적으로 심리적 안정과 치유를 위한 카운슬링 서비스를 전역대 상자 확정 시점부터 재취업 이후까지 단계별로 구축하여 제공하는 것이 필요하다. 전 역준비기간이 너무 짧고 재직기간동안 자신의 능력을 개발할 수 있는 기회가 제한적 이다. 따라서 전역준비기간의 연장과 수요자중심의 맞춤형 직업보도교육프로그램을 발굴하고 다양한 능력개발 프로그램을 운영하여 개인에게 경력관리 기회를 확충해 주는 것이 필요하다. 군과 기업은 지속적인 소통을 통해 재취업에 대한 상호적인 요 구와 조건을 공유하여 전역 후 재취업하고자 하는 희망자들에게 양질의 일자리를 제 공할 수 있도록 새로운 일자리를 발굴하고 육성해야 한다. 정부는 법과 제도적 정비 는 물론이고 재정지원이나 세제지원을 통해 뒷받침한다. According to the analysis results our military is currently operating in support programs for long-term service veterans is very limited in terms of functional and not feasible. By improvement, psychological support to the veterans need to strengther. Ongoing psychological counseling services and the need for healing. From a global point to re-employment step is to build support. Global warm-up period is too short and limited period of self-development. Thus, global warm-up preiod should be extended and consumer-oriented reporting, custom job training program should be excavated. And on a personal level the opportunity to a career should be expanded military and corporate needs. For re-employment through ongoing communication, sharing a mutual feedback. Then comes when you want to re-employment seekers throughout their decent work should be provided. The government should support financial support and tax incentives as well as legal and institutional maintenance.

        In this paper, collapse test of thin-walled structural member widely used for automobiles is carried out under static compression load to observe the effects of cross-sectional shape and material on the absorbing-energy capacity in the viewpoint of crashworthiness. specimens tested consist of two sorts(Aluminium, CFRP) and configurations(Cylinder, Square) with variation in thickness. Also, comparisons of Al cylinder and square specimens are made th find the influence of difference in shape on the absorbing-energy capability according as the thickness of specimen varies.

      • 계지 열수추출물의 대장암세포에서의 활성산소 의존 세포사멸 유도활성

        Background : The young stem of Cinnamomum cassia (YSC) as traditional Chinese medicines has been reported to show a variety of pharmacological properties such as anti-allergy, insecticidal, antimicrobial, antiulcer, anti-inflammatory, immune-suppressive, and neuronal death prevention, tyrosinase inhibition and anticancer, antioxidant and free radical scavenging, as well as antidiabetic and aldose reductase inhibition activities. In this study, we elucidated apoptotic effect and potential molecular mechanism of hot water extracts from YSC (YSC-HW) against human colorectal cancer cells. Methods and Results : YSC-HW treatment increased ROS level and induced ROS-dependent DNA damage in human colorectal cancer cells. ROS generation mediated by YSC-HW induced DNA induced apoptosis and reduction of cell viability in human colorectal cancer cells. YSC-HW ROS-dependently induced NF-kB activation through p65 nuclear translocation via IkB-α degradation, which exerted the induction of apoptosis. In addition, YSC-HW activated ATF3 expression dependent on ROS, which resulted in apoptosis. Conclusion : Our results suggest that YSC-HW may induce apoptosis through ROS-activation of NF-kB and ATF3 in human colorectal cancer cells. From these findings, YSC-HW has potential to be a candidate for the development of chemoprevention or therapeutic agents for human colorectal cancer.

        A Cross-Joint Vivaldi Antenna Pair for Dual-Pol and Broadband Testing Capabilities

        The non-standalone 5G antenna wireless communication standard and devices operating under Wi-Fi 5, 6, and 6E operate at the 3 ㎓ frequency bands and above. With the increasing demand for these devices and technologies, it is crucial to test them rapidly and economically for commercial usage. This paper presents a dual-polarized Vivaldi antenna for the over-the-air (OTA) measurement of wireless communication devices used in the 3–7 ㎓ band. The dual-polarization performance is realized by vertically intersecting two planar Vivaldi antennas and soldering them at the back end. A three-step 1/4 wavelength balun is applied to the input for the wideband impedance matching of the antenna, which is attached to a Teflon holder for easy mounting. It has excellent performance and is designed to be manufactured at low cost. The fabricated antenna was tested in an anechoic chamber and showed S11 less than -10 ㏈ from 2.63–7.15 GH, and a realized gain of more than 5 ㏈i from 3 ㎓ and above. A measured half-power beam width of more than 60° was realized with symmetric E/H-plane. Much of the required symmetry was achieved with the designed Teflon holder. The antenna has a measured cross-polarization discrimination of better than 15 ㏈ across the entire operating bandwidth.

        Naringenin-Mediated ATF3 Expression Contributes to Apoptosis in Human Colon Cancer

        Naringenin (NAR) as one of the flavonoids observed in grapefruit has been reported to exhibit an anti-cancer activity. Activating transcription factor 3 (ATF3) is associated with apoptosis in human colon cancer cells. This study was performed to investigate the molecular mechanism by which NAR stimulates ATF3 expression and apoptosis in human colon cancer cells. NAR reduced the cell viability and induced an apoptosis in human colon cancer cells. ATF3 overexpression increased NAR-mediated cleaved PARP, while ATF3 knockdown attenuated the cleavage of PARP by NAR. NAR increased ATF3 expression in both protein and mRNA level, and increased the luciferase activity of ATF3 promoter in a dose-dependent manner. The responsible region for ATF3 transcriptional activation by NAR is located between -317 and -148 of ATF3 promoter. p38 inhibition blocked NAR-mediated ATF3 expression, its promoter activation and apoptosis. The results suggest that NAR induces apoptosis through p38-dependent ATF3 activation in human colon cancer cells.

        Anti-Proliferative Effect of Naringenin through p38-Dependent Downregulation of Cyclin D1 in Human Colorectal Cancer Cells

        Naringenin (NAR) as one of the fl avonoids observed in grapefruit has been reported to exhibit an anti-cancer activity. However, more detailed mechanism by which NAR exerts anti-cancer properties still remains unanswered. Thus, in this study, we have shown that NAR down-regulates the level of cyclin D1 in human colorectal cancer cell lines, HCT116 and SW480. NAR inhibited the cell proliferation in HCT116 and SW480 cells and decreased the level of cyclin D1 protein. Inhibition of proteasomal degradation by MG132 blocked NAR-mediated cyclin D1 downregulation and the half-life of cyclin D1 was decreased in the cells treated with NAR. In addition, NAR increased the phosphorylation of cyclin D1 at threonine-286 and a point mutation of threonine-286 to alanine blocked cyclin D1 downregulation by NAR. p38 inactivation attenuated cyclin D1 downregulation by NAR. From these results, we suggest that NAR-mediated cyclin D1 downregulation may result from proteasomal degradation through p38 activation. The current study provides new mechanistic link between NAR, cyclin D1 downregulation and cell growth in human colorectal cancer cells.

        Kahweol from Coffee Induces Apoptosis by Upregulating Activating Transcription Factor 3 in Human Colorectal Cancer Cells

        Kahweol as a coffee-specific diterpene has been reported to induce apoptosis in human cancer cells. Although some molecular targets for kahweol-mediated apoptosis have been elucidated, the further mechanism for apoptotic effect of kahweol is not known. Activating transcription factor 3 (ATF3) has been reported to be associated with apoptosis in colorectal cancer. The present study was performed to investigate the molecular mechanism by which kahweol stimulates ATF3 expression and apoptosis in human colorectal cancer cells. Kahweol increased apoptosis in human colorectal cancer cells. It also increased ATF3 expression through the transcriptional activity. The responsible cis-element for ATF3 transcriptional activation by kahweol was CREB located between -147 to -85 of ATF3 promoter. ATF3 overexpression increased kahweol-mediated cleaved PARP, while ATF3 knockdown attenuated the cleavage of PARP by kahweol. Inhibition of ERK1/2 and GSK3β blocked kahweol-mediated ATF3 expression. The results suggest that kahweol induces apoptosis through ATF3-mediated pathway in human colorectal cancer cells.
