        구릉지 활용을 위한 테라스하우스 적용방법 분석과 계획방향

        This research starts from the questioning of current housing development situation on hilly sites in Korea. It aims to investigate various design techniques of terraced housing as an alternative housing type on sloped sites. Several generic solutions are proposed, as for site slope and stacking method, combination of dwelling units, access pattern, and sectional variation of unit space. By the comparative analysis of design proposals with the typical two-row vertical-access type, the efficiency of the proposed techniques are verified in terms of development density, provision of community space, habitability of dwelling units.

        도시 주거지의 부지여건별 개발방법과 주택형식 제안 - 광주광역시 사례 연구 -

        The purpose of this study is to propose a new development method for urban residential area, considering the urban site and development conditions rather than just meeting the development limit and regulations. Gwangju Metropolitan city is investigated as a case city and the new method verifies a decision process of pertinent development types and housing forms in urban blocks. The consequences of this study are summarized as follows. The process of a new development method consists of four steps; First, current conditions of the residential area of Gwangju are analysed in order to find out the site characteristics and housing development situations. And the theoretical research is made to set up the development goals and objectives, regarding current trends and future paradigms of residential development. Next, the suitable development sites are selected, and their site characteristics and relevant development types for the future are compared and matched with a close analysis. Finally some pertinent housing forms for each development site are suggested, which fit well in terms of urban context and are appropriate for building up sustainable city in the future.

        역세권 제2종 일반주거지역 상업화 확산과 특성 분석

        The purpose of this study is to find out the commercialization characteristics of 2nd class residential district in innercity railway station area as basic research to protect urban residential area against the pressure of commercialization. Through the research that are based on literature, field survey and urban planning map, it analysed the commercialization characteristic of selected three sites under similar urban condition; to be a nearby subway station and to be a famous commercial street in site, etc. The consequences of this study are summarized as follows; First it finds the commercialized lots in all blocks that adjoin blocks of upper class zoning. Second it is in inverse proportion between the commercialization of lots and the distance from subway station to residential block. Third, the corner lot of a block and the access road directly connected collector road are very important factors to spread commercialization to residential area. Finally, it finds the difference of the commercialization degree of 2nd class residential zone according to arrange main commercial street and the 2nd class residential block; vertical arrangement and horizontal arrangement.

        징벌적 손해배상에 관한 미국의 최근 동향

          Punitive damages, in USA torts system, are awarded only for very serious misconduct coupled with a bad state of mind involving malice or at least a reckless disregard for rights of others. The stated purposes of punitive damages almost always include (a) punishment or retribution and (b) deterrence. Sometimes the purpose encompasses (c) the desire to assist in financing useful litigation by providing a source from fees and costs can paid. The purposes are somewhat conflicting in that they do not necessarily call for the same amount of punitive damages.<BR>  It is said in USA that punitive damages are a controversial aspect of tort litigation and have been the subject of numerous theoretical, empirical, and experimental studies. Critics in USA have argued that the uncertainty and unpredictability that punitive damages claims injects into a case may increase the rate and amount of settlements and carry systemic consequences for the general processing of tort claims. An important one of those studies is a theory that answer two questions: (1) What place, if any, do punitive damages have in the civil law of tort, given that they appear to involve an idea of criminal punishment? (2) Why are punitive damages subject to special constitutional scrutiny, as in the Supreme Court’s decision in BMW v. Gore, if they really are part of the civil law of tort?<BR>  Generally they say that punitive damages are not per se unconstitutional under the double jeopardy, excessive fines, or due process provisions of United State Constitution. However, extreme awards, given without appropriate guidance to the jury and without adequate review by judges, may violate due process. the Supreme Court’s decision in BMW v. Gore gave us three guideposts to review excessive awards: (1) the degree of reprehensibility of defendant’s conduct (2) the ratio between the plaintiff ’s compensatory damage and the amount of the punitive damage (3) the difference between the punitive damage and the civil or criminal sanctions authorized or imposed in comparable cases.<BR>  Many states in USA now also limit the recovery of the amount of punitive damages as part of efforts to stem civil litigiousness, reduce perceived damage award inequities, and halt escalating insurance costs. These measures usually take the form of restrictions on the types of cases in which punitive damages may be sought, limitations on the amount of punitive damages that can be awarded, special procedural requirements that must be followed in cases in which punitive damages are sought, and mechanism for review of punitive damages awards.<BR>  This paper presents the recent cases on punitive damages and state statutes authorizing or restricting the award of punitive damages in USA, as well as describes briefly statutes setting out requirements for seeking punitive damages in civil matters.

        점유자의 과실취득권과 부당이득

        In Korea gab es langanhaltende Diskussion über die rechtliche Beziehung zwischen das Fruchtziehungsrecht des Besitzers im Sinne von § 201 des koreanischen BGB (KBGB) und die ungerechtfertigte Bereicherung im Sinne der §§ 741 ff. des koreanischen BGB (KBGB). Der Eigentümer kann die Herausgabe vom jeweiligen Besitzer mit keiner rechtlichen Begründugsmacht seiner Sache verlangen. Bei diesem Fall ist der Herausgabeanspruch der Sache auf dem Herausgabeanspruch vom Eigentum berechtigt, jedoch beim Fall, in dem der Herausgabeanspruch auf das Schuldverhältnis berechtigt und dazu dieses Schuldverhältnis von Anfang an nichtig oder anfechtbar ist, ist der Herausgabeanspruch der Sache auf dem Herausgabeanspruch von ungerechtfertigten Bereicherung berechtigt. Im oben genannten ersten Fall gilt § 201 KBGB. Allerdings, im oben genannte zweiten Fall, sogenannte bei Fälle der Nichtigkeit oder Anfechtbarkeit des Kaufvertrags steht dazwischen die Konkurrenz der Herausgabeansprüche vom Eigentum und ungerechtfertigten Bereicherung. Formelle angesehen, gibt es zwischen der Vorschriften von § 201 KBGB und § 741 BGB die Schwierigkeit aufgrund der Konkurrenz, den genauen Anwendungsbereich festzustellen. Im Bezug auf Theorien über Gegensitigenbeziehungen vom Herausgabe der Früchte und Nutzungsinteresse gab es bislang auch viele Diskussionen. Diesbezüglich hat die koreanische Rechtsprechug eine konsitente Stellung. Jedoch stehten noch unklare Punkte und verschiedene Stellungen zur Analyse dieser koreanischen Rechtsprechungen. In der vorliegenden Arbeit wurde wieder die rechtlichen Beziehungen bezüglich der Herausgabe von Früchten und Nutzungsinteressen neu geforscht. Der Kurzüberblick ist wie folgt gegliedert: I.         소셜 네트워크 서비스 환경에서 개인정보보호를 위한 OpenAPI기반 보안 프레임워크

        모바일 디바이스의 진화와 무선 네트워크의 발전으로 스마트폰 기반 모바일 소셜 네트워크 서비스의 사용자가 증가하고 있다. 또한 실시간 의사소통과 정보공유에 따른 개인정보 유출이 심각한 사회적 문제로 대두되고 있다. 이에 본 연구에서는 먼저 OpenAPI를 이용하여 소셜 네트워크 서비스 플랫폼에 연동 가능한 프레임워크를 설계하고, 개인정보보호 강화를 위해 구현된 프레임워크에 인증과 탐지 메커니즘을 제안하였다. 인증 방식으로는 아이디와 패스워드를 사용하고 탐지 방법은 사용자가 지정한 입력패턴을 분석하여 개인정보보호 가이드라인에 해당하는지 사전에 미리 검증함으로써 소셜 네트워크 서비스 환경에서의 개인정보보안을 강화하였다. 마지막으로 성능 평가를 수행하여 본 연구의 효율성 및 타당성을 입증하였다. With the rapid evolution of mobile devices and the development of wireless networks, users of mobile social network service on smartphone have been increasing. Also the security of personal information as a result of real-time communication and information-sharing are becoming a serious social issue. In this paper, a framework that can be linked with a social network services platform is designed using OpenAPI. In addition, we propose an authentication and detection mechanism to enhance the level of personal information security. The authentication scheme is based on an user ID and password, while the detection scheme analyzes user-designated input patterns to verify in advance whether personal information protection guidelines are met, enhancing the level of personal information security in a social network service environment. The effectiveness and validity of this study were confirmed through performance evaluations at the end.

        생활방해와 소유권의 침해

        이 논문은 임미시온에 의한 방해를 규정한 한국 민법 제214조와 소유권에 기한 방해 제거 및 예방청구권을 규정한 한국 민법 제217조와의 관계를 검토한다. 한국의 확립된 판례에 의하면 "토지위에 건축 중인 건물이 이웃 토지의 사용에 방해를 야기하고, 그 방해가 사회통념상 수인할 정도를 넘어선다고 인정되는 한, 그것이 민법 제217조에 정한 불가량물(Imponderabilien)에 해당하는지의 여부를 떠나 민법 제 214조에 가하여 방해제거 및 예방청구권을 행사할 수 있다”고 한다. 이 판례에 의하면 민법 제217조의 요건을 충족한다고 하더라도 따로 민법 제214조의 요건을 충족한다면 민법 제214조에 의한 책임이 발생한다는 의미가 된다. 그러니까 민법 제214조의 요건을 충족하는가의 여부를 먼저 검토하여 민법 제214조에 의한 책임이 발생한다면 민법 제217조의 요건의 충족여부는 따질 필요도 없다는 뜻이 된다. 필자는 한국 민법 제217조의 규범목적과 적용대상은 한국 민법 제214의 그것들과는 다르기 때문에, 어떤 토지에 대한 방해가 민법 제217조의 적용대상인지 아니면 민법 제214조의 적용대상인지는 구별해야 한다고 생각한다. 나의 주장을 논증하기 위하여 한국 민법 제217조와 한국민법 제214조의 관계를 독일 민법 제906조와 제1004조와의 관계와 비교 검토하였다. 이 논문의 구성은 다음과 같다. 1. 서언 2. 한국 민법 제217조의 비교법적 검토 1) 독일 민법 제906조의 해석론 2) 한국 민법 제217조의 해석론 3. 결언
