본 논문은 정부의 산하기관이나 공공기관의 자회사 등의 설립에 관한 기준과 원칙이 미흡하여 공공조직을 설립과 관련된 논란과 혼란이 발생하고 있음에 주목하고, 정부간 거래를 위한 전담조직을 대상으로 적정 설립형태를 모색하고자 하였다. 이를 위해 정부간 거래의 목적과 취지 및 특성 등을 고려하여 설립목적 적합성, 출자·출연의 적정성, 영리성, 기능적 연계성 등을 적정성 분석기준으로 설정하였다. 또 정부와 지방자치단체가 채택할 수 있는 조직형태로 사단법인, 재단법인, 주식회사, 협동조합 및 지방공사 등을 선정하고, 적정성 분석기준을 적용하여 전담조직의 적정성을 분석하였다. 분석결과, 주식회사와 지방공사가 가장 적합한 조직형태로 나타났으며, 재단법인은 그 다음으로 적합하였으며, 사단법인이나 협동조합은 적합하지 않은 것으로 분석되었다. 하지만 이러한 결론이 항상 타당한 것은 아니며, 정부간 거래의 대상이 되는 공공서비스의 내용과 특성에 따라서 달라질 수 있다. 특히, 본 연구에서는 정부간 거래에 관한 경험이나 실적 및 사업여건 등이 미흡한 실정에서 가시적인 사업성과를 얻기까지는 많은 사업화 과정과 시간이 소요될 수 있다는 점에서 처음부터 새로운 조직을 설립하는 것보다는 어느 정도의 사업기반을 마련할 때까지는 기존의 조직을 활용하는 것이 바람직하다는 점을 지적하였다. This paper focus on the fact that there are controversies and confusions related to the establishment of public organizations due to lack of standards and principles on the establishment of a government-affiliated organization or government subordinate organization, and then we tried to find a proper organizational form by targeting the organization in charge of intergovernmental trade. For this, considering the purposes and characteristics of intergovernmental transactions, we set the criteria such as the appropriateness of the establishment purpose, the appropriateness of investment and contribution, the profitability, and the functional linkage. Also, we selected the corporation, foundation, incorporated, cooperatives, and the local public corporation as the organizational forms that can be chosen by the government and municipal governments. The results show incorporated and local public corporations are the most suitable organizational forms, and the foundation was the next best, and the corporation or cooperatives were not appropriate at all. However, these conclusions are not always valid and can vary depending on the contents and characteristics of public services that are subject to intergovernmental transactions. In particular, we emphasized that it would be desirable to utilize the existing organizations until the business conditions are established rather than to create a new organization from the beginning. Because it may take a lot of commercialization process and time to get visible business performance and results from the experience of inter-governmental transactions.

공공서비스의 정부간 거래 활성화 방안: 서울시의 우수정책 해외진출 사례를 중심으로

이 논문은 최근 들어 공공서비스의 정부간 거래가 부각되고 있음에 주목하고, 정부간 거래의 문제점과 개선방안을 모색하고자 하였다. 기존의 해외개발방식과 달리 최근 주목받고 있는 해외개발방식의 특징은 특정 사업 분야에 대한 직접적이고 물리적인 재화와 서비스뿐만 아니라 공공서비스의 관리와 운영을 위한 노하우까지 함께 제공하는 패키지 방식이 선호된다는 것이다. 일명 `공공서비스의 정부간 거래`로 불리는 새로운 해외개발방식은 기존의 공적개발원조(ODA)나 기업-정부 거래(B2G)와는 다른 새로운 형식이다. 이러한 변화는 기존의 개발 방식과는 다른 법률, 제도 및 운영방법에 대한 논의를 요구한다. 이런 점에서 본 논문에서는 서울시의 공공서비스 해외진출 사례를 바탕으로 공공서비스의 정부간 거래의 문제점을 도출하고, 이를 보완하기 위한 개선방안을 제시하였다. This paper focuses on the government to government(G2G) or inter-governmental transaction of public services, and looks for problems and improvements of it. One of the overseas development methods that have been attracting attention recently, unlike existing methods, is a package method that provides not only direct and physical goods and services for specific fields but also know-hows for management and operation of the public services. The so-called `G2G transaction of public services` is a new form of overseas development methods that differs from existing public development assistance(ODA) and corporate government transactions(B2G). Therefore, it is necessary to discuss on the laws, institutions and operating methods of G2G that are different from existing development methods. In this respect, we are to seek a revitalizing measures of the G2G transaction of public services on the basis of Seoul`s overseas expansion policy of public services through G2G transaction and public-private partnership.
