        스마트 기기를 활용한 공동주택 하자 관리의 효율화 방안

        현재 국내에서는 매년 약 40만 세대의 공동주택이 신축되고 있다. 건설업체는 높은 품질의 다양화된 주거 공간을 공급하고 있으며, 입주자들도 고품질의 하자 없는 공동 주택을 원하고 있다. 건설업체는 입주자 요구 사항의 만족과 업체의 브랜드화를 위해 시공단계에서 부터 완공 후 하자 보수 단계 까지 품질 향상을 위한 노력을 기울이고 있다. 그러나 건설 공사의 특성상 여러 공종의 복합적인 결합으로 인해 하자는 불가피하게 발생되고 있으며, 하자의 책임 여부에 있어서 건설업체와 입주자와의 갈등은 법적 분쟁으로까지 이어지고 있어 하자에 대한 체계적인 분석과 계획 수립이 요구되고 있다. 따라서 본 연구에서는 최근 보급률이 높은 스마트 기기의 기능을 이용하여 공동주택 하자를 효과적으로 관리할 수 있는 방안을 제시하고자 한다. 즉, 스마트 기기를 도입한 하자 관리 프로세스를 제안하여 하자 접수와 처리 및 완료 단계에서 하자 처리 관련 시간을 단축하고, 각 하자 관련 주체간의 의사소통을 원활하고 신속하게 수행할 수 있도록 하고자 한다. 또한, 각 하자처리 단계마다 하자에 대한 정보를 체계적으로 데이터베이스화하여 하자관련 분쟁 시 근거 자료 확보에 도움이 되도록 하고자 한다. Recently, apartment housing tends to increase 3-4% every year by economic growth and development of construction technology in domestic construction industry. According to this tendency, construction enterprises are providing high-quality and various residential space, and residents also want high-quality apartment housing without any defect. Construction company make efforts to decrease construction defects in order to satisfy all the residents, and to improve company value. However, it is impossible to have no defect in construction because construction works are combination of many different complicated process. Because of the responsibility for the defect, conflicts between construction company and residents have been occurred. This study suggests defects management method that can be used from defect register phase to defect repair phase with a function of smart-device of the high penetration rate. The effectiveness use of the suggested method might save defects maintenance time and improve resident satisfaction about construction quality.

        The Inter-Korea Arbitration Committee(the Arbitration Committee) should aim to regulate the application of legal standards which are developing in an increasingly commercial disputes in Korea area. The Arbitration Committee is characterized by the gradual recognition of general standards in relation to inter-Korea commercial arbitration procedure. The Arbitration Committee has progressively become an autonomous discipline of the law applicable to the arbitration agreement, which regulates the obligation of the parties to settle inter-trade disputes by their local committee. The commercial arbitration system contributes usefully to the security and expansion of inter-trade. The Arbitration Committee enables the parties to an arbitration to design their arbitral proceedings to suit their particular needs. With regard to the law governing arbitral procedure, this principle grants the parties the power to select suitable procedural rules. The arbitration rules should be applied by arbitrators for its users' application in inter-Korea commercial arbitration. For the local arbitration committee and its users, the arbitration procedure must not only be good but it should also be known or at least easily ascertainable. When parties are trying to agree on a suitable local committee, their counsel yearn for ready access to the local law. If that information is not easily available, it may well be a reason for preferring their local committee. The above considerations suggest certain major conditions that an acceptable practice for inter-Korea commercial arbitration should meet. It should be good quality with solutions that are sound and suitable to the specific needs of inter-Korea arbitration system.

        국제물품매매통일법상 목적물의 적합성결여에 대한 담보책임범위에 관한 고찰

        Liability of the Seller The seller is liable in accordance with the contract and International Sales Law for any lack of conformity which exists at the time when the risk passes to the buyer, even though the lack of conformity becomes apparent only after that time. The seller's duties are determined primarily from the terms of the contract. Furthermore, that the seller must deliver and transfer the goods according to the pertinent documents. The transfer is governed by the domestic law chosen by conflict-of-law rules. Although the obligations of the seller and remedies for the breach of contract, it should be noted that some of the obligations is upon the buyer to examine the goods or cause them to be examined within as short a period as is practicable in the circumstances. No such duty exists under the sale of goods legislation. The seller must deliver the goods, hand over any documents relating to them and transfer the property in the goods, as required by the contract and International Sales Law. Lack of Conformity Buyer may choose to take the defective goods and claim compensation for the defects. The International Sales Law spells out in considerable detail seller's obligations as to conformity of the goods. The goods must not only be “of the quantity, quality and description required by the contract,” but also “fit for the purposes for which goods of the same description would ordinarily be used”. If buyer is correct in concluding that they are not of the required quality, seller has failed to meet this obligation as to conformity. Because liability is strict liability, it makes no difference, even as to conformity, that seller's failure was not his fault. Buyer can at least hold seller liable for damages or reduce the price because of the lack of conformity. Conclusion The conclusion that seller has failed to meet his obligations is, however, subject to a number of exceptions. If, for example, buyer examined the goods before making the contract and then not have been aware of the lack of conformity, seller is not liable for that lack of conformity. Furthermore, if seller has included in the contract a provision effectively disclaiming liability for the lack of conformity, seller is not liable for the lack of conformity. The buyer may claim damages in circumstances specifically set out and, in addition, exercise other specific rights. In this regard, International Sales Law is more pragmatic than the domestic legislation.

        건설중재에 있어서 선택적중재합의의 유효성에 관한 연구

        Arbitration is a creature of contract. The parties agree that selective dispute resolution clause provides them with a choice to litigate or arbitrate certain disputes. Under the agreements, the parties had the option in the action. In the event any dispute arises between the parties concerning our representation or payment of our fees and disbursements which cannot be promptly resolved to our mutual satisfaction, you agree that dispute will be submitted to arbitration. Arbitration is a matter of contract and a party cannot be required to submit to arbitration any dispute which he has not agreed so to submit. The selective arbitration agreement has become an accepted method of dispute resolution. However, the trend of dispute settlement has changed. The selective arbitrations clauses are to be construed as broadly as possible, and arbitration will be compelled unless it may be said with positive assurance that arbitration clause is not susceptible of an interpretation that covers the asserted dispute.

        난치성 복수를 동반한 간경변증 환자의 혈장 Aldosterone 치

        N/A Objectives: Hyperaldosteronism is the most important factor in sustaining salt and water retention in patients with cirrhosis and aldosterone antagonists or loop natriuretic agents are used for the treatment of ascites. But some patients do not respond to the dietary diuretic regime and the cause or mechanism of refractory ascites complex. To evaluate the difference in response after treatment of ascites and the importance of plasma aldosterone level in refractory ascites, pretreatment plasma aldosterone concentration and the degree of cirrhosis by Child-Pugh classification were investigated among cirrhotic patients. Methods: Plasma renin activity (PRA), plasma aldosterone concentration (PAC) and 24 hour urinary Na+ excretion (Una+V) were tested in 16 normal control (group I), 16 cirrhotic patients without ascites (group II), 29 cirrhotic patients with ascites who responded to aldosterone antagonist (group III) and 12 cirrhotic patients with refractory ascites (group IV). Results: The amount of Una+ in group IV (19.1±13.0 mmol/day) was much lower than that of group I (81.8±42.2mmol/day), group II (75.1±12.5mmol/day), and group III (74.9±47.8 mmol/day) (p<0.01). PRA and PAC in group III (10.8±4.1ng/ml/hr, 359.8±196.8pg/ml) and group IV (12.5±8.7ng/ml/hr, 585.9±323.7pg/ml) were significantly elevated as compared to group I (1.5±0.8ng/ml/hr, 127.0±69.1pg/ml) (p<0.01 and p<0.05, respectively) and group II (4.3±2.1ng/ml/hr, 198.8±50.8pg/ml) (p<0.01 and p<0.05, respectively). But no remarkable differences were noted between group III and group IV in PRA and PAC. No negative correlations were noted between Una+V and PRA, or between Una+V and PAC in cirrhotic patients. According to Child-Pugh classification, the majority of the group IV were in C. Conclusion: Hyperaldosteronism itself is not the main cause of low sodium excretion in cirrhosis with refractory ascites. Some other factors related to the advanced cirrhosis may play a major role in the mechanism of diuretics resistance in refractory ascites.
