        DMZ세계평화공원 추진 및 운영에 대한 법적지원방안

        May 2013, Park Geun-hye of the president of the U.S. senate in a speech to dmz the World Peace Initiative after a public offering, the DMZ is a new park the two Koreas.(- building trust process) the confidence-building process of public opinion as to be New Year’s Day of the spotlight.The proposed DMZ World Peace Park at the time is fundamentally different from the previous plan in that it not only covers the southern part of the Demilitarized Zone but also the northern part of the DMZ, but also opens up the main body of the park’s creation and operation to the international community, including the two Koreas, the United Nations, the United States and China. The purpose of this study is to illuminate the Demilitarized Zone from a legal and institutional point of view and explore domestic legal support measures for the future creation and operation of the World Peace Park. Prior to the full-fledged analysis of the system, a brief look at the concept of the Demilitarized Zone and the normality of the Armistice Agreement, which is the basis for its direct installation, in order to understand the legal reality of the Demilitarized Zone. The constitutional and unification legal significance of the World Peace Park project to be created in the Demilitarized Zone based on the problems of legal reality found herein and the legal basis of the current law are considered (II respectively. Next, in the analysis of the current system, the normative system currently applied in the Demilitarized Zone will be divided into international and domestic law aspects, and among these, regulations that serve as obstacles to the relationship with the World Peace Park project will be reviewed (III). This study mainly aims to check domestic legal elements, but to the extent deemed essential, such as the Armistice Agreement, the international legal problems will also be pointed out and solutions reviewed together.

        모듈라 신경망을 이용한 자동차 번호판 문자인식

        Recently, the modular learning are very popular and receive much attention for pattern classification. The modular learning method based on the "divide and conquer" strategy can not only solve the complex problems, but also reach a better result than a single classifier′s on the learning quality and speed. In the neural network area, some researches that take the modular learning approach also have been made to improve classification performance. In this paper, we propose a simple modular neural network for characters recognition of vehicle number plate and evaluate its performance on the clustering methods of feature vectors used in constructing subnetworks. We implement two clustering method, one is grouping similar feature vectors by K-means clustering algorithm, the other grouping unsimilar feature vectors by our proposed algorithm. The experiment result shows that our algorithm achieves much better performance.

        공법분야 투고논문 : "시체해부 및 보존에 관한 법률"에 대한 소고

        This paper searches the content of the ‘Act on Dissection and Preservation of Corpses’, and points out problems of the Act. The purpose of this Act is to prescribe matters concerning dissection and preservation of corpses(including a dead fetus at least four months old) in order to improve national health and contribute to medical education and researches(including dentistry and oriental medicine) by appropriately investigating the cause of death and conducting pathological or anatomical research. When any person intends to dissect a corpse, he shall obtain the consent of the bereaved family. But, this shall not apply to any of the following. ① when a will referred to the Civil Act exists concerning dissection of the corpse, ② when there is no claimant to take over the corpse even after 60 days elapse from the confirmation of death. But, that inmates in social welfare facilities shall be excluded, ③ where a patient who has been examined and treated by at least two medical doctors dies, when all doctors who have engaged in the examination and treatment of the patient deem an autopsy specifically necessary in order to investigate the cause of death, and also the objective of the autopsy cannot be attained if the confirmation of consent by the bereaved family has to be waited, because the whereabouts of the bereaved family are unknown. But, this Act has many problems. In order to supplement such insufficiencies of the Act, it is necessary to revise the ‘Act on Dissection and Preservation of Corpses’ as soon as possible. Futhermore, it is recommended to establish a new Act supporting the body donation movement and management for activation of anatomical dissection education, which eventually extend the basis of the development of medical science.

        징벌적 손해배상에 관한 비교법적 검토

        오늘날 환경침해에 대하여 사후피해에 대한 구제방법의 구비와 더불어 사전예방적인 대비책의 중요성이 높다. 즉, 환경보호의 관점에서 이미 발생한 환경침해는 완전한 회복이 불가능하기 때문에 오히려 사전적으로 예방을 하여 침해가 발생하지 않도록 해야 한다. 이러한 환경침해에 대한 사전예방적 방법으로 징벌적 손해배상 제도의 도입논의가 다시 활발해지고 있다. 징벌적 손해배상이란 가해자가 악의적으로 불법행위를 함으로써 피해자에게 손해를 입혔을 경우, 피해자가 입은 실손해 이외에 추가적으로 징벌적 의미를 추가하여 배상하는 제도를 말한다. 물론 이런 징벌적 배상제도를 우리나라에 바로 도입할 수 있는가에 대하여는 대륙법계와 영미법계의 차이에서 오는 문제점으로 인하여 신중을 기해야 한다는 주장도 다수 존재한다. 그러나 연혁적으로 징벌적 배상제도의 전통적인 형태인 배수적 배상개념은 우리나라를 포함한 다수의 국가에서 고대부터 존재해왔던 것으로, 이미 징벌적 배상제도는 많은 국가에서 새로운 유형의 불법행위를 효과적으로 막을 수 있는 제도로 그 기능을 충분히 검증받고 있다. 특히, 징벌적 배상제도가 가지는 처벌과 예방 및 억제의 기능, 사회적 배상기능, 고의적이고 악의적인 불법행위를 억지하는 사회개혁적인 역할 및 통제기능 등은 환경분쟁에서의 갈등양상이나 침해의 특수성에 비추어 볼 때 충분히 활용될 것으로 판단된다. 본 연구에서는 환경분쟁에 있어 징벌적 손해배상을 도입할 것인가와 관련하여 도입가능성과 도입방안 등의 연구보다는, 징벌적 손해배상제도의 올바른 이해를 위하여 그 의의와 연혁 등을 비교법적으로 고찰하여 추후의 연구에 밑바탕을 제공하고자 하였다. Compensation system in Korea is that is object to complementary compensation system that is supplementing. And civil law article 750 is handling equally to deliberation or negligence. Under the current law, it is hard to believe that it will prevent the recurrence of resemblant crimes. Serious cases are happening due to ineffective compensation system for these accidents. They are either the compensation is not enough as compare to the loss ot it can not fully recover from the compensation. Therefore, it must be reinforced stringent controls especially when the attacker knew the faulty. Punitive damages punishes the injurer who commit malicious torts and prevents recurrence of crime by others. This concept appeared at first in the British Jurisdiction which is developed from Punitive damages in Anglo-American law. Currently it is being applied most vigorously in U.S.A. However, there is no other place that this is accepted in the continent legal system countries. Multiple compensation system that is resemblant to Punitive damages existed in ancient times in many countries including Korea in history. Funtion of Punitive damages can devide into natural side and metrical side. Natural sides consist of five functions. They are punishment and control, satisfactory function, law observance function, social compensation function and functions of social reformation and control. On the other hand, metrical aspects consist of three roles, namely coming off profit through torts, function of supplying manuscript costs of a lawsuit and lawyer expense and reparation function of compensating about spiritual damages. Problems also exist in punitive damages compensation system. Nowadays, few issues are discussed in U.S.A. It is unconstitutionality of punitive damages compensation system. and critics insist in problem of it`s juridical aspect and of law`s nature or calculation of compensation. Besides, there is problem to control civil and criminal liability, to relate with consolation money and to calculate compensation money. As Punitive damages was introduced and developed in Anglo-American law system, we must consider harmony with the current law, metric of calculation and reasonable punitive dameges compensation amount, criminal liability, excess compensation and good public order and customs. There are two ways of induction of new laws. One is induction through law analysis and other is induction through legislation. As judical officer`s discretion is widely applied under the Anglo-American law and the continent legal system, and it is difficult to maintain legal stabilities. We must decide individual object field followed by legislative supplementation.

        공법 : 행정소송법상 집행부정지원칙에 대한 연구

        Eine der wichtigen Forschungsaufgaben des modernen Verwaltungsgesetzes ist die Frage, wie man nicht nur die Effektivitat der Verwaltung aufrecht erhalt, sondern auch das Recht und das Interesse des Volkes verteidigt. In der Zeit als der Konstitutionalismus noch nicht gefestigt war, d.h. in der Zeit des Absolutismus oder noch fruher, wurde der Streit entweder durch Gewalt oder die Macht des Starkeren entscheiden. Im Rechtsstaat jedoch ist die Endstation des Streites eine Losung durch einen juritischen prozeß. Anders ausgedruckt : Der Streit im Rechtsstaat wird uber den prozeßstreit gelost. Je demokratischer und entwickelter der Staat ist, desto besser sind jene Prozeßgesetze eingerichtet. Eine de wichtigen Ideen im Prozeßgesetz ist die schnelle Gerichtsverhandlung, die jedoch aus Zahlreichen verschiedenen Grunden gehemmt wird. Das ist ein großes Problem des modernen Staates. In einer solchen Situation sind institutionnelle Zusatzmaßnahmen notig. Eine solche ist der vorlaufige Rechtsschutz, der bis zum Ende des prozeß das Recht der Parteien schutzt. Ohne diese Maßnahmen konnte es in vielen Fallen dazu kommen, daß das verletzte Recht einer Partei nicht wiederhergestellt wird, obwohl sie den Prozeß gewonnen ist. In dieser Studie werden zunachst die Diskussionen zusammengefaßt und es wird die weitere Entwicklung vorlaufiger Rechtsschutzmaßnahmen im Verwaltungsprozeß vorgeschlagen, d.h. die Setzung eines neuen Modells vorlaufiger Rechtsschutzmaßnahmen im Verwaltungsgesetz und der Schutz des Grundrechts in Verbindung mit der Steigerung der Effektivitat der Verwaltung, die das Ziel des Verwaltungsgesetzes bildet.
