        지방자치단체의 법무역량 강화방안 연구

        Local autonomy had not been well implemented in Korea due to historical situations. However, local councils were organized in 1991 to open an era of local autonomy. Democracy means people are the owners of the country and grassroots democracy indicates local residents are the owners of their regions. From this point of view, grassroots democracy has realized greater achievements over the past 20 years whereas the rule of law as a strong support for grassroots democracy in local administration has not been fully mature. Increased awareness of their rights by local residents led to expansion of local autonomy which involves increased participation and legislation by local residents. Such expansion cannot be handled without administrative competence based on the rule of law. Administrative enforcement based on the rule of law is effective in that local residents do not reject it, and it is also consistent with and fair to all local residents. The most important thing to support local administration based on the rule of law is the competence of local officials for judicial affairs with which they can exercise local administration based on correct laws in the front line. This study was intended to evaluate local officials for their competence in judicial affairs, find out related problems and suggest improvements in order to deal with enhanced competence of local governments. Realization of administration based on the rule of law by means of enhanced competence of local governments is not a matter of complicated theoretical organizations. It requires an approach based on legal policy. Grassroots democracy called local autonomy can be secured by administration based on the rule of law and administration based on the rule of law can be secured by the judicial functions with competence.

        저작권 남용의 통제 - 변호사 윤리를 중심으로 -

        The very nature of legislation for protection by copyrights is not only to seek individual benefits of copyright holders but also to protect their creativity while enhancing public interests so that more people can take advantage of them. In order to achieve this, reasonable and balanced arrangements required between copyright holders and users. Where copyright holders unduly exercise their copyrights and their lawyers perform active intervention in legal proceedings, the court should also be active in reviewing restrictive provisions in the copyright law and judging whether copyright holders filed illegal litigations and rules punishment or criminal penalty against copyright holders and their lawyers in accordance with the lawyer act and related regulations for self-purification so that they can contribute to the original purpose of the copyright act‘to protect the rights of authors and the neighboring rights and to promote fair use of works in order to contribute to the improvement and development of the culture and related industries.’ This thesis reviewed precedent research as a means of restriction on the abandonment of copyrights and introduced practical cases based on experiences by the author with respect to software copyright infringement to analyze stand points of related judicial precedents, and review and emphasize how to restrict such abandonments in terms of lawyer’s ethics under the assumption that legal representatives of copyright holders tend to facilitate such abandonments.

        한국문제에서 유엔사의 지위와 역할

        1947년 9월 17일 미국이 한국문제를 UN총회 의제로 상정시키면서 UN에서 한국문제를 처리해 왔던 바와 같이 하나의 한국(one Korea)을 위한 한국문제 또는 통일문제를 UN과 분리하고는 생각할 수 없다. 남과 북 상호간 전개되어 온 모든 관계는 바로 한국문제와 관련된다. 한국문제는 UN의 근간이라고 할 수 있는 집단안전보장제도를 구현하게 한 계기였다. 특히 한국문제에 있어 유엔군은 매우 중요한 역할을 하고 있다. 한국전쟁 기간 동안 파병되어 지금까지 주둔하고 있는 유엔사는 과거와 현재에서 한반도의 전쟁을 억제하는 역할을 하고 있으며, 한국문제가 통일로 연결되는 장차에서도 한반도의 평화를 구축하는데 핵심적 역할을 수행할 것으로 본다. 이 글의 목적은 한국문제 또는 통일과정에서 유엔사의 지위와 역할(임무)을 재조명하는데 있다. 이를 위해, 먼저 한국전쟁 기간 동안 한반도에 투입된 유엔군의 법적 성격을 UN헌장에 근거하여 살펴보고, 한국군의 유엔사로의 작전지휘권 이양을 검토함으로써 유엔사의 지위를 논한다. 다음으로, 국제법질서에서 UN의 기능을 분석한 후 유엔사의 해체 주장과 관련하여 유엔사의 UN의 기관성 및 한반도의 평화를 구축하거나 통일과정에서 기여할 유엔사의 임무 내지 역할을 강조하고자 한다. The United States brought the problem in Korea before the General Assembly of the United Nations (UN) on September 17, 1947 and the UN has dealt with issues in Korea since then. Thus, the UN cannot be ignored in discussions on issues related to One Korea or unification. All the relationships that have been continued between South Korea and North Korea are related to Korean Question. Korean Question served as a trigger for the UN to establish a system for collective security underlying the organization. In particular, the UN forces play a pivotal role in the Korean Question. The United Nations Command(UNC) in Korea first arrived at the Korean peninsula during the Korean War and it is still operating in Korea with its roles to deter wars in Korea. It is expected that the UNC will play a critical role in securing peace in Korea after the unification. This article is intended to shed new light on the position and roles(duties) of the UNC in the Korean Question or course of its unification. In order to achieve this purpose, the article reviewed the legal aspects of the UN forces dispatched to Korea during the Korean War based on the Charter of the United Nations, examined the assignment of the command authority to the UNC and discussed the position of the UNC. Then, the article analyzed functions of the UN within the context of the international legal order and put an emphasis on the organizational characteristics of the UNC, and its potential duties or roles in the course of achieving peace in Korea or its unification.

        북한이탈주민의 법교육에 관한 법정책적 소고

        우리 사회에 정착한 북한이탈주민이 3만명을 넘어섰다. 한반도를 대한민국의 영토로 선언한 헌법 제3조에 따라 북한이탈주민이 우리 국민인 이상 어렵게 우리 사회에 정착해가는 과정에 있는 북한이탈주민에 대한 국가의 평생교육의무는 물론이고 법치주의 국가인 대한민국에 동화되기 위해서는 평생교육의 일환으로 법교육의 진흥의무가 국가에 있음은 당연하다. 수직적 집단주의와 사회주의 체제에서 성장한 북한이탈주민의 법의식은 ‘法의 無知’상태라고 할 수 있다. 북한이탈주민에 대한 국가의 법교육 지원은 그 어느 집단보다 절실하다고 하겠다. 법교육은 우리의 의지에 의하지 않고 분단되어 전혀 다른 체제에서 생활한 데서 오는 이질감으로 인해 북한이탈주민이 우리 사회에서 더불어 살아가는데 불편하지 않도록 법정책적으로 배려하는 아주 유용한 방법이다. 한편으로는, 우리사회에 안정적으로 정착한 북한이탈주민은 북한 사회와 우리 사회를 모두 경험하고 양 사회가 가진 체제의 이질감을 극복해낸 소중한 인적 자원이다. 북한이탈주민의 성공적인 정착을 돕는 법교육의 지원은 통일과정에서 북한이탈주민이 일정한 역할을 할 수 있도록 사전에 통일기반 내지 통일여건을 조성하는 중요한 의미가 있는 것이다. 2018 남북정상회담으로부터 시작된 한반도 화해모드를 볼 때 평화의 여건 성숙 및 통일에 대비하여 북한이탈주민을 건전하고 성숙한 민주시민으로 성장시키는데 법교육은 평생교육으로써 강조되고, 실시되어야 한다. The demographics of North Korean defectors settled in South Korea has reached over 30,000. As stated in Article 3 of our constitution, as it declares the Korean Peninsula as the territory of the Republic of Korea. For North Korean defectors, who live through struggles in settling down their lifelong responsibility in assimilating the Korean Legal system as long as their presence is continued in the country, whilst struggling to settle in our society, not only the nation’s lifelong education is imperative, making it logical under the commitment of a nation to promote its own laws, that it is equally inescapable for these individuals to assimilate the legal education within a nation governed by legalistic value system. The legal consciousness of North Korean defectors raised under a vertical collectivism and socialist system, is founded on the notion of ignorantia beatitudo non est. Accommodating proper legal training for these defects seems to be more pressing than any other groups, withal, to alleviate inconveniences they may encounter whilst living in our society, the legal education has great practicality for defectors benighted of our own, having their upbringing based on a system completely mis mated from ours. Au contraire, the defectors that have encountered stability in their lives here, have developed into valuable members of the society, a posteriori the subjugation of heterogeneity from their experience both in North and South Korea. Holding up the structure of providing legal education for these defectors, aiming at a successful settling in our society, could play the role of a prerequisite in building a unified basis, that will pave the road for unification conditions to appear, eventually leading to a much more fundamental role in the unification process. Under the current diplomatic resilience in the air, with the first milestones produced by the 2018 inter Korean Summit, within the scope of legal education, a clear emphasis on fomenting the growth of honest and mature democratic civis mind is needed.
