This article is a preliminary paper regarding single-session e-mail counseling to suggest its skills. It takes place by PC and internet on the text-based communications. Compared to the ordinary face-to-face counseling, the skills of single-session e-mail counseling is not so developed. However some skills were focused on three points; 1)counseling process 2)contents of counselor’s e-mail 3)formality of counselor’s e-mail. First, single-session e-mail counseling process must be more considerated e-mail situation : (1)dimensions of clients’ problems were classified in cyber counseling space (2)clients had to write the personal backgrounds,and were tested or basic psychological questionnarire. Second, contents of counselors e-mail were systematically constructed : (1)greeting & introduction of counselor (2)comforting & support (3)problem & it’s cause (4)problem solving (5)closure. Third, e-mail was written to magnifying visual effects for understanding of clients : (1)paragraph forms (2)large letters of key words & key statements (3)control of e-mails quantity (4)subjecting the key words (5)verbalization of problem solving.

아동 대상 성범죄의 전문가 참여제도에 관한 고찰 - 아동 진술의 확보와 분석에서의 개입을 중심으로 -

아동을 대상으로 한 잔혹한 성범죄가 잇달아 발생됨에 따라 아동 성범죄자에 대한 강력한 처벌을 촉구하는 사회적 요구가 커졌고, 이러한 관심은 관련법의 제·개정으로 이어졌다. 더불어 성범죄 피해 아동의 특성을 고려한 법적 제도들이 마련되었다. 아동 성범죄 사건은 피해자인 아동에 대한 특성과 아동을 대상으로 한 성범죄에서 나타나는 독특한 범죄 특성에 대한 이해와 지식이 필요하다. 특히, 아동 성범죄 사건에서는 아동의 진술이 중요한 역할을 하는 바, 신빙성을 갖춘 양질의 진술을 확보하는 것과 확보된 진술의 신빙성을 정확하게 분석하는 것이 사건을 해결하는 데 핵심적인 역할을 한다. 이에 아동 성범죄 사건에 전문성을 갖춘 전문가가 다양한 형사사법절차 내에서 개입하고 있다. 전문가 개입에 대한 법률적 근거는 형사소송법 등에 규정되어 있지만, 아동 진술의 확보 및 분석에 대한 전문가 참여의 주된 법률적 근거는 「성폭력범죄의 처벌 등에 관한 특례법」 제33조의 전문가의 의견 조회 조항이다. 형사사법절차 전 과정에서 전문가가 개입하는 여러 제도들을 살펴본 결과, 신뢰관계인 동석 제도, 진술조력인 제도, 진술조사 참여 전문 인력제, 진술분석전문가, 전문수사자문위원, 전문심리위원 제도를 통해 아동 성범죄 사건에 전문가가 참여하고 있다. 아동 진술을 확보하고 진술의 신빙성을 분석하는 데에 전문가가 좀 더 효율적으로 참여하기 위해서는 몇 가지 문제점들이 개선되어야 한다. 먼저, 전문성 수준에 대한 기준을 설정하고 전문가의 선발 등에 대한 최소한의 자격 요건을 관련법에 구체적으로 규정하여야 한다. 또, 전문가의 전문성에 대한 역량을 강화할 수 있도록 활동하고 있는 전문가를 대상으로 하는 교육 등에 관한 사항을 법률로 규정하여야 한다. 그리고 전문가에 의해 확보된 진술이 법적 효력을 갖출 수 있는 제도적 방안이 마련되어야 한다. 마지막으로 전문가에 의한 진술 신빙성 평가가 정확성과 유효성을 갖출 수 있도록 하는 절차적 장치가 필요할 것으로 판단된다. A recent a series of violent sex crimes targeting children, the social demand for harsh punishment has increased sharply and this concern led to the enactment of related law and regulations. In addition, legal institutions have been designed to considering the characteristics of sexually abused child. Child sex abuse case require understanding and knowledge of the unique nature of crimes and characteristics of child. In particular, a child's statement plays an important role in child sex abuse. Therefore, acquiring high quality statements with credibility and accurately analysing of the statements are key role in solving criminal case. Experts, who specialize in child sex abuse, are involved in various criminal justice procedures, Legal grounds for expert involvement are stipulated in 「Criminal Procedure Act」. The most important legal ground for the expert participation of child sex abuse is stipulated in the Article 33 of the 「Act on Special Case Concerning the Punishment, Etc. Of Sexual Crimes」. In this research, have checked that expert involvement in the entire criminal legal system process, have been able to verify that expert participate in child sex abuse case through Appearance of persons in relationship of trust, Intermediaries, Statement investigation related professional manpower, Statement analysis expert, Participation of professional investigative adviser and Participation of professional examiners. However, for get the exact statement by child and increase credibility of statement, the current system about expert should be improved. First, have to establish the degree of specialization about expert and the minimum qualification of expert in relevant regulation. And in order to enhance the strengthen capacity of expert, should defined about concerning experts’ education and need to legal proceeding to get legal validity about statements obtained by expert. Lastly, for increase the accuracy and effectiveness of the evaluation about credibility of statements by expert, procedural rules required.

According to existing studies, ruminating about a negative events that provoked the frustrative emotion increases the level of anger and the likelihood of aggressive activation. And dysfunctional automatic thoughts makes effects on this cognitive process. The present study examined qualitatively the effect of rumination on the cognitive distortion and the level of anger through the diary writing design. The experimental condition was the two types of social frustration with the imprecise and intangible provocateur, one is the failures by unjustifiable means and the other, arbitrary but socially acceptable means. The result showed that the characteristics of the provocateur and the dysfunctional automatic thoughts made effects on the rumination. The dysfunctional automatic thoughts function resulted in having a combined effects with the social acceptability on the level of anger and the aggression. Especially, the individual attitude to the social acceptability was found to function as a medium between the dysfunctional automatic thoughts and the its effects on the anger and the aggression, so this attitude was defined as the Probability of Social Acceptance.
