경험적 법률가 연구의 발전을 위하여 - 이호선의 「법과 정책연구」 글에 대한 검토와 제언

이 글은 이호선 교수가 < 법과 정책연구 > 제15집 제4호에 게재한 "한국 로스쿨 체제, 과연 사법시험의 대안인가?"라는 글을 비판적으로 검토한다. 첫째, 이호선의 글은 연구목적이 불분명하며, 연구문제가 부재하며, 결론을 정당화하기 위한 방법과 결과가 충분하지 않은 등 경험적 학술논문으로서의 기본요건을 갖추지 못하고 있다. 특히 이호선의 글을 선의로 해석해서 이재협 등의 연구에 대한 재현연구를 시도한 것으로 보더라도 연구의 재현성 여부를 평가할 수 있는 필수적인 방법론을 제시하지 않고 있으며, 재현연구가 갖추어야 할 최소한의 방법론적 기초를 구비하지 않고 있다. 둘째, 이호선의 글은 표집이론, 모집단, 표집틀 등 사회과학적 표본조사 연구에 사용되는 기본적인 개념을 혼동하고 있으며, 모집단과 표본 간의 상위성에 대해 오해를 보인다. 셋째, 이호선의 글에는 이재협 등의 연구에 대한 해석적 오해를 담고 있다. 특히 사법연수원 출신 법률가와 로스쿨 졸업 법률가 간 가구소득의 차이를 비교함에 있어서 비교시점을 상이하게 설정하는 등 오류를 범한다. 결론적으로 이 글은 법학교육제도와 법률직역의 구조가 급격히 변화하고 있는 상황에서 경험적 자료축적을 통한 실증연구가 필요함을 주장하며, 향후 법학과 인접학문이 공동연구를 활성화해야 함을 제안한다. This article critically reviews the paper written by Professor Lee Ho-Sun, "Korean Law School System, Is it really an alternative to Judicial Exam?", which was published in the Law and Policy Review, Vol. 15, Nov. 4. First, Lee Ho-Sun``s paper lacks basic requirements for an empirical scholarly article: (1) the research purpose is unclear, (2) the research questions are not provided, and (3) the methods and outcomes do not sufficiently support conclusions. Even if Lee Ho-Sun``s paper can be regarded as a replication study of Jae-Hyup Lee et. al.``s research, it does not provide necessary methods to assess its replicability. In addition, the paper is not equipped with minimum methodological foundations. Second, Lee Ho-Sun``s paper confuses basic concepts in social scientific sampling studies (e.g., sampling theory, population, sampling frame), and does not correctly interpret the difference between parameters and statistics. Third, Lee Ho-Sun``s paper contains many interpretive misunderstandings of Jae-Hyup Lee et. al.``s research. For example, in interpreting the household income differences between the graduates of the Judicial Research and Training Institute and the graduates of law schools, Lee Ho-Sun sets a different time frame than that used in Jae-Hyup Lee``s research. This article advocates that more empirical studies are needed to adequately assess the rapid changes in the legal educational system and the structure of the legal profession in Korea, and to that end, that more interdisciplinary research collaboration is necessary.

2016년 3월 31일부터 7월 31일까지 서울특별시 서초구 서초동에 위치한 서울고등학교 교정 일대를 서울고등학교 환경생물부 부원들이 채집 조사한 결과 20과 43속 53종의 거미가 조사 연구되어 이에 보고하는 바이다. From March 31st to July 31st in 2016, members of an environmental biology club at Seoul High School located in Seocho-gu, Seoul, Dae-Hee Kim, Dong-Woo Park, Jae-Woong Seo and Hyun-woo Lee, collected 20 families 43 genera 53 species of spiders and report the result of the study here.

And we should develop new educational process to bring up potent engineers adaptable to the training affairs, faithful to the educational object of the industrial university.

The broad consensus concerning the mixed economy and the welfare state so characteristic of western societies since the second world war has weakened a good deal in recent years. The weltare state is faced with a crisis of legitimacy, As Keynesianism and other social theories of the Centre, which served either as a practical guide to state intervention or as its intellectual nunderpinning, have lost credibility the radical critique of welfare, from Right as well as the Left, has gained ascendancy. The arguments advanced from the two ends of the spectrum of social thought-paradoxically they also share certain orientations and analysis-have acquired greater plausibility. This paper is planned as follows: Chapter II looks at the nature of the legitimacy of the post -war welfare state and the process of its erosion. Chapter III examines some major ideological orientations, namely the varions diagnoses offered and the solutions proposed with respect to the crisis in welfare and financial crisis in UK and USA. Finally, Chapter IV argues that a 'corporatist' form of the welfare state could be the way ahead.

In this study, drinking prevalence and the factors associated with drinking by gender were investigated. A cross-sectional study was conducted from 22 April to 3 May in 2002. 1000 subjects(301 females and 699 males) aged 13 to 59 were personally interviewed by trained interviewers. Data on socio-demographic characteristics, drinking related behaviors and health behaviors of subjects were collected. Among females, 191(63.5%) subjects were drinkers and preferred beverage was beer. Drinkers were likely to be 30-39 year-old, employed, religionless, smokers and metropolitan city residents. Among males, 579(82.8%) subjects were drinkers and preferred beverage was Soju. Drinkers were likely to be 19-29 year-old, religionless, jobless, smokers and county residents. After adjusting for various confounders, age, religion and smoking were statistically significantly related to drinking. Smoker(Odds ratio=2.68 females, 2.77 males) and catholic-buddhist(OR=1.51 female, 3.83 males) had higher drinking risk than non-smoker and protestant. County residents had borderline significantly lower drinking risks(OR=0.50) than metropolitan city residents among females.
『화사집』의 짐승 표상 : ‘병든 숫개’, ‘배암’, ‘숫사슴’을 중심으로

본고는 『화사집』의 주요한 짐승 표상으로 ‘병든 숫개’, ‘배암’, ‘숫사슴’을 지목하고, 이러한 짐승 표상들을 통해 직조되는 『화사집』의 원초적 생명성의 세계를 살피려는 시도다. 짐승 표상들은 화사집의 세계를 구성하는 주요한 요인이다. 그러나 짐승 표상들의 구체적 의미와 관계, 맥락을 통해 『화사집』의 세계를 체계적으로 이해하려는 시도는 부재한 상황이다. 이에 본고는 ‘병든 숫개’와 ‘배암’, ‘숫사슴’을 중심으로 짐승 표상들이 지니는 의미와 맥락을 추적하고, 이러한 짐승 표상들을 통해 직조되는 화사집의 세계를 탐색하였다. ‘병든 숫개’는 밑바닥의 세계로 육박하여 고투하는 육체의 몸부림으로 찬란함을 간취하려는 역설적 시선을 보여준다. ‘병든 숫개’의 시선은 화사집 전체를 통관하는 시선이기도 하다. ‘배암’은 여성의 육감으로 나타나는 원초적 관능의 표상으로, 수컷들을 매혹하여 원초적 욕망의 몸부림을 만들어내는 생명성의 기제다. ‘숫사슴’은 건강한 육체의 화신으로서, 근원적 생명성과 합일을 이뤄 충만해진 이상적 수컷의 표상이다. ‘숫사슴-되기’는 병든 육체의 회복 열망을 보여준다. 시인은 이러한 짐승 표상들이 보여주는 육체의 몸부림들을 밑바닥 세계에서 찬란함을 간취하게 하는 생명성의 구현 원리로 받아들이고 짐승적 본능과 육체성 회복의 서사를 써내려간다. This study points out “Sick Male Dog”, “Snake”, and “Stag” as the main representation of the beast in 『Hwasajip』. And it attempts to examine the world of life of 『Hwasajip』 created through such representation of beasts. The representation of beasts is the main factor that makes up the world of Hwasajip. However, there have been no attempts to systematically understand the world of Hwasajip through the specific meaning, relationship, and context of the representation of beasts. In this regard, this paper traces the meaning and context of representation of beasts focusing on “Sick Male Dog”, “Snake”, and “Stag”, and explores the world of Hwasajip created though these representation of beasts. “Sick Male Dog” shows a paradoxical gaze of entering the world of the bottom and trying to acquire splendor through bodily struggle. The gaze of “Sick Male Dog” is also the gaze that passes through the whole of Hwasajip. “Snake” is a representation of primordial sensuality that appears in a woman’s physical beauty. “Snake” is the mechanism of life that makes males struggle bodily with their primal desires. The “Stag” is the incarnation of a healthy body, and the representation of an ideal male who has been fulfilled through unity with the fundamental life. “Becoming a stag” shows the desire for recovery of the sick body. The poet accepts the struggles of the body shown by these representations of beasts as the principle of realization of life that acquire the splendor of the world of the bottom, and writes the narrative of the restoration of the beast's instinct and physicality.
