A number of complicated legal issues tend to arise due to the long latency period of tort litigations over exposure to toxic substances. In such cases, a plaintiff has the burden of proving: (a) exposure to a toxic substance; (b) damages incurred therefrom (such as a toxic substance-related illness); and (c) the causal link between the exposure and illness. Of note, causation is considerably difficult to establish inasmuch as the likelihood of multiple intervening causes is greater with the passage of time. That said, the causation element is the most heatedly disputed in toxic tort cases. A plaintiff must prove: (i) general causation by offering epidemiological and toxicological evidence; and (ii) specific causation by ruling out such alternative causes as pre-exposure health, nature of disease, lifestyle, and family history. In particular, the burden of demonstrating causation should be mitigated in consideration of signature disease and relative risk. Furthermore, the admissibility and reliability of expert testimony should be determined in full view of the testability of hypothesis, peer review, error rate, and general acceptance of hypothesis. In cases where the likelihood of developing an illness can be reasonably predicted due to considerable exposure to a toxic substance, solatium and medical monitering expenses that incurred or likely to incur should be compensated. In cases where a person developed an illness caused by exposure to a toxic substance, substantial damages should be awarded in consideration of the seriousness of illness, impact on the damaged person’s life, and intent of the perpetrator’s act. The extinctive prescription runs from the period of time when the latent damage incurred and when the causation between the toxic substance exposure and latent damage was known. Against such backdrop, there is a need to mitigate the burden of proof whilst adequately responding to requests for relief from exposure to a toxic substance and avoiding the floodgates of litigation. 유독물질의 노출로 인한 불법행위소송은 장기간의 잠복기로 인하여 여러 가지 어려운 법적 문제가 제기된다. 원고는 ① 유독물질의 노출, ② 손해, ③ 유독물질의 노출과 질병 사이의 인과관계를 입증하여야 한다. 우선 원고가 질병을 유발할 정도로 상당한 정도로 유독물질에 노출되었다는 점을 입증하여야 한다. 특히 인과관계를 입증하는 것은 매우 어려운데, 이는 시간의 경과에 따라 다른 발병요인이 개입할 가능성이 크기 때문이다. 인과관계는 소송에서 가장 활발하게 다투어지는 요건이다. 원고는 역학과 독성학을 활용하여 일반적 인과관계를 입증하고, 다른 발병원인(유독물질 노출 이전의 건강 상태, 질병의 성격, 생활습관, 가족력 등)을 배제하는 방식으로 개별적 인과관계를 입증하여야 한다. 특히 지표질환과 상대위험도를 고려하여 인과관계의 입증책임을 완화하여야 한다. 인과관계의 인정에 있어 중요한 역할을 하는 전문가증언의 신빙성을 판단하기 위하여 ① 가설의 실험에 의한 재현가능성, ② 동료전문가에 의한 검증, ③ 가설의 오류율, ④ 가설의 일반적 수용가능성을 종합적으로 고려하여야 한다. 유독물질에 상당한 정도로 노출되어 발병가능성이 합리적으로 예견되는 경우에는 위자료와 질병의 발병가능성을 진단하는 비용이 배상되어야 한다. 유독물질의 노출로 인한 질병이 발병한 사안에서는 질병의 중대성, 개인의 삶에 미치는 영향, 가해자의 비난가능성을 고려하여 고액의 위자료가 인정되어야 한다. 소멸시효는 잠복손해가 현실적으로 발생하고 유독물질의 노출과 잠복손해 사이의 인과관계를 인식할 수 있었던 시점부터 진행한다. 유독물질의 노출로 인한 피해 구제의 요청과 소송폭주의 위험에 적정하게 대응하면서 입증책임을 완화할 필요가 있다.
