        특가법상 뇌물죄의 수뢰액에 관한 헌법합치적 해석

        특정범죄가중처벌 등에 관한 법률 제2조 제1항은 수뢰죄를 범한 자를 가중처벌하면서 수뢰액의 크기에 따라 법정형을 달리 규정하고 있는바, 이에 대하여는 입법 초기부터 위헌 여부에 대한 논의가 끊이지 않았다. 최근 헌법재판소는 특가법 제2조 제1항 제1호에 대하여 합헌결정을 하였으나, 관여재판관 9인 중 4인이 위헌의견을 개진함으로써, 적어도 특가법 제2조 제1항이 위헌의 소지가 있는 입법이라는 점은 부인하기 어렵게 되었다. 따라서 특가법 제2조 제1항을 적용, 해석함에 있어 위헌성을최소화할 수 있는 헌법합치적 법률해석과 형벌규정에 대한 엄격해석 원칙이 다시금 강조될 수밖에 없다. 위헌성을 지니고 있긴 하지만 합헌으로 선언된 법률의 해석은 법원의 임무에 속하고, 법원은 법률을헌법합치적으로 해석하여야 한다. 특가법상 뇌물죄의 적용에 있어 수뢰액은 엄격한 증명이 이루어져야하고, 검사가 피고인의 구체적 수뢰액을 입증하지 못한 경우에는 특가법상 뇌물죄를 적용할 수 없다. 특히 법원이 특가법상 뇌물죄 사안에서 수뢰액을 인정함에 있어서는, 기존의 수뢰액 인정에 관한 법리- 예컨대 공무원 등이 수수한 금품에 직무행위에 대한 대가로서의 성질과 직무외의 행위에 대한 사례로서의 성질이 불가분적으로 결합되어 있는 경우, 그 전부가 불가분적으로 직무행위에 대한 대가, 즉수뢰액으로 보아야 한다는 법리 등 - 를 무비판적으로 적용하여 특가법의 적용대상을 편의적으로 확장하지 않도록 유의하여야 할 것이다. Article 2 Section 1 of the Additional Punishment Law on Specific Crimes provides that a bribee should be punished severely according to the sum of bribe. Recently the Constitutional Court decided that the provision of the law is constitutional in an opinion of 5(constitutional) to 4(unconstitutional). But that is still a matter of debate. The Supreme Court has the authority to interpret the provision of the law which declared constitutional. The provision of the law must be interpreted constitutional and strictly. The broad application of the provision which has a controversial issue, should be restricted until the provision is reformed. Above all, when the provision of the law applies to a bribery case, a sum of bribe must be proved strictly by a prosecutor, if not, the provision of the law should not be applied. Furthermore, the court should not follow a precedent about sum of bribe without criticism, since a sum of bribe in a crime of bribery regarding the Additional Punishment Law on Specific Crimes is not just one of elements in the examination of an offense, but the requirement for the application of the provision.

        천연 단백질 고분자를 이용한 모직물의 형태안정가공에 관한 연구(ㅣ) -모직물에 의한 케라틴 가수분해물의 흡착거동-

        Adsorption behavior of hydrolyzed wool keratins onto wool fabric was first studied systematically for the purpose of improving the permanent set of a wool fabric. The adsorption isotherm of the keratin onto wool fabric showed a Langmuir type and was found to be influenced by pretreatments such as swelling and reduction of wool fabric. Indeed, by the reduction, the diffusion coefficient of the hydrolyzed keratin was increased by about 10 times as large as that of the untreated wool fabric. It was indicated from the solubility test and washing test that new crosslinks were possibly formed by the adsorption of keratin and the subsequent oxidation. Dyeing behavior of the keratin adsorbed wool fabric was also discussed in terms of the adsorbed amount of hydrolyzed keratin.

        High oil prices have a huge impact on various industries, businesses and individuals daily lives. In addition, it is expected that various means of transportation using eco-friendly power will gradually increase due to the intensification of regulations on greenhouse gas emissions of existing internal combustion engines. Among them, small mobility is expected to gradually increase in demand as one of the economical and convenient short-distance transportation means due to the steady increase in single-person households. For this, lightweight technology is required. Therefore, in this study, we will look into the lightweight bumper structure that integrates the steel hood and fender with the plastic bumper among the current vehicle body exterior panels.

        In the past, radiator grilles in internal combustion engine vehicles were one of the important roles of engine cooling. However, as the paradigm changes from internal combustion vehicles to electric vehicles, the engine cooling role of radiator grilles is gradually decreasing. Therefore, the design of the radiator grilles, a key element of automobile exterior design, is also expected to change. As one of them, the lighting grille, which applies LED lighting to the radiator grille, can differentiate design and improve high-quality in appearance compared to existing internal combustion engines. Therefore, this study examines the concept and design focus reviews of lighting grilles that are expected to be expanded in electric vehicles in the future. Furthermore, we will look at matters that require additional review and preparation for the development of lighting grilles.

        In the past, bumpers were structures mounted on the front and rear of vehicles to reduce impact in the event of a collision and to minimize repair costs due to collisions at low speeds. These bumpers are currently undergoing many changes in the era of electric vehicles and self-driving cars and are expected to undergo significant changes in the future. It became a situation where reinforcement was needed more. As such, this study is a technology that integrates lamps and bumper s among various bumper function changes according to future technological changes such as electric vehicles and autonomous vehicles. We are going to look at ways to implement seamless hidden lighting bumper technology that can strengthen the overall design unity of the vehicle by integrating parts to be hidden until the lamp is turned on.

        두경부에 동시 발생한 성숙 기형종과 이소성 위장관 낭종 1예

        Teratoma is a congenital tumor which occurs rarely in the head and neck. Head and neck teratomas have been described infrequently in the literature as a result of their low incidence, occuring in only 1 in 20,000 to 40,000 live births. And the heterotopic gastrointestinal cyst, a type of choristoma, is uncomon in head and neck also. Patients with these tumors have symptoms related to difficulties with swallowing and respiration that could result in high degre of morbidity and mortality by nasopharynx and a heterotopic gastrointestinal cyst of left submandibular gland. We review the literature pertaining to teratoma and heterotopic gastrointestinal cyst in head and neck. (Korean J Otolaryngol 2003 ;46 :536-9)

        돌발성 난청을 주소로 내원한 소뇌교각부 지방종 1예

        Intracranial lipomas are uncomon and rarely symptomatic benign tumors comprising 0.1% of intracranial tumors. Although e tumors. And lipomas within the cerebellopontine (C-P) angle and internal auditory canal are extremely rare. In the C-P angle region, lipomas are the most symptomatic compared in other intracranial regions, although symptoms depend on the origin site and involve neural and vascular tissues adjacent to lipomas. And hearing loss, dizziness and tinnitus are the commonly presenting symptoms. Among these symptoms, hearing loss is the most comon, but sudden hearing loss, as in this case, has not been s the best treatment option for patients with these rare lesion. But surgery is indicated only when significant progresive or disabling symptoms are present. We experienced a case of right side C-P angle lipoma with sudden hearing loss in a 49-year old female who showed complete recovery of hearing by conservative therapy. With a review of literature, authors report a case of right C-P angle lipoma presented as sudden hearing loss. (Korean J Otolaryngol 2002 ;45 :1098-101)

        Laryngeal cancer is known to show relatively good prognosis. Though primary object of laryngeal cancer treatment is to save patient's life, it is also important to support patient's quality of life by preserving laryngeal function. During the 1960s through 1980s, researches about anatomy of larynx were proceeded many innovative surgeons reported numerous small series of patients in which the indications and extent of resection of these basic techniques were extended in an attempt to manage larger lesions. Today, there is a variety of techniques available for selected laryngeal malignancies, with predictable functional and oncologic outcome based on analysis in the literature of many patients. Conservation laryngeal surgery is precision surgery and to achieve successful oncologic and functional results, the conservation laryngeal surgeon should have a firm grasp of the clinical assessment of laryngeal cancer and a complete understanding of the surgical techniques.

      • 3차원 직육면체 대공간 내에서의 열 및 기류 유동에 관한 연구

        본 연구에서는 대공간 내에서의 열 및 기류 유동 현상을 연구하기 위하여 464×300× 950mm^3크기의 축소 모형으로 아트리움을 제작하였다. 가상 화재를 모사하기 위하여 대공간 하단에 히터를 설치하였으며, 히터의 온도에 따른 대공간 내의 온도분포를 측정하였다. 본 실험에서 얻은 결과는 아트리움과 같은 대공간에서 화재가 발생하였을 경우에 열 및 기류 현상을 해석하기 위한 기초자료 및 열유동 현상을 해석하는 수치해석 프로그램의 계산 결과의 기준 데이터로도 이용될 수 있을 것이다.
