제주자치경찰 비판에 대한 비판적 고찰 - 제주자치경찰의 정체성을 중심으로 -

2006년 7월 1일 우리나라에서는 처음으로 제주특별자치도에 자치경찰을 도입하였 다. 당시 참여정부에서는 자치경찰제를 기초자치단체 단위로 도입할 것을 제안하였다. 이는 한편으론 당시까지 논의된 자치경찰의 큰 방향이 ‘시도단위 자치경찰제’였다는 점을 감안할 때 ‘유레카’에 비유될 정도로 신선한 충격이었다. 다른 한편으론 자치경찰 제가 ‘무늬만 경찰’이지 경찰분권 등 자치경찰제의 의의를 찾아보기 어려운 모형으로 결국 지방자치단체의 재정부담만 늘릴 것이라는 반발과 비판이 강하게 제기되었다. 무 엇보다도 자치경찰의 사무가 방범순찰, 지역교통, 지역경비 등으로 그 범위가 너무 제 한적이고 비권력적인 활동으로 일반행정기관에서도 담당할 수 있는 업무이어서 국가 경찰과 병립하는 (자치)‘경찰’로 보기 어려웠기 때문이다. 또한 중앙집권적 국가경찰체 제는 전혀 손대지 않은 채 그와는 별도로 자치경찰을 새로이 조직한다는 것이었기 때 문이다. 이러한 가운데서도 지난 2014년 12월 대통령 소속 지방자치발전위원회에서는 기초 자치단체에 자치경찰단을 설치하여 범죄예방, 질서유지, 학교폭력 등과 같은 주민생활 과 밀접한 사무를 수행하는 자치경찰제 확대방안을 제시하였다. 이는 많은 비판을 받 고 있는 제주자치경찰제를 확대 시행하겠다는 것이나 다름없다. 여기서 제주자치경찰에 대한 비판이 과연 타당한지 여부를 살펴볼 필요가 있다. 만 약 제주자치경찰이 자치경찰제의 의의를 전혀 살리지도 못하고 앞으로도 그럴 가능성 이 없다면, 다시 말해 제주자치경찰이 향후 전국적으로 확대 도입될 자치경찰제의 이 정표로서 역할을 하지 못한다면 굳이 시범운영할 필요조차도 없을 것이기 때문이다. 이러한 점을 고려하여 본 연구는 제주자치경찰에 대한 비판을 비판적으로 고찰해보 고, 이를 기초로 향후 자치경찰제의 성공적 도입을 위한 정책적 대안을 제시하고자 한다. July 1, 2006 Jeju Special Self-governing Province and municipal police system in Jeju was implemented. By establishing the Jeju municipal police system in Jeju-do, the korean municipal police system on the one hand were able to provide a customized police service proper to residents' intention and Jeju's characteristic. However this system has been on the other hand criticized as 'pattern, only the police’ for the Jeju municipal police. Last December 2014 Presidential Committee on Local Autonomy Development has a special promotion agenda which provides catered policing service through the introduction of municipal policing system, reflecting the characteristics of the local region. This is the same as the commitment, that will expand the Jeju municipal police system getting a lot of criticism. In this background, it is need to look at whether the criticism of Jeju municipal police system is indeed reasonable. If the Jeju municipal police system is not at all bring the basic idea of the municipal police system, or there is no possibility to find the meaning of that system, it will be fruitless to expand the municipal police system such as the Jeju municipal police. This study aims at for the first time looking at critically the criticism of the Jeju municipal police system. And then the author suggests policy options for the successful establishment of the municipal police system in Korea.

검경 수사권 조정에 관한 법안의 비교․검토

The recently discussed Redesign of Investigation System is being conducted in order to remove the obstacles of the prosecution 's infinite power to monopolize the power of investigation and prosecution. However, there are various perspectives in the methodology of how to reform it. The government, however, has drawn up a government consensus as a concrete measure of prosecution reform. Several Bills have been submitted to the National Assembly to reflect this consensus. These Bills largely meet the need for the Redesign of Investigation System, especially separation of investigation and prosecution. However, there is a high possibility that the method of installing the investigation agency that shows a big difference in the methodology will act as a variable. Nevertheless, since there is a consensus on the intention of the separation of the investigation – prosecution, there is enough room for adjustment. It is time for the National Assembly to finish the Discussion on the Redesign of Investigation System, even if there is opposition and resistance from the prosecutor. 최근 논의되는 수사권조정은 수사권과 기소권을 독점한 검찰의 무소불위 권한의 폐해를 극복하기 위한 차원에서 이루어지고 있다. 다만, 이를 어떻게 개혁할 것인가의 방법론에서는 다양한 시각이 존재한다. 정부에서는 그럼에도 검찰개혁의 구체적 방안으로서 정부합의안을 도출하여 발표하였다. 지금 국회에는 이 합의안을 반영한 여러 법안이 제출된 상태이다. 여기서는 백혜련 의원안, 심상정 의원안, 곽상도 의원안, 박지원 의원안, 김석기 의원안, 오신환 의원안 등을 중심으로 검토하였다. 이들 법안들은 공통적으로 수사권조정의 필요성, ①수사와 기소의 분리를 통한 검찰권 축소, ②검찰의 직접수사 범위 제한 및 이를 뒷받침하는 장치의 조정, ③그와 연계한 검사의 수사지휘권 등을 대부분 충족하고 있다. 다만 방법론에서 큰 차이를 보여주는 곽상도 의원의 수사청 설치방안이 변수로 작용할 가능성이 높다. 그러나 수사-기소 분리라는 수사권조정의 취지에 대한 공감대가 형성된 만큼 조정의 여지도 충분하다. 이제 국회에서 수사권조정 논의를 매듭을 지을 때이다.

형사법 편향적 경찰활동에 대한 비판적 고찰

The purpose of this study is to analyze the cause of the problem that the current police activities are overly criminal-oriented. The study also starts with the awareness that the area of ​​administrative police for "public safety" through risk (or crime) prevention is being eroded. Based on this consciousness, we analyzed the causes of the problem and tried to suggest ways to cope with the police activities based on the criminal law. There is a fear that the safety of the people can not be guaranteed from the crime (danger). This may lead to the contraction of on-the-spot police activities and consequent encroachment of the administrative police area. In this background, what should we do in order to overcome the criminal justice-biased police activity? From the point of view of separation of police functions, first of all we have to separate administrative and judicial police. Through this, it is necessary to enhance the specialization of investigation by the judicial police on the one hand and strengthen the administrative police area on the other. Next, however, sufficient legal grounds for administrative police activities should be laid out to minimize the adverse effects of separation of administrative police and judicial police. The paradigm of police control through prosecution should be converted to court or democratic control. The procedural part of the warrant provision(by request of the prosecutor) in constitution should be deleted to reduce the rigidity of the warrant system. 우리나라의 경찰활동은 방범순찰 등 예방적 활동이 적지 않은 비중을 차지하고 있음에도, 실제로 현장에서 무언가를 할 수 있는 조치는 형사소추의 목적을 위해서만 가능하다는 인식이 팽배해 있다. 즉, 현장의 경찰관들에게 위험방지 등 사전예방적 차원의 활동은 그저 소극적으로 ‘순찰’하는 정도일 뿐, 강제력을 수반하는 ‘적극적 경찰활동’은 범죄수사를 목적으로 하는 경우에만 가능한 것으로 인식되어 있다는 것이다. 문제는, 현장에서는 형사소추 목적의 범죄수사와 비교하여 공공의 안전을 위한 사전예방적 활동이 요구되는 경우가 결코 작지 않고, 그것이 적시에 이루어지지 않았을 경우 그 파급력도 만만치 않다는 점이다. 그런데도 현장의 경찰관들이 형사소추 목적이 아닌 사전예방적 영역에서 소극적인 경찰활동으로 일관한다면 그 피해는 결국 국민이 지게 된다. 이러한 문제의식에서 이 논문은 현행 경찰의 활동이 지나치게 형사법 편향적이어서 위험(또는 범죄)예방을 통한 ‘공공의 안전’을 위한 행정경찰의 영역이 잠식당하고 있다는 문제의식에서, 그 원인을 분석하고, 이를 토대로 형사법 편향적 경찰활동을 극복하기 위한 방안을 제시하고자 하였다.

게이지 고정과 양자색소역학에서의 진공

Many problems exist in quantum chromodynamics (QCD) although it constitutes an important part in the standard model as the theory of strong interactions. One typical problem is the confinement problem,which has recently been studied quite seriously. In order to explain the results of lattice calculations, maximal Abelian gauge (MAG) has been introduced, and the gauge-fixing procedures turn out to be related to the idea of vacuum condensates, which gives a new perspective to the QCD vacuum. In this paper, we review the gauge-fixing procedures in the process of quantization of gluon fields and discuss the relations between various gauges and vacuum condensates with an eye to new definitions of the QCD vacuum. 강작용 이론으로서 양자색소역학은 표준모형의 중요한 한 축을 형성하고 있지만아직은 해결해야할 많은 문제점들이 남아있는 것이 사실이다. 가장 대표적인 문제가 쿼크나 글루온의 속박 문제인데 최근 들어 이와 관련된 연구가상당히 진전되고 있다. 반실험적 측면에서 격자 게이지 이론을 사용한 컴퓨터 계산 결과를이론적인 관점에서 설명하려는 노력의 결과 최대 아벨 게이지(MAG) 고정 방법이 도입되었고,몇 단계의 수정 과정에서 진공 응축과 관련된 생각들이 제시되면서 양자색소역학에서의진공에 관한 새로운 관점들과 연계성이 있는 것으로 판명되고 있다. 이 논문에서는 글루온 장의 양자화 과정에서 주어져야 하는 게이지 고정의 방법이 어떻게진공 응축과 관련되어 있고, 이 진공 응축이 강작용에서의 진공 정의에 어떠한 영향을주는지 논의하려 한다.
