정당해산에 관한 베니스위원회 기준과 그 적용 -통합진보당 해산심판청구를 계기로-

이 글은 정당의 결성과 활동에 관한 다양한 기준들을 제시해 온 베니스위원회의 정당해산과 관련 지침과 의견들의 내용을 소개하고, 이를 기준으로 현재 진행중인 통합진보당 해산심판청구의 당부를 평가하기 위한 목적으로 작성되었다. 2000년 공표된 ‘정당의 금지와 해산 및 유사 조치에 관한 지침’과 2010년의 ‘정당 규제에 관한 지침’, 그리고 2009년에 채택된 ‘터키에서 정당의 금지에 관한 헌법 및 법률 규정에 관한 의견’을 중심으로 정당의 해산 또는 금지와 관련된 베니스위원회의 기준을 비적용원칙, 예외적 적용 원칙, 합법성 원칙, 비례성 원칙 및 절차적 요건으로 정리한 후 이를 바탕으로 통합진보당 해산심판청구가 이들 원칙에 위반됨을 논증하였다. 아울러 민주적 정치과정에서 핵심적 중요성을 가지는 정당의 의의를 고려할 때, 통합진보당에 대한 정부의 정당해산심판청구는 다양성, 다원성을 바탕으로 구축되어야 하는 민주주의를 ‘종북’이라는 모호한 자의적·편향적 개념으로 재단한 지극히 반민주적인 조치일 뿐 아니라 모든 권력과 수단을 동원하여 반대세력을 배제하고자 하는 엄청난 폭력성이 거기에 있음을 분명히 하였다. In this article, I aimed at making clear the implications of various guidelines and opinions regarding the prohibition and dissolution of political parties of the Venice Commission and clarifying the unreasonableness of the governmental request seeking dissolution of the Unified Progressive Party(UPP) in terms of the standards presented by the Commission. For this purpose, I analysed three documents of the Commission: ‘Guidelines on prohibition and dissolution of political parties and analogous measures’(2000), ‘Guidelines on Political Party Regulation by OSCE/ODIHR and Venice Commission’(2010), and ‘Opinion on the Constitutional and Legal Provisions relevant to the Prohibition of Political Parties in Turkey’(2009). Through the analysis, I summarized the standards of the Commission regarding dissolution of political parties into five principles: non-dissolution, exceptionality, legality, proportionality and judicial decision by sufficient evidence. And then I demonstrated how and why the complaint for dissolution of the UPP by the Korean government can not be compatible with any of those principles. In conclusion, governmental request for dissolution of the UPP must be not only an extremely anti-democratic measure suffocating the democratic political system based on diversity and pluralism, but also be a naked violence to eliminate every single opposition using every possible means.
